SMALL, Chief of Police I SUBJECT: Approve Proposed Modifications to the Recreational Vehicle Permit Ordinance Statement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: There is a need to consider decreasing the maximum number of parking permits that residents can obtain each month for their Recreational Vehicles, and attached/unattached boat and personal watercraft trailers, as well as decreasing the maximum number of days the permits can be linked together consecutively. Additionally, there is a need to include in the Municipal Code a subsection requiring recreational vehicle permit holders to comply with the requirements of the street sweeping ordinance. Funding Source: Not applicable. Recommended Action: Motion to: 1. Approve the recommended modifications to the Recreational Vehicle Permit Ordinance. Alternative Action(s): 1. Deny the recommended modifications to the Recreational Vehicle Permit Ordinance and direct staff accordingly. Analysis: In April 2005, the City Council adopted Ordinance No. 3699, which amended Section 10.44 of the Huntington Beach Municipal Code regulating parking time limits of oversized vehicles, recreational vehicles and attached/unattached trailers on city residential streets. RCA RV 2006 version 1.doc -- / _ 4/5/2006 9:36 AM Q The main components of the ordinance provided a no cost permit process to residents allowing them to obtain either 24 hour, daily, medical and construction permits to park their recreational vehicles, and certain types of attached/unattached trailers, in front of or in close proximity to their residences. This ordinance provides residents the opportunity to obtain up to sixteen 24-hour parking permits each month. Up to eight 24-hour permits can be linked consecutively. Since its adoption, 1,290 residents registered with the Police Department to obtain permits. To date, 7,156 permit requests have been processed, resulting in 22,900 actual daily permits issued. From April 2005 through February 2006, the Police Department issued 927 parking citations for violations of Municipal Code Section 10.44 relating to recreational vehicle parking. Between these same time periods in 2004-2005, the Police Department issued 79 parking citations related to oversized vehicle parking and unattached trailers. The Police Department considers the new RV permit process, and its improved efficiency of our parking enforcement efforts, an overwhelming success. However, the Police Department still receives numerous complaints monthly from citizens about RV's parked in their neighborhoods. Their main complaint is that the ability to obtain up to 16 permits per month, and up to eight days linked together, have allowed many RV owners to abuse the system, thereby turning residential streets into alternative storage areas. This detracts from the neighborhoods. An analysis of the RV permit applications shows that the number of daily permits obtained by each applicant during this time period ranged from one day to 144 days. Thirty of the 1,290 applicants obtained more than seventy 24-hour permits. In reviewing each of the 30 high-end users, of the 1,290 applicants, several are consistently using most, if not all, of their allotted 16 permits each month. In order to mitigate at least some of the concerns of the complaining residents, while at the same time maintaining a generous permit process, the Police Department recommends reducing the maximum number of permits an applicant can obtain monthly to 12. The ordinance, in its existing form, is in conflict with the California Vehicle Code, specifically Section 22651 (k), which provides law enforcement the authority to impound vehicle parked on city streets in excess of 72 hours. The Police Department proposes that the ordinance be modified to limit the number of consecutive permits to three days in order to be consistent with the Vehicle Code. This modification would also lend itself to satisfying many of the complaints as previously mentioned. Our existing Municipal Code does not include language requiring permit holders to comply with the street sweeping ordinance. In order to add clarity to the Police Department's enforcement efforts with regards to street sweeping, the Police Department recommends that language be included in the ordinance requiring permit holders to comply with the street sweeping ordinance. (3699-04/05) 10.44.062 Recreational vehicle parking in a residential district-special permits. (a) The Chief of Police may issue a temporary permit for the overnight parking of a recreational vehicle prohibited by 10.44.060 if there is a finding that the vehicle is used on a daily basis and on-premise parking is not reasonably available. A permit issued based on this finding shall not be valid for longer than six months. (3699-04/05) (b) The Chief of Police may issue a temporary permit to persons who demonstrate by way of written statement from a licensed medical doctor, that the recreational vehicle prohibited by 10.44.060 must be kept near a residence for medical reasons. (3699-04/05) 10.44.065 Exceptions. Section 10.44.060 shall not apply to the following: (a) Recreational vehicles as defined in Section 10.44.060, or unattached boat or personal water craft trailer, parked for the purpose of loading, or other short term use, provided that a permit has been issued in advance by the Chief of Police. A permit may be issued for loading, unloading, or other short-term use not to exceed twenty-four hours, provided that: (3699-04/05) 1. no more than sixteen (16) such periods are allowed in a calendar month; and (3699-04/05) 2. no more than eight days consecutively. April 17, -q�CITY CLE FF L.FLYNN,CITY CLERK As a member of the RV Owners Group of Huntington Beach I participated last year in the proceedings that resulted in the existing RV parking ordinance that has been in effect for about a year now. The reason why we are here tonight addressing this issue again is the result of the requirement last year that Chief Small would report to the council within a year on how the new ordinance was working. In the process of preparing that review Chief Small, with his staff,has