[ ] Yes [ ] New Policy or Exception 9 01/ Statement of Issue, Recommendation,Analysis, Funding Source, Alternative Actions, Attachments: STATEMENT OF ISSUE Police policy calls for voiding parking citations issued to vehicles at parking meters when it is discovered that a meter was inoperative. It is becoming common for meter users to jam the meters with foreign objects, mostly metal can pull tabs, knowing they can have the citation voided. Therefore, there is a need for an ordinance to prohibit parking at inoperative meters. RECOMMENDATION Adopt the attached ordinance amending the Huntington Beach Municipal Code by adding Section 10 .68.015 thereto prohibiting parking at inoperative meters. ANALYSIS Currently, there is no ordinance prohibiting vehicles from parking at inoper- able meters and, thereby, parking free of charge. The police department advises that citations issued to vehicles parked at expired meters are voided when the meter is determined to be inoperable. It has been determined that frequently the meter was vandalized to make it inoperable so that a vehicle could park free of charge. The attached ordinance will make it an infraction for any person parking a vehicle at an inoperable meter. A meter will not register time when it is inoperative, so the general public will be aware if a meter is inoperative when they attempt to insert a coin. Signage would be placed on the meters to inform the public of the ordinance. The Police and Community Services Departments concur with this proposed action. RECOMMENDATION Adopt the attached ordinance amending Chapter 10.68 of the Huntington Beach Muncipal Code by amending Section 10 .68 .100 establishing parking meter zones at the public launch ramp parking lots on Warner Avenue, and Section 10.68.130 establishing the hours of operation for said metered parking. zones. ANALYSIS At its October 2 , 1989 meeting, the City Council directed staff to install parking meters at the Earl Percy public launch ramp parking lot. On November 6, 1989, Council approved the expenditure of $12, 000 for purchase -and installation of thirty-two double-head meters. The amendment to Section 10.68 .100 establishes that parking lot as a parking meter zone in the city. Section 10 .68.130 has been amended to establish the hours of operation for that metered parking zone to be 5 : 00 a.m. to midnight daily. City Council indicated that the fee for the meters would be 750 for one hour. This will generate approximately $7, 500 per year in revenue. No person, except as otherwise provided in this chapter, shall cause, permit, allow or suffer any vehicle registered to or parked or operated by him to be or remain parked in any parking space in a parking meter zone, designated by resolution of the City Council as a recreational zone, during any time when the parking meter adjacent to such parking space indicates that no portion remains of the period of time for which a coin or coins have been deposited or beyond the time parking in such place is otherwise permitted or limited. (1500-5/69) 10.68.050 Coin deposit Exception. A vehicle may be parked and remain parked in a parking meter space without the deposit of any coin in the parking meter adjacent thereto during hours other than those designated by resolution of the City Council as hours during which such deposits are required. It is unlawful to deposit or cause to be deposited in any parking meter any slug, device or metallic substitute for a one cent or a five cent or a twenty-five cent coin of the United States. (496-7/46) 10.68.070 Tampering with meters. It is unlawful for any unauthorized person to open, or for any person to deface, injure, tamper with, or wilfully break, destroy or impair the usefulness of any parking meter installed pursuant to this chapter, or to hitch any animals thereto. (496-7/46) 10.68.080 Parking Hermits. Notwithstanding any other provision of this code, there is established a system of permit parking subject to the following standards and provisions: (a) A nontransferable parking permit shall be issued after payment of a fee, set by resolution of the City Council, to cover a calendar year. Such parking permit or decal, when affixed to the front windshield of a vehicle within a seven (7) inch square in the lower corner farthest removed from the driver's position, shall authorize the parking of said vehicle in posted or metered recreational parking areas in the city, as such recreational parking areas have been, or may be hereinafter, established by resolution of the City Council, without the deposit of coins in a parking meter adjacent to a metered parking space. Such parking permit shall not, however, establish any priority for a parking space. (b) Parking permits or decals shall be issued for one (1) vehicle only and shall not be transferable to any other person or vehicle except in those cases where the vehicle for which the permit has been issued has been disposed of and a substitute vehicle acquired. Such permit shall be transferable to such substitute vehicle upon presentation of the old permit together with a transfer fee of one dollar ($1). (c) The Director of Community Services shall establish the necessary procedure for the sale of annual parking permits. Such permits shall be appropriately designed and dated to indicate the appropriate year during which such permit is valid, and the area in which the owner of the permit is entitled to park. Parking meter zones are hereby established for public parking at the public launching ramps situated at Warner Avenue in the City of Huntington Beach.
