HOPKINS, PE, DIRECTO PUBL190 KR S SUBJECT: Approve a Sole Source Purchase from Diversified Waterscapes, Inc. for Natural Lake Restoration Statement of Issue, Funding Source, Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: A waiver of the formal bidding requirement per Municipal Code Section 3.02.080(b)(4), Sole Source Goods and Services exemption, and approval for a purchase not to exceed $150,000 from Diversified Waterscapes, Inc. to provide lake restoration using proprietary and patented natural bacterial and enzymatic agents is requested. Funding Source: Funds in the amount of$150,000 are budgeted for lake restoration in the Infrastructure Fund, Public Works, Account No. 31485201.82200. Recommended Action: Motion to: 1. Waive the formal bidding requirement per Municipal Code Section 3.02.080(b)(4), Sole Source Goods and Services exemption; and 2. Authorize the purchase of lake restoration services from Diversified Waterscapes, Inc. in an amount not to exceed $150,000. Alternative Action(s): Do not waive the formal bidding requirement and direct staff accordingly. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 10/19/2009 DEPARTMENT ID NUMBER: PW 09-48 Analysis: Greer Lake and Chris Carr Lake are man-made lakes which suffer from declining water condition and diminished capacity due to a buildup of solids on the lake bottom. The buildup of sludge on the bottom is due primarily to waterfowl activity. The result is the lake water is not attractive, can become odorous, and can harbor pathogens harmful to fish and birds. Diminished water capacity creates an unsuitable environment for fish and may render the City ineligible for the fish stocking program offered by the California Department of Fish and Game. The common method to correct sludge accumulation is to drain the water and physically remove the material from the bottom, then refill and restock the lake. The removed material is held for drying in special tanks, tested for contaminants, and disposed of accordingly. Public Works staff sought an alternative to this drastic and expensive method to conserve water, preserve the fish population, and maintain the lakes for public enjoyment. Staff researched biological restoration using controlled applications of natural bacteria and enzymes and determined that this can be an effective alternative to draining the lakes for cleaning. A vendor was located in Orange County, Diversified Waterscapes, Inc., who proposed testing, treatment with bacterial and enzymatic agents, monitoring, and maintenance services over the course of several months to restore the lakes. The proposed services using the biological controls method would result in a cost savings of at least 50% over the draining method, allowing us to clarify both lakes with the budget originally intended to complete one. Diversified Waterscapes, Inc. demonstrated their products and methods to be effective during a pilot maintenance program implemented at Chris Carr Lake. This vendor is recommended as a sole-source purchase because the enzymatic agents and natural bacterial agents proposed for use are their own proprietary and patented blends which are manufactured for them under private label. References were checked with acceptable responses. The City has had positive experience with this vendor during the pilot program. Public Works Commission Action: Not applicable. Public Works staff sought an alternative to draining and physically cleaning the lake bottom in order to save money, conserve water, preserve the fish and bird populations,and keep the lakes available for public enjoyment The effectiveness of the proposed service has been vetted with a trial maintenance program at Chris Carr Lake. 3. Describe the uniqueness of the acquisition (why was the good/service/supplier chosen?). This supplier was chosen because they offer an eco-friendly method to clean and clarify man-made lakes without draining by using natural bacteria and enzymes. They are experienced in servicing lakes of similar size and larger than ours and have worked for public agencies, large golf courses, and homeowner's associations. They are local to Orange County. 4. What are the consequences of not purchasing the goods/services or contracting with the proposed supplier? The alternative is to drain the lakes and physically remove bottom sludge. This is more costly than the proposed service and will result in completion of only one lake,with a delay of approximately 2 years to complete the other lake due to current budget constraints on capital projects. Lake restoration is necessary in order to maintain the ecosystem and to continue eligibility for fish stocking from State Dept. of Fish and Game. 5. What market research was conducted to substantiate no competition, including evaluation of other items considered? (Provide a narrative of your efforts to identify other similar or appropriate goods/services, including a summary of how the department concluded that such alternatives are either inappropriate or unavailable. A search was performed on Thebluebook.com for similar contractors. The proposed vendor's biological agents are proprietary; one is patent-pending. Sludge removal via draining and dredging was considered, but staff determined bio-treatment to be preferable due to less costly and avoids draining the lakes. 2 y ' : CITY OF HUNTINGTON BEACH Sole Source Justification (For use on all goods and services acquisitions.) B. PRICE ANALYSIS 1. How was the price offered determined to be fair and reasonable? (Explain what the basis was for comparison and include cost analyses as applicable.) The alternative solution for bottom sludge removal is to drain the lake, physically remove bottom sludge, hold for de-watering in specialized tanks,test for presence of hazardous materials, and dispose of accordingly. The estimate for this method for Greer Lake is approximately $150,000,which is nearly triple the price of services proposed by this vendor for this lake. Additionally, draining and refilling the lake is avoided,thereby minimizing the effect of this process on fish and other wildlife as well as the public. A proposal from RPW Services offered monthly algae control for$425 monthly using chemical applications. This does not address the bottom sludge issue. 2. Describe any cost savings realized or costs avoided by acquiring the goods/services from this supplier. Acquiring the services and goods from this supplier for Greer Lake will save the city$95,000 as compared to draining/dredging alternative. Commensurate savings are expected for Chris Carr Lake. The cost to our municipal water supply is avoided by not draining the lakes.
