Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution No. 2012-38 to establish Sunset Beach as Permit Parking District "N" within the City of Huntington Beach Statement of Issue: The residents of Sunset Beach have a permit parking district that was established under the County of Orange regulations. This resolution establishes Sunset Beach as permit parking district "N" within the City of Huntington Beach in substantially the same form as when the parking district was established under County of Orange regulations. Financial Impact: The provisions of Huntington Beach Municipal Code Chapter 10.42 require that the residents choosing to participate in the residential permit parking district pay a proportionate share of the cost to establish and administer the district. Typical costs include, but are not limited to, installation of signs, staff time to issue permits, and administrative costs to create the district. This program will only require permit purchase by residents and is revenue neutral. Recommended Action: Motion to: Adopt Resolution No. 2012-38, "A Resolution of the City Council of the City of Huntington Beach establishing Permit Parking District "N" for Sunset Beach within the City of Huntington Beach." Alternative Action(s): Deny the recommended action Item 10. - 1 HB -138- REQUEST FOR COUNCIL ACTION MEETING DATE: 7/2/2012 DEPARTMENT ID NUMBER: PW 12-039 Analysis: The County of Orange. established a permit parking district for Sunset Beach residents by resolution on June 24, 1980. The resolution allowed residents to park in front of their private driveways by permit on North Pacific Avenue and South Pacific Avenue between Warner Street and Anderson Street and; on Second Street through Twelfth Street, Broadway, and Fourteenth Street through Twenty -Sixth Street, all between the beach and South Pacific Avenue. Chapter 10.42 of the Huntington Beach Municipal Code authorizes City Council to establish residential parking districts in Huntington Beach. On November 15, 2010, City Council approved the Memorandum of Understanding (MOU) between Sunset Beach Community Association (SBCA) and the City. The MOU included adopting and enforcing a parking and parking permit policy for Sunset Beach in substantially the same form and content as the existing County regulations. The resolution establishes Sunset Beach as permit parking district "N" in the City allowing parking in established areas in front of residential driveways and frontages on specific streets. The permit parking will be allowed only behind the marked vehicle travel edge line on the streets. A five-year duration of permit use will be established for the district. Environmental Status: Not applicable Strategic Plan Goal: Maintain public safety Attachment(s): 1 Adopt Resolution No. 2012-38, "A Resolution of the City Council of the City of Huntington Beach establishing Permit Parking District "N" for Sunset Beach within the Citv of Huntinaton Beach." xB -139- Item 10. - 2 ATTACHMENT #1 RESOLUTION NO. 2012-38 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING PERMIT PARKING DISTRICT "N" FOR SUNSET BEACH WITHIN THE CITY OF HUNTINGTON BEACH WHEREAS, the City Council has adopted Ordinance No. 3936 allowing the establishment of parking districts in residential areas under certain conditions; and Local residents have requested authorization to park in front of their driveways and property frontage; and Such parking will not create a traffic hazard or impair emergency services access; and The Director of Public Works has caused an investigation of parking conditions on and around the roadways mentioned herein, and found the requirements of Ordinance No. 3936 to be substantially fulfilled; and The citizens of the area known as Sunset Beach currently have a permit parking district established under County of Orange regulations; and NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. A Permit Parking District for Sunset Beach is hereby established on the following roadways, effective every day, including weekends and holidays; and 2. Authorizes owners or lessees having written authorization of the owners of private property fronting on the following roadways in Sunset Beach to park on the street immediately in front of their private driveway and property frontage with the terms of the Vehicle Code and this Resolution: a. North Pacific Avenue, behind the marked vehicle travel edge line along the street between Second Street and Anderson Street. b. South Pacific Avenue between Warner Avenue and Anderson Street, behind the marked vehicle travel edge line along the street. C. Third Street, Sixth Street, Eighth Street, Ninth Street, Twelfth Street, Broadway, Fourteenth Street, Fifteenth Street, Sixteenth Street, Seventeenth Street, Eighteenth Street, Nineteenth Street, Twentieth Street, Twenty-third Street, Twenty-fourth Street, Twenty- fifth Street, Twenty-sixth Street, all between the beach and South Pacific Avenue in front of their private driveway not blocking any coastal access walking path. 12-3377/80867.doc Resolution No. 2012-38 3. The permit shall be prominently displayed in the front windshield of any vehicle parked in front of the private driveways or property frontage; and 4. A five-year duration of permit use for this district is hereby established. BE IT FURTHER RESOLVED that not more than one authorized vehicle may be parked alongside the road in front of the private driveway, as defined in Section 22500(e) of the Vehicle Code, unless the width of the driveway will accommodate more than one car entirely within its width.
