Staff Recommendation: Staff recommends that the City Council approve by resolution the Linear Park Conceptual Boundary and Preliminary Development Plan as revised by the Planning Commission. I PI O 5/85 ANALYSIS' The Linear Park has been the subject of planning efforts since the mid 19701s . Various County and City plans prepared during that time have depicted a wide range of park uses and park sizes . In an effort to finally resolve the Linear Park issue, Supervisor Harriett Weider formed a Linear Park Advisory Committee in 1988 . The committee was composed of Supervisor Weider, Huntington Beach City Council members, County and City staff, and the principle landowners in the .p.ark areas . As a direct result of the Committee' s efforts, a conceptual plan was submitted to the City Council on April 17, 1989 . At that time, the Council indicated tentative agreement with the concept and directed that public hearings for the plan be scheduled for the Planning Commission and the City Council . On June 6, 1989, the Linear Park Conceptual Boundary and Preliminary Development Plan was presented to the Planning Commission for public hearing. After receiving public testimony, the Planning Commission approved the plan with two minor revisions to the component list. The first revision was to delete locational criteria for the equestrian trail and instead merely require that it be located somewhere above the 5-foot contour line, rather than entirely restricted to the bottom of the bluff . The second revision was to require that the Linear Park be designed to be as self-sufficient in the provision of off-street parking as possible. The County staff has accepted the Planning Commission' s parking revision, but does not agree with the equestrian trail revision. The County indicates that they still intend to pursue the equestrian trail at the bottom of the bluff . City staff does concur with both of the Planning Commission' s revisions . It is highly questionable as to whether or not the Department of Fish and Game will permit equestrian uses in the lowlands . As such, staff feels that the Preliminary Development Plan should not restrict equestrian uses to the bottom of the bluff. City and County staff are now asking the City Council to approve the Linear Park Conceptual Boundary and Preliminary Development Plan by adopting a resolution. This resolution will supercede any previous resolutions of the City Council pertaining to Linear Park acreages and uses . The County staff has begun the more detailed process of site planning (General Development Plan) and preparation of an Environmental Impact Report for the park. That process includes a Citizen' s Advisory Committee which is currently meeting once a month with anticipated completion date of April 1990 . RCA - 12/5/89 -2- (3031d) In summary, the Linear Park Conceptual Plan which has been submitted to the Council for approval will comprise a total of 113 acres, of which approximately 88 acres will be usable for human activities . These activities may include an interpretive center, bike/pedestrian trails, equestrian trails, vista points, open play areas and picnic areas . The park will have a minimum usable width of 150 feet . A local bluff top road west of Edwards Street will provide vehicular access to the park. For a more detailed description of park uses and concepts, please refer to the exhibits to the attached resolution. FUNDING SOURCE: No funds required. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING A CONCEPTUAL BOUNDARY AND PRELIMINARY DEVELOPMENT PLAN FOR THE BOLSA CHICA LINEAR PARK WHEREAS, The Orange County Board of Supervisors executed agreement 79-102 dated November 27, 1979, between the County of Orange, the Orange County Harbors, Beaches and Parks District and the City of Huntington Beach, providing for cooperative planning and implementation of the Bolsa Chica Linear Park; and The Orange County Board of Supervisors adopted the Bolsa Chica Linear Park Boundary Study dated April 1985, as the guidance document for acquisition and development of the proposed park; and The City of Huntington Beach established Bolsa Chica Linear Park planning goals in 1977 as set forth on the attached sheet (Exhibit C) ; and An Advisory Committee was established in 1988 and included representation from County Supervisor Harriet Weider, Huntington Beach City Council, the principal landowners, County staff members and City staff members . ESHAs - Environmentally Sensitive Habitat Areas - ESHAs shall be located primarily along bluff-faces in areas unsuitable for conventional park uses. - ESHAs could potentially include eucalyptus/torrey pine groves, coastal sage scrub, and grasslands. - ESHAs will be located in a manner protecting important view areas, and vista points. - ESHAs shall be compatible with adjacent park uses and require no fencing or special buffers. -2- 11. Landscape Theme Predominantly open view and use areas framed by clusters of tall skyline pines and palm trees, enhanced by smaller trees and shrubs tolerant of first exposure seacoast and drought conditions. 12. Signage - Entry signs - Directional signs - Special interest signs 13. Interim Security Fencing - As required at key oil field elements. 