Statement of Issue: Approval of a Resolution of the City Council of the City of Huntington
Beach allowing military veterans whose vehicles display license plates honoring Pearl Harbor
Survivors, Legion of Valor recipients, former American Prisoners of War, Congressional
Medal of Honor recipients or Purple Heart recipients to park their vehicles that weigh not
more than 6,000 pounds gross weight, without charge, in any metered parking space. The
Resolution is required by Section 22511.3 of the California Vehicle Code.
Funding Source: No impact.

Recommended Action: Motion to: Approve a Resolution of the City Council of the City of
Huntington Beach, California, allowing military veterans to park in any metered parking stall
without charge when the required license plate is displayed.
Alternative Action(s): Do not approve the Resolution and direct staff accordingly.

Analysis: Councilman Dwyer was contacted by a Huntington Beach resident regarding new
legislation allowing military veterans to park in metered parking spaces with no fee when a
distinguishing military license plate is displayed.
At Councilman Dwyer's request, the police department investigated and found Section
22511.3 of the California Vehicle Code allows military veterans whose vehicles display
license plates honoring Pearl Harbor Survivors, Legion of Valor recipients, former American
Prisoners of War, Congressional Medal of Honor recipients or Purple Heart recipients to park
their vehicles in a metered parking space without charge contingent upon the approval of the
local authority's governing board.
This law does not require the state or a local authority to designate specific parking spaces
for vehicles displaying any of the military veteran license plates.

equipped overall.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ALLOWING MILITARY VETERANS
WHO DISPLAY A DISTINGUISHING LICENSE PLATE TO PARK
IN A METERED SPACE WITHOUT CHARGE
WHEREAS, California Vehicle Code Section 22511.3(a) provides that a veteran
displaying special license plates issued under designated Vehicle Code sections may park his or
her motor vehicle, weighing not more than 6,000 pounds gross weight, without charge, in a
metered parking space; and
California Vehicle Code Section 22511.3(d) further provides that a local authority's
compliance with such is solely contingent upon the approval of its governing body.
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
SECTION l: The City Council of the City of Huntington Beach hereby approves
allowing a military veteran displaying special license plates issued under Vehicle Code Sections
5101.3, 5101.4, 5101.5, 5101.6 or 5101.8 on a motor vehicle, weighing not more than 6,000
pounds gross weight, to park in any metered parking space, in the beach parking lots, and City-
operated parking structures, without charge, when the license plate is displayed.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 18th day of May , 2009.

Honorable Mayor and Council Members
I strongly recommend that you give Veterans the proposed free parking perk. It
is the least we can do and is a wonderful to say the least idea. This transcends
just being the first city to do it but shows real character and a moral high ground
for HB...I am sure Dave Sullivan will be in support of this!