undertaken to recommend one or more changes to the existing ordinance. As a quick review, please remember that the basis of the existing ordinance was that RVs would be able to park on streets in residential areas after obtaining a phone-in permit, for up to 16 total days per month, and no more than 8 consecutive days. All of the rationale that was developed last year for these numbers still pertain today. Chief Small has shared with our group many of the statistics gathered over the first ten months that the ordinance has been in effect,that describe the performance of the ordinance in terms of duration of permitted parking around the city. We have shared the details of these statistics individually with the council members. In summary,there were approximately 1300 different RV residents that obtained a 7,177 permits for a total 22,966 days. This represents an overall average of 3.2 days per permit issued and an average of 1.8 days per month per RV resident. A further breakdown reveals that 97 '/z %of RVers used an average of 1'/z days per month of permitted parking. 2 '/2% used an average of 7 or more days per month, and of this group, 14 RVers averaged 11 to 15 days per month. Besides this overall moderate usage of on-street RV parking, Chief Small has told us that the transient parking that was a problem before, has been virtually eliminated by virtue of enforcement of the existing ordinance. By these statistics,we in the RV Owners Group consider the existing ordinance to be a complete success, and that it does not need any changes to further limit the parking constraints. At least partially, one might characterize that we are here tonight because of a "failure to communicate". For communication to occur there has to be a sender and a receiver of some information. And ideally there should be understanding and acceptance of that information. Part of the purpose for the city council's creation of last year's ordinance was to eliminate on-street, continual storage of RVs. The compromise that was reflected in the ordinance was to accomplish that, but still allow RVers, for the most part,to have unconstrained use of their RVs for recreational purposes by allowing them limited on-street parking for loading, unloading, cleaning, light maintenance, and for any resident to have an occasional RV visitor for up to a week. Even with the statistics quoted earlier, Chief Small and his staff perceive that there are still a small number of RV owners in the city who are attempting to essentially store their RVs on the street. And primarily for that reason the Chief is recommending some additional parking constraints in the ordinance. One of my purposes in speaking tonight is to clarify the communication for these few RV owners,that the city administration will not allow on-street storage of RVs in Huntington Beach. And there is a permit system for limited parking. I'm also here to clearly communicate to the city residents in general that the new ordinance is working well, whether modified tonight or not, and that virtually all of the previous RV parking problems have been resolved. Now the general public needs to uphold their part of the compromise and start living with the new ordinance and refrain from complaining about it and the parking allowances it has made for RV owner-residents. The RVOG does not see a compelling need for changes to the RV parking ordinance that would invoke more limited restrictions. • The RV owners of Huntington Beach made significant compromises last year when the existing ordinance was negotiated. (Even then, many of our members warned that there would be a push for tighter restrictions at every opportunity.) • All the arguments for the parking needs of RV owners last year when the existing ordinance was being structured still pertain: (storage lots not open weekends/24 hours, the distance of some storage lots, families that want to get away nearly every weekend in the summer, and the fact that the current monthly allotments cover all recreational vehicles in one household, i.e. motorhomes, campers, boats, trailers, and their out-of-town visitors as well, etc.) . • The average duration of a permit is 3.2 days, which means quite a few more and quite a few less. A 3- day restriction would affect a significantly large number of RV owners. • If you feel strongly that restrictive changes to the existing RV Ordinance should be imposed, then we believe there is a better approach to smoothing out the perceived "rough edges of the current ordinance." This would be imposing a maximum number of parking days within a 12=month period. You said that if we were willing to forgo the general right of all citizens to park a noncommercial vehicle on a city street by obtaining a permit from the City, that we could legally park for the agreed upon eight consecutive days or a total of sixteen days per month. Now you are proposing to renege on that agreement. The intent of the ordinance passed last year was to assist the police in enforcing the law against abandoned vehicles, owners storing their recreational vehicles on the street and transients who lived full or part time in the vehicles. The 72 hour limit in state law applies to "abandoned vehicles." RV's who have obtained permits are not abandoned. In practice, "abandoned" is defined by the vehicle not having been moved during the 72 hours. Many residents park their cars on the street in basically the same spot every day of the month. If someone complains, all they have to do is show that the vehicle is being used and moved. Enforcement under the old rules was virtually impossible because parking enforcement was required to mark tires, then recheck to verify that the time limit of 24 or 72 hours had been exceeded. Since it was relatively easy for offenders to merely move the vehicle short distances, the police and complainants were frustrated with the lack of a remedy. Now you are proposing to limit parking to the 72 hour limit but still require recreational vehicle owners to obtain a city permit. This is outrageous. If the city is not willing to keep its side of the bargain, then no permit