14. Archaeology - The blufftop areas contain numerous archaeological sites identified by the county and private consultants. In 1986, a proposal from a private consultant for investigation, excavation, and testing amounted to $200,000. These sites are scattered across the blufftops. Proposed grading in the park North of proposed Garfield Avenue in conjunction with the future residential development by the Huntington Beach Company should include provisions for archaeological investigation of all grading at landowner's expense. - The optional 5-acre fill area in the Southern half of the park (currently a ravine and gently eroded area) should mitigate any archaeological sites through capping. - Options for mitigation of the remaining archaeological sites include: A. Further investigation of sites to define boundaries and identify the most significant sites. B. The phase one park area (approx. 31 gross/27 net acres) should be investigated separately. A private consultant could be used to expedite this area along Seapointe Avenue. C. Capping the archaeological sites with a layer of soil has been an acceptable mitigation practice. An important disadvantage to this approach in the phase one blufftop area is the elimination of any existing view from Seapointe Avenue and adjacent residential units of the ocean and wet lands. This area would benefit from removing one to three feet of soil to facilitate views from vehicles along Seapointe Avenue which are currently restricted. - The material for a soil cap would have to be imported from areas without archaeological resources, and consist of good quality top soil to ensure landscape suitability. - The Huntington Beach Company has offered additional fill for park use. They do not want to see the grade raised along Seapointe Avenue, and have indicated a preference to see it lowered to facilitate views. -3- • A 3-foot soil cap will require 4,840 cubic yards (c.y.) per acre at approximately $5/c.y. _ $24,200 cost of grading per acre. A soil cap should be used only if it can be cost effective and does not compromise any of the view opportunities on the site. 15. Grading - The southern portion of the park is proposed to receive approximately 50,000 c.y. import soil in the ravine/slope Phase One area. This fill and dedication of land has been offered by the Huntington Beach Company at no cost in conjunction with future residential development entitlements currently pending with the City of Huntington Beach. Additional drainage facilities and provisions for placement and compaction of fill will need to be designed and implemented. The result of this fill will be an increase of five net usable acres and a contiguous park area. - Minimal grading is expected in the remaining blufftop areas to enhance views and accommodate facilities and trails in the southern portion of the park. - The Huntington Beach Company has offered to coordinate and negotiate some temporary grading along their lessee's gas plant at Seapointe Avenue to access Phase One development from existing Garfield Avenue. This level area adjacent the street is essential for trail users to view incoming and outgoing traffic from the gas plant. The Huntington Beach Company has indicated this 2.8 acre gas plant will be offered for dedication by May 1994 or before and is tied to pending future residential entitlements in the City of Huntington Beach. - Phase One grading in the southern portion of the park is expected within the next three years. This will require the necessary dedications of land by Signal Landmark and Huntington Beach Company. Cleanup of the oil operations will need to be initiated in this area. - Grading in the northern portion of the park, above proposed Garfield Avenue, is proposed in conjunction with future residential grading by the Huntington Beach Company. The Huntington Beach Company has offered to clean up oil facilities, abandon wells, cut and fill grading of approximately 65,000+ c.y. import or more as necessary, and dedication of land with future residential entitlements pending with the City of Huntington Beach. This grading should be conditioned to include: oil cleanup and remedial grading, archaeological investigation and mitigation, geologic conditions/mitigation, placement and compaction of fill material to City of Huntington Beach standards. The Huntington Beach Company has offered additional fill up to 150,000 to 200,000 c.y. total, or more if it can used. The plan had been prepared through a cooperative effort between Supervisor Harriett Weider, Councilmembers Erskine, Green and Silva, the Huntington Beach Company, County staff and City staff . The City Council ' s action was to approve the plan by minute action and forward it to the Planning Commission for more formal review and action. 2 . 0 ' SUGGESTED ACTION: Staff recommends that the Planning Commission review the proposed Linear Park Conceptual Boundary and Preliminary Development Program and approve the plan by approving Resolution No. 1415. 3 . 0 ANALYSIS• The Linear Park Plan which the County and coalition members have prepared is outlined in the following Exhibits included in the Resolution and attached to this staff report: A) Summary of Parcels within Proposed Boundary, B) Preliminary Develo ent Program and Maps. If the Planning Commission and City Council concur with the concepts presented in this staff report, then the County will begin preparation of a detailed park plan and will initiate a formal review process. The formal review process for the Linear Park will require environmental analysis with the possible preparation of an environmental impact report. Project entitlement will be a Conditional Use Permit. At the time of submittal of the Conditional Use Permit the County will need to provide detailed site plans identifying precise grading amounts and locations, trail placement and design, picnic and vista point location and design, parking and street designs, landscape and ESHA designs, .oil facility treatment, acquisition and construction phasing, and funding and operational