STATEMENT OF ISSUE: Should the Parking Authority of the City of Huntington Beach set the
time and place for their regular meetings as the first and third Mondays of each month at 6:30 P.M., in
City Council Chambers at 2000 Main Street.
RECOMMENDED ACTION: Approve Resolution , and thereby change the time and place
of the Parking Authority of the City of Huntington Beach to the first and third Monday of each month
at 6:30 P.M., in the City Council Chambers at 2000 Main Street, Huntington Beach, CA.
ANALYSIS: The regular meetings of the Parking Authority was set by their Resolution 1, back in
1967 to coincide with the time and place of the City Council at that time. Since then the City Council
has changed both the time and place of their regular meeting. By approving the attached resolution, the
regular meeting of the Parking Authority will coincide with the regular meetings of the City Council.

ALTERNATE ACTIONS: Provide direction to staff on an alternative meeting schedule.

RESOLUTION NO. 19
A RESOLUTION OF THE PARKING AUTHORITY OF THE CITY OF HUNTINGTON
BEACH REVISING RESOLUTION NO. 1 FIXING THE TIME AND PLACE OF
REGULAR MEETINGS, APPOINTING OFFICERS AND PROVIDING FOR SERVICES
AND FACILITIES OF CITY DEPARTMENTS.
The City Council of the City of Huntington Beach, acting as the Parking
Authority of the City of Huntington Beach, California, does hereby resolve as follows:
SECTION 1. That regular meetings of said Parking Authority shall be held
every first and third Monday of each month at the hour of 6:30 o'clock P.M. in the
Council Chambers in the City Hall, 2000 Main Street in said city, and that in all respects
meetings of said Parking Authority shall be governed by and be in compliance with the
Ralph M. Brown Act(Sections 54950, et seq. of the Government Code of the State of
California.) Except as otherwise provided in the Parking Law of 1949 (Sections 32500,
et seq. of the Streets and Highways Code of the State of California), the rules of
procedure of the City Council as set forth in the Charter of said city shall also apply to
the City Council acting as the Parking Authority insofar as such rules can be made
applicable.
SECTION 2. That pursuant to the designation previously made the Mayor shall
act as ex officio as the Chairman of said Authority.
SECTION 3. That the Mayor Pro-Tem shall act ex officio as the Vice-Chairman
of said Authority.
SECTION 4. That the City Clerk shall act as ex-officio as the Secretary of said
Authority.
SECTION 5. That the City Treasurer shall act ex-officio as the treasurer of said
Authority and shall keep the monies of said Authority in the City Treasury but separate
and apart from monies of the city.
SECTION 6. That the City Attorney shall act ex-officio as the legal advisor to
the Authority.
SECTION 7. That the City Administrator shall act ex-officio as the chief
executive officer of said Authority and as such shall be responsible for the
administration of such Authority business.
SECTION 8. That pursuant to the authority granted by Section 32812 of the
Streets and Highways Code, and in order that there be no unnecessary duplication of
effort or expense, the Finance Department, the Public Works Department and the
Community Development Department of city shall furnish to the Authority services in
connection with matters within the scope of the normal activities of the particular
department and the Authority may use the facilities of any such department. Until the

City Council and the Authority determine otherwise, such services and such use of
facilities shall be without charge to the Authority.
SECTION 9. Resolution No. 1 and all resolutions in conflict herewith are
hereby repealed.
PASSED AND ADOPTED by the Parking Authority of the City of Huntington
Beach at a regular meeting held thereof on the 20th day of September , 1994.

A RESOLUTION OF THE PARKING AUTHORITY OF THE
CITY OF HUNTINGTON BEACH FIXING THE TIME AND
PLACE OF REGULAR MEETINGS, APPOINTING OFFIC-
ERS AND PROVIDING FOR USE OF SERVICES AND '
FACILITIES OF CITY DEPARTMENTS-
The City Council of the City of Huntington Beach,
acting as the Parking Authority of the City of Huntington
Beach, California, does hereby resolve as follows :
Section 1. That regular meetings of said Parking
Authority shall be held every first and third Monday of
each month at the hour of 4:30 o'clock P.M. in the Council
Chambers in the Memorial Hall, Sixth and Pecan in said City,
and that in all respects meetings of said Parking Authority
shall be governed by and be in compliance with the Ralph M.
Brown Act (Sections 54950, et seq. of the Government Code
of the State of California). Except as otherwise provided
in the Parking Law of 1949, the rules of procedure for the
City Council as set forth in the Charter of said City shall
also apply to the City Council acting as the Parking Author-
ity insofar as such rules can be made applicable.
Section 2. That pursuant to the designation pre-

legal work. Such special counsel shall co-operate with and

officio as the chief executive officer of said Authority and
as such shall be responsible for the administration of such
Authority.business as by law is not required to be directly
administered by this Authority.
Section 8. That pursuant to the authority granted by
Section 32812 of the Streets and Highways Code, and in

At your request the City Clerk's Office found the previous resolution of the Parking Authority that
set the time and place of meetings and is now out-of-date.
We received your new up-dated resolution and now request that your office prepare a Request for
Council Action to be placed on the City Council's agenda.

SUBJECT: Response to your May 25, 1994, memo, RLS 94-356
I have modified the resolution of the Parking Authority to have the meeting time and
location conform to the city council regular meetings. In considering modifying.ft rules
for special meetings which would allow the appropriation of funds for this agency, I
discussed the matter with Robert Franz, and we concluded that there is a strong
likelihood we will be closing out this authority after the 1994-95 budget activities have
slowed down. In the meantime, there is no expectation of a need for a special meeting
for the appropriation of funds, and, inasmuch as the Brown Act now provides for
posting as well as notice to the newspapers of our meetings, it is my opinion that it is no
longer necessary to open and/or report the regular meeting of the Parking Authority at
each council meeting.
