STATEMENT OF ISSUE:
There is not currently a clear definition of what constitutes a recreational vehicle for
guidance in enforcing oversize vehicle parking restrictions.
RECOMMENDATION:
Adopt Ordinance No. 3 /3 to , amending Section 10.44.065 (a) of the Huntington
Beach Municipal Code (HBMC) relating to oversize vehicle parking.
ANALYSIS:
The original intent of this code section was to permit persons leaving for or returning from
vacation or recreational activity to load or unload in front of their home, after which the
recreational vehicle(s) would be relocated out of the neighborhood. Currently, due to the
wording of HBMC Section 10.44.065 (a), no distinction between recreational and
commercial vehicles is made. As a result, parking enforcement personnel are unable to
prevent overnight parking of commercial vehicles in residential areas.
The proposed amendment will clarify the exception for recreational vehicles, and provide
a clear definition of such vehicles. The ability to enforce the code will be enhanced with
these additions, thereby fulfilling the original intent while removing those vehicles which
violate that intent.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH
MUNICIPAL CODE BY AMENDING SECTION 10.44.065 THEREOF
1 RELATING TO OVERSIZE VEHICLE PARKING REGULATIONS
WHEREAS, there' is a need to clarify the existing
regulations regarding the parking of oversized vehicles on the
public streets in the City of Huntington Beach,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby ordain as follows:
1. Huntington Beach Municipal Code Section 10 .44 . 065(a)
is hereby amended to read as follows :
(a) Any oversized recreational motor vehicle, as defined
by California Health and Safety Code Section 18010 or any
amendments thereto, while parked or standing for the purpose of
loading or unloading passengers or property for a period not to
exceed twenty-four (24) hours;

§ 18010. Recreational vehicle
"Recreational vehicle" means either of the following:
(a) A motor home, travel trailer, truck camper, or camping trailer, with or without motive power,
designed for human habitation for recreational, emergence or other occupancy, which meets all of
the following criteria:
(1) It contains less than 320 square feet of internal living room area, excluding built-in equipment,
including, but not limited to, wardrobe, closets, cabinets, kitchen units or fixtures, and bath or toilet
rooms.
(2) It contains 400 square feet or less of gross area measured at maximum horizontal projections.
(3) It is built on a single chassis.
(4) It is either self-propelled, truck-mounted, or permanently towable on the :highways without.a
permit.
(b) A park trailer designed for human habitation for recreational or seasonal use only-, which meets
all of the following criteria:
(1) It contains 400 square feet or less of gross floor area measured at the maximum horizontal
projections. However, it may not exceed 12 feet in width or 40 feet in length in the traveling mode.
(2) It is built on a single chassis.
(3) It may only be transported upon the public highways with a permit.
(Amended by Stats.1986, c. 1078, § 2, eff. Sept. 24, 1986, operative Jan. 1, 1987; Stats.1988, c. 1178,
§ 1; Stats.1990, c. 765 (A.B.4079), § 3.)

designed, used or maintained for the transportation of property;
(c) Any motor vehicle, including buses, motor trucks, trailers,
semitrailers, trailer coaches, or truck tractors as defined in the
Vehicle Code, over ninety-six (96) inches wide, measured at its--widest
point excluding side-view mirrors or similar extensions, designed, used
or maintained for the -transportation of property;
(d) Any motor vehicle which is designed, used or maintained as farm
machinery or a special purpose or equipment machine; or
(e) Any nonmotorized vehicle, such as a semitrailer, trailer, trailer
coach, utility trailer, two or more axle camper, or a one-axle camper,
which has been detached from its drawing vehicle .for a period not to

10.44.065 ._Exceptions. Section 10.44.060 shall not apply to the following:
(a) Any oversized motor vehicle parked or standing for the purpose of
it
or unloading passengers or property for a period not to exceed
twenty-four (24) hours;
(b) Any oversized motor vehicle parked while used in performing or
assisting in performing services or repairs on residential property;
(c) Any oversized motor vehicle which is parked for not more than
twenty-four (24) consecutive hours to make emergency repairs to such
vehicle; and
(d) Any nonmotorized vehicle, such as a semitrailer, trailer, trailer
coach, utility trailer, two or more axle camper, or a one-axle camper
which has been detached from its drawing vehicle parked for a period
not to exceed four (4) hours in any area other than a residential

Dear Mayor Mays:
We have reviewed Code Amendment No. 88-12 regarding changes to
the parking, landscaping, and loading provisions of the Hun-
tington Beach Ordinance Code. While, in general, we support the
proposed code amendment, we would like to suggest the following
changes.
We agree with the total number of parking spaces proposed for
single family dwellings. However, we believe, as is permitted in
existing development, available on street parking should be
counted towards meeting the requirements for new construction.
We also believe that two resident spaces and one-half guest space
per multi-family unit is sufficient. Additional parking is not
only unnecessary but significantly constrains project design and
feasibility.
We hope that you will include these changes when adopting Code
Amendment No. 88-12.

