CRAIG HOWARD, Home Owners Association Gate Committee member, informed Council that
he believes most of the people would prefer Plan A as they also.want gates. He spoke
regarding the park issues, and the attorney's review of the situation. Mr. Howard requested that
a committee be appointed by council so that the Home Owners Association can work with staff
toward implementing a gate.
DEBBIE COOK spoke regarding a legal case relevant to this matter and urged everyone to
obtain a copy. She read some sections pertaining to the case. Ms. Cook spoke relative to the
matter. She informed Council that she believes that the people will have neither a park nor a
gate.
MS. THOMAS, Gate.Committee member, spoke regarding the history of the gate subject
including a discussion with former Planning Commissioner Ken Bourguignon. She informed
Council that Quarterhorse Lane is used like a racetrack by the residents themselves, and not
necessarily other people. She spoke regarding the 65 mile per hour traffic that will occur if
Quarterhorse Lane and Saddleback Lane are made through streets. Ms. Thomas spoke
regarding their conversations with Tom Zanick, developer, who did not want gates. She stated
that she believes all of the options should be looked at. Ms Thomas stated that a lot of the
homeowners have encyclopedia lots which they have extended onto their property and would
not want the city to have them.
JIM MELROSE, Hampton Home Owners Association member, stated that he believes there is a
way that they can come to agreement where there can be a gate and a park. He stated that he
believes the city ordinance requires that either a park or a refund is due to be made on the
property. Mr. Melrose informed them that the school district is considering deeding a portion of
their property to assist the situation.

Assistant Administrator Fallon presented an overview of the preliminary findings and conditions
set forth by the Planning Department, using the outline of her communication dated
March 20, 2000, titled Ellis/Goldenwest Quarter Section announced earlier as a late
communication by the City Clerk.
Deputy City Attorney D'Alessandro addressed legal aspects including the City Attorney's
opinion that the Measure C (City Charter) election provisions do not apply to the situation.
Community Services Deputy Director Engle presented a staff report and referred to wall charts,
including charts on Park Sites A & C— Regional Parksites; and a chart showing the location of
the various home owners associations.
At the request of Councilmember Green, Community Services Deputy Director Engle reported
on what Park Site B had been.
MOTION TO RECESS TO CLOSED SESSION
A motion was made by Green, second Sullivan to recess to Closed Session on the following
items. The motion carried by unanimous vote.

ACCESS GATES
PRELIMINARY CONDITIONS AND ISSUES
• Individual CC & R's appear to require 75% vote of
property owners to submit gate application.
• Master Homeowners' Association (MHA) must be
formed.
• 100% approval of property owners needed to gate
quarter section and privatize streets.
• MHA must indemnify City.
• Gates must include visitor call boxes, opticom systems
(police/fire access), required vehicle stacking and
torn around areas, vehicle and pedestrian access (inc.
for emergencies), and fire lanes and roads.
• Multipurpose (horse) trails remain open to the public.
• Public neighborhood park must have full public access
(including vehicular access).
• Saddleback must be connected per General Plan and
Ellis/Goldenwest Specific Plan.
• MHA assumes responsibility for street/utility/ .
infrastructure (including street lights; excludes water
and storm drains).
• Street vacation and zoning text amendment must be
addressed prior to processing Conditional Use Permit
for gates.

Request: To install traffic control gates at the entrances to the quartersection.
Location: Saddleback at Garfield,Saddleback and Ellis,Quarterhorse at Ellis,and Faircrest at
Edwards
Dear Mr.Hoskins:
As requested,staff has received responses from the various departments on the subject application and is
forwarding them to you. The following comments/requirements are separated by department:
PUBLIC WORKS DEPARTMENT COMTKENTS/REC91►ZIENDED CONDITIONS•