responsibilities . Linear Park Boundary Study dated April 1985, as the guidance document for acquisition and development of the proposed park; and The City of Huntington Beach established Bolsa Chica Linear Park planning goals in 1977 as set forth on the attached sheet (Exhibit C) ; and An Advisory Committee was established in 1988 and included ' representation from County Supervisor Harriett Weider, Huntington Beach City Council, the principle landowners, County staff members and City staff members . Archaeology - The blufftop areas contain numerous archaeological sites identified by the county and private consultants. In 1986, a proposal from a private consultant for investigation, excavation, and testing amounted to $200,000. These sites are scattered across the blufftops. Proposed grading in the park North of proposed Garfield Avenue in conjunction with the future residential development by the Huntington Beach Company should include provisions for archaeological investigation of all grading at landowner's expense. The optional 5-acre fill area in the Southern half of the park (currently a ravine and gently eroded area) 'should mitigate any archaeological sites through capping. Options for mitigation of the remaining archaeological sites include: A. Further investigation of sites to define boundaries and identify the most significant sites. B. The phase one park area (approx. 31 gross/27 net acres) should be investigated separately. A private consultant could be-used to expedite this area along Seapointe Avenue. C. Capping the archaeological sites with a layer of soil has been an acceptable mitigation practice. An important disadvantage to this approach in the phase one blufftop area is the elimination of any existing view from Seapointe Avenue and adjacent residential units of the ocean and vet lands. This area would benefit from removing one to three feet of soil to facilitate views from vehicles along Seapointe Avenue which are currently restricted. - The material for a soil cap would have to be imported from areas without archaeological resources, and consist of good quality top soil to ensure landscape suitability. - The Huntington Beach Company has offered additional fill for park use. .. They do not want to see the grade raised along Seapointe Avenue, and have indicated a preference to see it lowered to facilitate views. -3- 4b - A 3-foot soil cap will require 4,840 cubic yards (c.y.) per acre at approximately $5/c.y. _ $24,200 cost of grading per acre. - A soil cap should be used only if it can be cost effective and does not compromise any of the view opportunities on the site. 15. Grading The southern portion of the park is proposed to receive approximately 50,000 c.y. import soil in the ravine/slope Phase One area. This fill and dedication of land has been offered by the Huntington Beach Company at no cost in conjunction with future residential development entitlements currently pending with the City of Huntington Beach. Additional drainage facilities and provisions for placement and compaction of fill will need to be designed and implemented. The result of this fill will be an increase of five net usable acres and a contiguous park area. !Minimal grading is expected in the remaining blufftop areas to enhance views and accommodate facilities and, trails in .the southern portion of the park. - The Huntington Beach Company has offered to coordinate and negotiate some temporary grading along their lessee's gas plant at Seapointe Avenue to access Phase One development from existing Garfield Avenue. This level area adjacent the street is essential for trail users to (M1 view incoming and outgoing traffic from the gas plant. The Huntington Beach Company has indicated this 2.8 acre gas plant will be offered for dedication by May 1994 or before and is tied to pending future residential entitlements in the City of Huntington Beach. - Phase One grading in the southern portion of the park is expected within the next three years. This will require the necessary dedications of land by Signal Landmark and Huntington Beach Company. Cleanup of the oil operations will need to be initiated in this area. - Grading in the northern portion of the park, above proposed Garfield Avenue, is proposed in conjunction with future residential grading by the Huntington Beach Company. The Huntington Beach Company has offered to cleanup oil facilities, abandon yells, cut and fill grading of approximately 65,000+ c.y. import or more as necessary, and dedication of land with future residential entitlements pending with the City of Huntington Beach. This grading should be conditioned to include: oil cleanup and remedial grading, archaeological investigation and mitigation, geologic conditions/mitigation, placement and compaction of fill material to City of Huntington Beach standards. The Huntington Beach Company has offered additional fill up to 150,000 to 200,000 c.y. total, or more if it can used. The purpose of this ( letter is to provide you with information and recommendations on the proposed park. Background .The Linear Regional Park had its origins in 1976. At that time, the Board of Supervisors was seeking to identify an appropriate site for a regional park in the west Orange County area, recognizing the shortage of regional recreation facilities there. The City of Huntington Beach proposed a linear park connecting Huntington Central Park along the bluff of Huntington Mesa to Pacific Coast Highway, with a trail connection to the beach and its regional bicycle trail. After considering several alternatives, the Board of Supervisors approved the city proposal and