Hopkins, PE, Director of Public Works Subject: Adopt Resolution No. 2018-31 Establishing Permit Parking District "W" Affecting Residents on Farinella Drive between Edwards Street and Cooper Lane. Statement of Issue: Residents on Farinella Drive between Edwards Street and Cooper Lane have petitioned to establish a residential permit parking district, Permit Parking District "W° in Huntington Beach. Financial Impact: The provisions of Huntington Beach Municipal Code Chapter 10.42 requires that the residents choosing to participate in a residential permit parking district pay a proportionate share of the cost to establish a district making the district cost neutral to the City. Typical costs include, but are not limited to, installation of signs, curb markings, staff time to issue permits, and administrative costs to create a new parking district. Recommended Action: Adopt Resolution No. 2018-31, "A Resolution of the City Council of the City of Huntington Beach Establishing Permit Parking District "W' Within the City of Huntington Beach" Alternative Action(s): Deny the recommended action. Analysis: Residents on Farinella Drive, between Edwards Street and Cooper Lane, submitted a petition requesting permit parking due to parking impacts, noise, and littering issues from commuter parking. The area is located north of Warner Avenue, east of Edwards Street just north of the Wintersburg channel, and is shown on Attachment 1. The residents expressed that these concerns occur daily preventing the use of on-street parking for themselves and guests, and are inconvenienced by late night noise and disposing of trash left on their front yards by others. The residents have requested that the permit parking restrictions be in place all day, every day, including holidays. Ballots to vote on the permit parking district request were sent to the eleven (11) properties fronting Farinella Drive between Edwards Street and Cooper Lane. Ten (10) of the properties returned the ballot with eight (8) supporting establishing permit parking. Municipal Code Chapter 10.42 requires a minimum of 75% of the property units to be in favor of the parking district to move the request for further consideration. The first eight (8) of nine (9) properties fronting Farinella Drive east of Edwards Street voted in favor of creating a permit parking district. The last two properties fronting Farinella Drive with Cooper Lane addresses voted against establishing permit parking. Due to these two properties not supporting permit parking staff removed these addresses from the requested permit parking area. Attachment 2 shows the recommended properties along Farinella Drive to be included in the requested parking district. As required by code, staff investigated the conditions on Farinella Drive in the requested permit parking area to examine the parking conditions and related concerns. Field observations and discussions with the residents demonstrated that the street experiences recurring parking impacts from commuter vehicles, with the most significant impacts occurring late evenings, early mornings, and on the weekends. Due to these conditions, staff believes findings can be made showing that commuter parking unreasonably and regularly interferes with the use of available street parking for residents and their guests, and causes other related disturbances. These findings are consistent with the Municipal Code requirements as a basis for establishing permit parking. The number of addresses that would comprise the permit parking district is nine (9). Notices were sent to the affected properties and properties within 500 feet of the proposed district boundaries indicating the date and time of the City Council meeting. Figure 1 shows the requested new parking district consisting of nine (9) properties on Farinella Drive. Requested Permit Parking District on Farinella Drive. 2 Page -49- Staff received a petition from residents on Farinella Drive east of Edwards Street requesting permit parking be established on the street. The reasons for the request include issues with the availability of on-street parking for residents and their guests,trash placed on the street and front yards, and excessive late night and early morning noise attributed to vehicles parking from the nearby apartment complexes. As required by regulations of Municipal Code Chapter 10.42, Permit Parking Districts, staff reviewed and determined that the petition and request were valid. The proposed boundaries were examined and a determination was made to include all the properties fronting Farinella Drive between Edwards Street and Cooper Lane as the permit parking area for consideration as shown in Figure 2. Table 1-Voting Results for Permit Parking District Proposal, Properties Fronting Farinella Drive No. of Addresses 11 No. of Ballots Returned 10 Votes Supporting Permit Parking 8 Votes Not Supporting Permit Parking 2 Percent Supporting Permit Parking Amendment 73% Results of the returned ballots were 73%of the property units fronting Farinella Drive between Edwards Street and Cooper Lane supported permit parking. Municipal Code Chapter 10.42 requires a minimum of 75% of the property units to be in favor of permit parking to continue evaluation of the request. Examination of the voting showed that 89% of the property units with Farinella Drive addresses supported the request, while the last two addresses intersecting Cooper Lane voted to not support permit parking. Results are shown in Figure 3 on the following page. Since the two east end properties fronting Farinella Drive, 16751 Cooper Lane, and 16781 Cooper Lane did not support the request (1 no vote, 1 ballot not returned), residents and staff discussed and it was agreed to remove these properties from participating in the proposed parking district. With these properties removed the voting supported a permit parking district consisting of properties with Farinella Drive addresses only as originally requested (Figure 1). The voting results removing the last two east properties are shown in Table 2. Permit Parking Voting Results on Farinella Drive. 