should ever be required and the law should simply be �lo-106 /a& 4/13/2006 Page 2 of 2 rescinded and the state law applied. We believe that the law as written should be maintained. Your own statistics show that the overwhelming majority of RV owners are not abusing the permit. If a compromise is absolutely necessary because of an errant few violators or a few vocal chronic complainers, the twelve day limit a month might be tolerable. However, the three consecutive day limitation is totally unacceptable. If the limit is going to be three days, then no permit should be required nor should there be any limit on the days per month. As discussed last year, sometimes a motorhome owner needs to keep a vehicle nearby their home for several days to load or unload and to perform maintenance tasks. Personally, we could live with a reduction to six consecutive days. We have no problem with the permit excluding street sweeping days. As retirees who worked for many decades in public service so that we could retire and enjoy living in Huntington Beach and traveling in our motor coach, we hope you will not make us regret our choice to retire here. I dont think any ordinance will be 100% perfect but i do think there has been enough success to make it unnecessary to have additional changes that make it more restrictive on RVER's that have helped and complied with previous changes.. THE Majority of RV users have complied with the Chief Small and the Councils suggestions and i do not believe further changes are needed because of the complaints of a very small group, who if they didn't have RV's to complain about, would surely find another banner to complain about. Let our enforcement personnel deal with them and not let these bad apples spoil the whole barrel. I noted that the width of 96 inches versus 102 inches is the crux of some of the ordinance.. I recently traded my 14 year old motorhome for a 2006 with the modern amenities newer motorhomes contain. Because I am used to parking a 96 inch vehicle next to a curb I found that, using the same technique I usually use that I would occasionally rub the curb with the front and rear right tires. Parked in this manner the width extension of 6 inches did not cause the 102 inch vehicle to extend into the street any further than my ald 96 inch vehicle which could be parked, legally, 18 inches from the curb. 96 inches plus 18 inches equals 114 inches, 102 inches 2 inches from the curb equals 104 inches. Are we not using the 102 inches perhaps as a ploy to target motorhomes, licensed by the DW as "passenger vehicles" (CVC 465)? Recently my next door neighbor was visited by his parents who are full time housecar residents. Their stay was 3 days and did not impose on the parking space of anybody. The same occurred directly, across the street from my home. Their stay was 5 weekdays and my neighbor brought them over for a visit and expressed the pleasure it was for them to be able to park in front of her home instead of an RV park some distance away. They too did not impose any problems on adjoining neighbors. In the strict sense I do not think the current ordinance is broken. Why fix it? The current Ordinance seems to be working fine with few problems. The intent of the law which is to address the issue of storing RVs on our streets has been accomplished. The proposed changes to the Ordinance will only impact RV owners use and enjoyment of their RV. The reduction to twelve days per month and a maximum 72 consecutive hours will negatively impact RV owners, particularly motorhome and fifth wheel owners. Sometimes it takes more than 72 hours to pack and prepare for a trip, or to clean and ready the RV for its return to the storage facility. This is especially true when other factors such as work and family obligations share the 72 hour period. The Chief of Police has indicated there have been complaints about RV parking since the Ordinance was -enacted, but I would guess that his Department receives more complaints about barking dogs than RVs. I do believe that RV parking should be secondary to street sweeping which is intended to aid in the reduction of beach and ocean polution. The permit time frames of the existing RV Parking Ordinance should remain unchanged. Raymond E. I'm speaking on behalf of the RV owners in Huntington Beach. Each of the last two years, through the proceedings in this chamber, the RV owners of Huntington Beach have lost about half the maximum legal RV parking days per year of the previous year. This is what mathematicians and engineers call a"geometric progression". A geometric progression is not good in almost any social action context. Think about having your taxes doubled every year. ( I forget I'm addressing the City Council; please don't think about that!) Even I have used the word"compromise"when speaking about this issue. This is no compromise. Councilmembers Cathy Green and Don Hansen have recognized the one-sided compromise that RVers have given in to. I don't know a word for what a one-sided compromise is called. I'll call it a"beating." Councilwoman Cathy Green is quoted as saying, "We keep rewriting the ordinance and dinging the RV owners. It seems like it's very strict for the RV owner and it seems like there's no flexibility on that (other) side." This one-sided compromise has not gone unnoticed by the RV owners either. Some of our RVers are thankful that the current proposal was not worse as Chief Small first proposed. Actually in one respect it is worse. If the chief s first proposal, 12 days per month, had passed we would have had 144 days per year maximum; now we have 100 days per year maximum. If the Council still wants to retain a"cap" of days per year, I suggest a cap of 144 days which would be consistent with the Chief s original proposal, but still retain the 16 and 8 per month that's in the current proposal. I suggest also that the council needs to think about how this RV parking ordinance can be implemented with the residents opposed to RV parking sensing a responsibility of compromise on their part, and therefore supporting the ordinance instead of continuing to complain.about it.