incorporated it into the County's master plan of regional parks. About the same time, the County began studies leading to the development of a plan for the entire Bolsa Chica area, and over the years the planning for the park and the Bolsa Chica. area as a whole were merged. In recognition of the fact that much of the linear park lies within the jurisdiction of Huntington Beach, and that its feasibility depends heavily upon city cooperation and assistance in securing the land and creating compatible relationships between the park and surrounding future development, an agreement was entered into between the City Council and the Board of Supervisors. A copy of that agreement is attached hereto as Exhibit 1. You will note the agreement provides for city cooperation in Securing land through dedication of local park lands and contributing such lands to the regional park. Hr. Ken Bourguignon Page 2 The securing of land through entitlement rights granted to adjacent property owners is still essential to the realization of the park. There is no way the County could afford now to acquire the park land at fair market value. The money available to the County for the park will be used to prepare the site and finance its development. Although much of the benefit to be derived from the park will be realized by residents of the nearby city area, the County can justify expenditure of regional park funds for operation and maintenance based upon the extraordinary character and function the park will provide to the regional visitor. We believe that the city will be very proud of the park we intend to develop. Although the design of the park will be determined ultimately through the process of preparing a General Development Plan (GDP) and Environmental Impact Report (EIR), it is necessary to give a sufficient description to the park to enable the Planning Commission to endorse the boundaries that are now proposed and to establish a project description for purposes of detailed environmental analysis. Thus, we are suggesting the following general description of the park for your approval: General Character 1. There will be a continuous bicycle trail connecting the existing trails at Huntington Beach Central Park to the trail paralleling Pacific Coast Highway within Bolsa Chica State Beach. At-grade crossings are envisioned at Edwards Street and Pacific Coast Highway, and probably (although this will be further studied during the GDP and EIR preparation) at the Garfield-Bolsa Chica road connection. 2. There will be an equestrian trail, with an at-grade crossing connecting to existing city trails southerly of Edwards Street, extending along the base of the bluff as far west as Garfield. The trail would not intrude into the area designated by the Department of Fish and. Game as wetlands (that is, it would be at least 5 feet above mean sea level). 3. The park would emphasize passive recreation, picnicking, trail use and scenic viewing across the lowlands and beyond to the coastline. 4. An interpretive center and observation structures would be incorporated into the park design. A fuller description of planned park features is attached as Exhibit 2. Exhibit 3 is a map showing the proposed boundaries, and Exhibits 4 and 5 are cross-sections illustrating the general character envisioned for the park. Planning for the park had not been completed partially due to differences between what the County, City and landowners felt the ultimate boundaries and size of the park should be . The coalition ' s efforts were assisted by the County' s planning consultant Phillips , Brandt and Reddick (PBR) . The coalition examined issues related to topography, street alignment , land use and park function . After considering the opportunities and constraints posed by these issues , the coalition worked toward preparation of a park boundary that would be acceptable to most of the interested parties . M M The park plan which has been prepared features approximately 66 acres of usable park area, with a minimum usable width of 150 feet . ` Significant contouring of the bluff face will allow a fully functional equestrian and pedestrian trail system to be designed into the park. Picnic and view areas will also be provided. As had been discussed previously, .a local loop road will provide access to the linear park at the bluff area west of Edwards Street and north of Garfield Avenue . Staff feels that the conceptual plan .which has been prepared by. the coalition will adequately address all of the anticipated needs for the linear park. City and County staff, along with representatives from the consulting firm of PBR will be prepared to discuss the benefits of the proposed. plan with the Council at. the meeting of April 17 , 1989 . Homeowner's Associations are spending maintenance dollars for those trails and setting aside reserved dollars for capital improvements to the trail system. Developer bond moneys have been given to the City to improve equestrian environments in the adjacent quartersection to the proposed site. The connection of all three areas--Central Park,Ellis- Goldewest, and Linear Park--must be connected with equestrian trails and safe equestrian crossings. Recall that the number of horses stabled in the City is still in the 500 animal range. And in Ellis-Goldenwest, the capability of another 100 is--possible and planhedfor. The vistas the Linear Park will create will be the most beautiful in the City, period. 16 deny our thousands of equestrian friends access to such a place, especially when the boarding of animals is so close, is to breach that trust we all have in government to do the right thing.