Assuming Saddleback and Quarterhorse are not fully improved and do not connect(existing condition):
1- Visitor(call-box)gates shall be designed at Saddleback/Garfield,Saddleback/Ellis,and
Quarterhorse/Ellis. The resident only location may be at Faircrest.
2. Plans shall be submitted to scale. Plans submitted are not to scale.
3. Street lights on Saddleback south(north of Ofield)are City owned and maintained. Ownership and
maintenance of the lights would require to be accepted by the association or SCE.
4. City owned segments of Saddleback and Quarterhorse will have to be vacated by the City.(Public
utility easements shall be obtained for sewer,water,storm drain,etc.within the public streets which
are vacated).
S. The association must have 100%approval from ALL the homeowners to gate the community.
6. Gates shall be equipped with Emergency Vehicle Pre-emption Equipment
7. The park designated within the community is public. Public access needs to be maintained or the
park has to be moved so that the public may access it.(see also Community Services comment)
8. The location of gates for residents only shall require a minimum distance of 30 feet.
9. The location of gates for visitors shall require a minimum distance of 50 feet. This queuing distance
is to avoid any possible spillage onto Edwards Street or Ellis Avenue.
10. The visitor(call-box)gates shall be widened to allow for a Standard SU-30(UPS Truck)vehicle to
make a U-turn or a three point turn in front of the gate.
11. The visitor gate at Saddleback/Garfield shall allow for two lanes in,one for visitors and the other for
a resident by-pass.

12. Location of call-boxes as shown on plan,may be constantly hit by vehicles. Suggest moving and/or
eliminating the call-boxes out of the street. Staff suggests a guard to serve the community at the
Saddleback/Garfield gate..
13. The existing utility easements for the water pipelines shall be amended to address the maintenance
and control of the area within the easement,specifically concerning paving within the easement,and
repair to any enhanced pavements,fencing,etc.by other than City forces,if water mains require
repair or maintenance.
14. The BB City School District(Se acliff Elementary School)must agree to the gating of Saddleback
north of Garfield. Any state regulations must also be satisfied.
♦ Since this gate is a call-box gate,who will the bus drivers call to be let inside the gate?
♦ Will they be given a remote opener?
♦ The bus drivers and buses are not always constant and there may be times that a substitute may
be driving.
15. A pedestrian security gate for emergency ingresslegress to the community is required. The
pedestrian security gate must meet requirements from the Uniform building Code Sections 3304(b),
3304(g), and 3304(e). Please check with the Building Department for these sections.
16. Flans do not address the horse trails. Are they to remain public? Vehicles may use the trails to
access the community if it is not addressed.
17. Once Saddleback and Quarterhorse are fully improved and connected,would the visitor.gates(except
for"main gate"at Garfield]be retrofitted to resident only?

1. Fire lanes to comply with Specification 415.
--2. Fire access roads to maintain unobstructed width of min.24 ft.and comply with Specification 401.
3. Gates to comply with Spec.403.
4. Area designated on plan as"pavement ends"shall have the following:
a. Fire access roads must have all weather surfaces(pavement). Applicant may either construct the
connecting section to the weight specifications for fire apparatus,or provide damage waiver to
the City if the surface is substandards.
b. If gates are proposed at the Saddleback connection,they must be electrically operated following
the requriements as stated in Specification 403.

As previously discussed,the street vacation and zoning text amendment must be addressed prior to
processing the conditional use permit for the traffic control gates. Therefore,the subject applications
remain incomplete.

As you know, the majority of people who live on Edwards Hill (in the quarter section
bounded by Goldenwest, Ellis, Edwards, and Garfield) are interested in having Gates. The
overwhelming majority of our homeowners have informed us that if a park at site A
prohibits us (or makes our chances extremely unlikely) from gating then they would prefer
Gates over the Park.
We understand that there will be a Study Session held on 3-20-00 and most, if not all of us,
will attend. We would like guidance from the City Council on how we can expedite (as
much as possible) the process of us determining whether gates for our quarter section are
feasible. We have been working on this project for several years and we all understand that
there are several hurdles still to overcome. If possible, could we have a Council Sub-
Committee created to help us in our endeavor?
