Statement of Issue: Should the City Council of the City of Huntington Beach increase the
fine for parking violations in the amount of $3.00 to cover the increase in surcharges required
by the State of California (SB 1407)?

Recommended Action: Motion to: Approve a Resolution of the City Council of the City of
Huntington Beach, California, adopting an amended uniform bail schedule for parking
violations.

REQUEST FOR CITY COUNCIL ACTION

Analysis: The Trial Court Facilities Act of 2002 established the State Court Facilities
Construction Fund and provides that monies in that fund may be used to acquire, rehabilitate,
construct or finance court facilities, as defined, and to implement trial court projects in
designated counties, as specified. SB 1407 extends the purposes for which monies in that
fund may be used to include the planning, design, construction, rehabilitation, replacement,
leasing, or acquisition of court facilities.
Prior to January 1, 2009, for every parking offense where a parking penalty, fine or forfeiture
is imposed, an added State Court Construction penalty of one dollar fifty cents ($1.50) was
included in the total penalty. Effective January 1, 2009, SB 1407 increased the Courthouse
Construction surcharge by three dollars ($3.00) to a total fee of four dollars and fifty cents
($4.50). This surcharge increase applies only to citations issued on or after January 1, 2009.
Monies collected shall be taken from fines and forfeitures deposited with the County
Treasure prior to any division of funds to the City of Huntington Beach pursuant to Section
1462.3 or 1463.009 of the California Penal Code.
An increase of our city's current parking fines by three dollars ($3.00) will off-set the
projected reduction of revenue created by SB 1407. We are requesting this increase to off-
set the increased surcharge already in effect.
Using December 2008 as an example, the total penalty assessment was $28,585.00 paid to
the County Treasurer. The surcharge increase of $3.00 per citation would have increased
our monthly assessment to $44,209.00, an increase of$15,624.00.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH, CALIFORNIA, ADOPTING
AN AMENDED UNIFORM BAIL SCHEDULE FOR PARKING VIOLATIONS
WHEREAS, Vehicle Code section 40203.5 requires local governing bodies to establish a
schedule of parking penalties for parking violations.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of
Huntington Beach, California, pursuant to the aforesaid authority, does hereby rescind
Resolution 6632 and adopts the Uniform Bail Schedule for parking violations, attached hereto as
Exhibit"A."
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 2nd day of February , 2009.
