` -No" 7WA& -1V10) CITY OF HUNTINGTON BEACH REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 10/5/2015 SUBMITTED TO: Honorable Mayor and City Council Members SUBMITTED BY: Fred A Wilson, City Manager PREPARED BY; Lori Ann Farrell Harrison, Director of Finance Robert Handy, Chief of Police SUBJECT: Adopt Resolution No 2015-57 adopting an amended Uniform Bail Schedule for Parking Violations, Adopt Resolution No 2015-58 revising and restating the charges for Civil Fines for Municipal Code Violations, and, Approve for Introduction Ordinance No 4071 amending Chapter 10 of the Huntington Beach Municipal Code (HBMC) relating to Meter Zones Statement of Issue At the September 8, 2015, Public Hearing on the Fiscal Year 2015116 Proposed Budget, the City Council directed staff to finalize recommendations to increase General Fund revenue for the fiscal year starting October 1, 2015 Financial Impact It is estimated that the proposed amendments to parking meter charges, Municipal Code violations and certain parking fines will generate approximately $747,000 in General Fund revenue each year starting with the FY 2015/16 Adopted Budget Recommended Action A) Adopt Resolution No 2015-57, "A Resolution of the City Council of the City of Huntington Beach, California, Adopting an Amended Uniform Bail Schedule for Parking Violations," and, B) Adopt Resolution No 2015-58, "A Resolution of the City Council of the City of Huntington Beach Revising and Restating the Fee Schedule for Municipal Code Violations," and, C) Approve for introduction Ordinance No 4071, "An Ordinance of the City of Huntington Beach Amending Sections 10 60 010, 10 60 020 and 10 60 030 of the Huntington Beach Municipal Code Relating to Meter Zones" Alternative Action(s) Do not approve the recommended actions and direct staff accordingly Analysis At the Strategic Planning Retreat held July 13, 2015, the City Council created a working group with the objective of evaluating options on how to generate additional General Fund revenue Under the leadership of Mayor Pro Tem Katapodis, the City Manager, Police Chief, and Director of Finance were tasked to identify potential new General Fund revenue sources Based upon City Council direction, the working group met with M,HB -837-rem Katapodis and presented option,Item 19. - Staff conducted a review of surrounding beach cities, including Redondo Beach, Lohg Beach, Seal Beach, Newport Beach, Laguna Beach, and San Clemente and proposed a modest increase to the'K,6urly-parking,meter charge during the summer months for meters in�the dowAtOn"busin-iss zone, downtown residential zone, bluffito,04parringl lots, Pacifi6`Coast,Hjghway, Beach BbUldvard, and metered lotslat,Pier Plaza The,prop6sed increase of 25 cents per hour for the months of"M-ayCheo"ugh August W6u"Id-increasethe'llburly rate from J1,50 per,-h'ourto $l,,7,5,per-,, hour and generate approximately $380,000 per year The current parking meter rates are within the range of rates charged by other coastal communities, and the proposed summer charge of $1,75 per hour is in keeping with rates in neighboring Newport Beach and Laguna Beach which similar to Huntington Beach, generally have a higher concentration of visitors during the summer months and a greater draw on City staff and resources Parking Citation Violations -While the Uniform Bail Schedule consists of many types of violations and fines, Staff proposes changes in two areas that relate to the fines for expired meters (Huntington Beach Municipal Code) and parking in a handicap ramp (California Vehicle Code) The proposed changes would increase the expired meter fine from $48 00 to $58 00 per violation and from $55 00 to $356 00 for parking illegally in a handicap ramp These changes to the Uniform Bail Schedule will generate approximately $282,000 annually Please be advised that the State recommends a handicap ramp fine of at least$250 00 These increased fines are also generally in- line with neighboring cities Civil Fines forMunicipal Code Violations-The final proposed source of revenue relates to changes in the C.-ivil Fines for Municipal Code violations such as public intoxication and using glass containers on the beach The proposed general increase for Administrative Citations will generate approximately $85,000 in revenue per year Staff is requesting City Council approval for these amendments to existing parking meter charges, parking violations, and Municipal Code violations, to increase General Fund revenue effective in Fiscal Year 2015/16 Environmental Status Not applicable Strategic Plan Goal Strengthen Economic and Financial Sustainability Attachme9l Us 1 Resolution No 2015-57, "A Resolution of the City Council of the City of Huntington Beach, California Adopting an Amended Uniform Bail Schedule for Parking Violations" 2 Resolution No 2015-58 "A Resolution of the City Council of the City of Huntington Beach Revising and Restating the Charges for Civil Fines for Municipal Code Violations " 3 Ordinance No 4071, "An Ordinance of the City of Huntington Beach Amending Sections 10 60 010, 1060 020 and 10 60 030 of the Huntington Beach Municipal Code Relating to Meter Zones Item 19. -