5 Page -52- Field survey of parking conditions: As part of the process for evaluating a residential permit parking district request, staff conducted field investigations of the area to examine the existing parking conditions and commuter vehicle related disturbances. The following information is from separate field reviews of the street. Based on the field observations and discussions with the requesting residents,the proposed permit parking district street experiences recurring parking impacts from commuter vehicles. The on-street parking impacts regularly occur during the evening and early morning hours on weekdays and on weekends as shown in the photos on the following pages. In addition to the parking impacts from the commuter vehicles,the residents have expressed concerns with trash on the street and late night excessive noise said to occur nightly. Because of the parking impacts and associated disturbances the property owners are strongly in favor of establishing permit parking. - Staff Recommendation: Based on the field observations and discussion with the requesting properties staff is recommending establishing permit parking along the Farinella Drive, Farinella Drive addresses only, every day, all day, including holidays. The last two properties on the east end of Farinella Drive would not be included due to not supporting the permit parking district request. Staff believes findings can be made which demonstrates that commuter vehicle parking unreasonably and regularly interferes with the use of the available street parking for residents and their guests. Farinella Drive parking impacted area at night. 9 Page -56- I RESOLUTION NO. 2018-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING PERMIT PARKING DISTRICT "W" WITHIN THE CITY OF HUNTINGTON BEACH WHEREAS, the City Council has adopted Ordinance No. 4051, allowing the establishment of permit parking districts in residential areas under certain conditions; and The citizens owning properties along the residential street known as Farinella Drive between Edwards Street and Cooper Lane have petitioned for establishment of a permit parking district to be in effect all day, every day; and The Director of Public Works reviewed the petition, sent a ballot for further consideration to residents of the petitioned streets, and caused an investigation which reasonably established that unrestricted parking interferes with available parking for residents and guests, and produces sources of health and safety concerns, Therefore, the Director of Public Works has found the requirements of Ordinance 4051 to be reasonably fulfilled, and determined that the Permit Parking District will not affect other uses of on-street parking. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. The above recitals are all true and correct. 2. Permit Parking District "W" is hereby established to include properties along Farinella Drive between Edwards Street and Cooper Lane, effective all day, every day. I'm not sure if my;husband and I will be able to attend the council meeting tomorrow, our baby is sick and we aren't sure if he will be well enough for us to attend tomorrow. We wanted to share our input about the proposed residential parking permit. We understand that we can't carry out a conversation via email about our concerns, so we will just list our points of concern here. My husband and I bought our house on Farinella Dr. in 2016. He has lived in HB for about 8 years and I have lived here 31 years. #1 -The volume of cars that park on our street, in front of our houses is extremely high - and out of that volume of cars, only a couple of those cars belong to known residents of Farinella Dr. Literally every available spot on Farinella Drive will be taken up - we are talking 15-20+ cars on Farinella Dr. #2 - We have seen time and time again that trash and food are left littering our street and front yards. We have even seen a used feminine hygiene product left lying around in front of our house. #3 - We have seen people sleep in their cars overnight in front of our house/on Farinella Dr. To us, that feels like a safety concern. #4 - Cars parked on our street are left for DAYS at a time. #5 - Due to the high volume of cars parked on Farinella Dr, from non-residents, we have lack of available parking for immediate family members. #6 - Some cars that are parked on our street have broken windows, creating an easy target for theft, which can escalate to secured vehicles or houses. #7 - We feel the excess parking from non-residents decreases the value of our home. #8 -The volume of cars on the street creates an un-easy feeling for our high-school aged son who walks to/from school and also creates an un-easy feeling when we return home late at night. #9 -The cars that