STATEMENT OF ISSUE•
Transmitted for your consideration are Resolution No. �Yylwhich
agrees and accepts the Coastal Commission' s action to approve Local
Coastal Program Amendment No. 2-91 with modifications and Ordinance
Nos . 3179 & 340 which incorporate the modifications into Article 960
and the Downtown Specific Plan. Local Coastal Program Amendment No .
2-91 represents Code Amendment No. 88-12, revisions to the parking
provisions of the Huntington Beach Ordinance Code and Downtown
Specific Plan.
RECOMMENDATION•

ANALYSIS:
On October 15, 1990, the City Council adopted Ordinance No. 3054
repealing Article 960 and adding new Article 960 and Ordinances
3055-3071 amending parking provisions contained in Articles 911 (Low
Density Residential) , 912 (Medium to High Density Residential) , 913
(Oldtown and Townlot Specific Plans) , 914 (Mobilehomes) , 915
(Planned Residential Developments) , 916 (Senior Residential Suffix) ,
Plo 5185
920 (Office Professional) , 922 (Commercial) , 924 (Visitor-Serving
Commercial) , 936 . 5 (Residential Condominium Conversion) , 937 (North
Huntington Center Specific Plan, 941 (Limited Use and Recreational
Open Space) , 951 (M1-A; Restricted Manufacturing) , 955 (M2 :
Industrial) , 960 (Off-Street Parking, Loading and Landscaping) , and
the Downtown Specific Plan.
At the City Council meeting of June 3, 1991, Resolution No. 6289
approving Local Coastal Program Amendment No. 2-91 was adopted. The
Local Coastal Program Amendment was subsequently submitted to the
California Coastal Commission for certification. At a public
hearing on July 7, 1992, the Coastal Commission certified LCPA 2-91
with modifications . (See attachment number 3) . There are four
modifications that the Coastal Commission approved which ensures
sufficient off-street parking is provided and to bring the amendment
into conformance with the public access provisions of the Certified
Land Use Plan. These modifications are summarized as follows:
1. Deletes the provision to allow on street parking credit for
new single unit dwellings with 5 or more bedrooms .
2 . Amends the provision to allow on street parking credit for
existing single unit dwellings so long as the on street
parking is not reserved in any way for residents and/or
guests but is available to the general public on a first
come, first serve basis .
3 . Amends the provision for single unit dwellings in the
Oldtown and Townlot Districts to prohibit reservation of on
street parking for adjacent residential use.
4 . Amends the Downtown Specific Plan to delete the
"grandfathering" provision which allows parking credit for
an existing structure and to require compliance with the
parking ratios or payment of in-lieu fees when fifty
percent or more of an existing building is demolished and
reconstructed.
If the Resolution and Ordinances are not approved, the City will
have zoning provisions in conflict with the Certified Land Use
Plan. All uses and development proposals within the Coastal Zone
that do not comply with the parking modifications will be subject to
Coastal Commission review and denial . In addition, inconsistent
zoning provisions increase the City' s exposure for legal challenge.
Environmental Status :
This project is statutorily exempt from further environmental review
pursuant Section 15265 of the California Environmental Quality Act
Guidelines.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH DOWNTOWN SPECIFIC
PLAN CONCERNING PARKING AND LANDSCAPING REQUIREMENTS.
WHEREAS, Ordinance No. 3071 amends Article 960 of the
Huntington Beach Ordinance Code concerning parking and
landscaping throughout the City; and
The Downtown Specific Plan contains parking and
landscaping standards which must conform to Article 960;
NOW, THEREFORE, the City Council of the City of
Huntington Beach does hereby ordain as follows:
SECTION 1. Article 4 .2.01(d) (2) of the Downtown
Specific Plan is hereby amended to read as follows:

(2) Any change of use, expansion of use, or
change in occupant to a use which would
require additional off street parking shall
provide the additional required off-street
parking according to the Huntington Beach
Ordinance Code.
If fifty percent (50%) or more of an

payment of in-lieu fees as allowed by the

WHEREAS, the Huntington Beach City Council has adopted
certain modifications approved by Local Coastal Plan Amendment
no . 2-91 as they relate to Residential Uses,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby ordain as follows:
SECTION 1. That Section 9602 .3(1) of the Huntington
Beach Ordinance Code is hereby amended to read as follows :

RESOLUTION NO. 6441
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH APPROVING LOCAL COASTAL PLAN
AMENDMENT (LCPA) 2-91 OF JULY 7, 1992
WHEREAS, the California Coastal Commission reviewed and
approved Huntington Beach Local Coastal Program Amendment No.
2-91 as modified at the July 7, 1992 Coastal Commission
hearing; and
Section 13544.5 of the Coastal Commission Regulations
require the local government to accept and agree to the
modification by resolution; and
Upon the City Council action staff will forward Resolution
No. for final Coastal Commission certification;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach does accept and agrees to the Coastal
Commission' s approval of Local Coastal Program Amendment No.
2-91 as modified.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting held on the 4th day of
January 1993.

Thank you for continuing,item G-l(a)and(b),Ordin, ce No. 3179, amending Article 960
and the Downtown Specific Plan related to parking provisions to give us the opportunity to
obtain additional information.
We did forward the proposed ordinance to one of our affiliated lenders for their comments,
and have discussed their concerns with Mr, Adams. You may recall that we were
concerned that changing the parking requirements for existing residences could affect the
property owners'ability to obtain market rate financing on the property should they have to
sell or refinance. Mr. Adams has reassured us that residential property owners in the
affected area are protected by a previous ordinance adopted by the Council which
guarantees their ability to rebuild up to 10 units under the current standards.
Thank you again for giving us the extra week to investigate this issue.