belong to non-residents, we feel, belong to the near-by apartment complex residents. The monthly rent that the apartment complex tenants pay helps to cover the maintenance of their own complex and their designated parking area - however, the residents utilize Farinella Dr as their own parking lot/area, yet we as Farinella Dr. homeowners are left responsible for extra maintenance due to these vehicles, and end up having to clean up/maintain what is left behind from these vehicles- as if we should take care of it like their association should if they were in their own designated area. It seems it should not be the burden of Farinella Drive to take in the excess vehicles from the tenants of the apartment complex and be responsible for their maintenance that should normally be covered be their apartment complex. It should not be the burden of Farinella Dr to have excess trash, wear & tear and unnecessary safety concerns due to the lack of parking available within these near-by apartment complexes - more burden than other HB streets. #10 - As our baby grows up and begins to play outside, we would like the added comfort of not having the ENTIRE street filled with parked cars and having trash on our front yard. #11 - We feel that approving Farinella Drive the residental parking permits would improve the quality/value of Farinella Drive and improve the quality of life of it's residents by decreasing fear/safety concerns, trash, loitering, prolonged parking, lack of available parking spaces, cars that are not secured (broken windows), etc. We take pride in living on Farinella Dr in HB, but we don't feel our little street should bear the burden on non- residents always parking on our street, leaving their trash, leaving the cars for days, creating safety concerns, etc. Thank you for your consideration! Their street is always lined with cars that I assume to be overflow from the nearby apartment complexes. There would be no room for a homeowner's guest to park. I think the parking permits are a good solution to the Farinella Dr street parking problem. I also think the apartment residents, who clearly have insufficient parking at their complex, would move to Brad Dr or Cooper Ln or across Edwards St if they haven't already. Can there also be ways to address the issue at the source of the problem (i.e. , parking at the nearby apartment complexes)? I spoke to a previous resident of the apartment complex on the NW corner of Warner and Edwards who said the property managers did not efficiently handle the parking spots available and some available permits and spots were unused. I saw an online Yelp review (which I cannot personally verify) in the last month that claimed the parking situation at the apartment complex on the NE corner of Warner and Edwards was atrocious and made worse by the apartment management's recent change to parking policy. Can the city meet with the nearby apartment complex managers and discuss the "nuisance" issue caused by the overflow parking and `reported' inefficient parking management? Can the apartment management be invited to the City Council meeting so they are fully aware of the problem? Another possible solution might be for the apartment complex managers to work with the owners of the parking lots on the corner (Big Lots parking lot, for example) and see if a portion of that lot could be leased for apartment complex dwellers? That particular lot (Big Lots) is never full and the property owners might welcome the additional income. Thanks for working with the residents on this issue. I am, however, concerned that the proposed permit parking limits are too constrained and the same vehicles will just be parked on Cooper Lane. This would worsen the situation, as only Farinella has an oversize residential plot with an unused curb side (on the north corner of Farinella and Edwards) . The apartment dwellers on Warner seem to have insufficient parking and are driven to park in remote locations and I don't think that walking one more short block would be a deterrent. Perhaps the city might explore options for alternative parking prior to just pushing the problem onto the Farinella residents' neighbors. Part of the value of a home is the proximity to apartment buildings; the proposed Farinella permit parking district might unfairly shift local property values. The parking lot for the strip mall on the northwest corner of Warner and Goldenwest seems underutilized and there is normally some room in the Murdy Park lot; perhaps the apartment dwellers might be offered some type of parking permit for those areas, providing, at least, temporary relief in conjunction with enactment of a broader Irby Park area resident parking permit district. The problems are basically twofold. First, the parking impacts the availability of parking for those residents. Second,the nature of the parking results in significant noise and litter in the neighborhood impacting the residents' quality of life. Generally speaking, the parking appears to be associated with the apartment buildings along Warner—either residents parking in the neighborhood or their guests. Our permit parking program acknowledges these "quality of life" impacts to neighborhoods as a reasonable basis for establishing a permit parking district, at the discretion of the City Council. I hope that helps to explain the circumstances. Would you like us to share your original e-mail with the City Council tonight?
