Adopt Ordinance No. 4167 amending Section 2.76.010 of the Huntington Beach Municipal
Code (HBMC) related to exclusions from competitive service by adding the classification of
Assistant Chief of Police
Approved for introduction 11/5/2018 - Vote: 6-0-1 (Posey-No)
Statement of Issue:
Ordinance No. 4167 is hereby introduced to amend Section 2.76.010 of the Huntington Beach
Municipal Code to add the classification of Assistant Chief of Police.
Financial Impact:
Funding for the Assistant Chief of Police is included in the FY 2018-19 budget.
Recommended Action:
Adopt Ordinance No. 4167, "An Ordinance of the City of Huntington Beach Amending the Huntington
Beach Municipal Code by Amending Section 2.76.010 Thereof Related to Exclusions From the
Competitive Service" by adding the Classification of Assistant Chief of Police.
Alternative Action(s):
Reject the Ordinance amendment to the Huntington Beach Municipal Code and direct staff to
establish the Assistant Chief of Police in an alternative manner consistent with California Code of
Regulations (CCR) Title 2, Section 570.5 and 571 .
Analysis:
Management Partners conducted a comprehensive review of HBPD operations in 2017. It was
recommended that a "second in command" sworn executive position be established to improve
departmental operational efficiency and to establish a ladder for succession planning. This action
provides the foundation for succession planning and strategic department and divisional re-alignment

in anticipation of improved departmental operations overall.
Reporting directly to the Chief of Police, the Assistant Chief of Police will exercise extensive authority
in directing and coordinating a broad range of Police Department operational functions through
subordinate sworn and non-sworn command staff, division managers and operations supervisors.
The job classification specification and compensation range for Assistant Chief of Police is currently
in development, and will be presented at a future meeting. Recruitment and selection will be
promotional-only.
The Assistant Chief of Police is a sworn position which will be appointed as an employment
contract/at-will appointment included as part of the classifications designated as Non-
Represented/Non-Associated, and is not included as part of the competitive service.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH MUNICIPAL CODE BY AMENDING
SECTION 2.76.010 THEREOF RELATED TO
EXCLUSIONS,FROM THE COMPETITIVE SERVICE
The City Council of the City of Huntington Beach does hereby ordain as follows:
SECTION I. That Section 2.76.010 of the Huntington Beach Municipal Code entitled
"Exclusions From Competitive Service" is hereby amended to read follows:
2.76.010 Exclusions from Competitive Service
Pursuant to Section 403 of the City Charter, it is declared that all
Departments and appointive officers and employees of the City are
Included within the personnel system and the competitive service except:
A. Elective officers;
B. City Manager;
C. Assistant City Manager;
D. Members of appointive boards, commissions and committees;
E. Persons engaged under contract to supply expert, professional,
technical or other services;
F. Emergency employees who are hired to meet the immediate
requirements of the emergency;
G. Employees who are employed to work a regular schedule of less
than 1040 hours in any fiscal year;
H. Temporary employees;
I. Appointive department heads;
J. Appointive Deputy City Treasurer;
K. Ambulance operators;
L. Chief Assistant City Attorney;
M. Deputy Community Prosecutor;
N. Deputy Director of Community Development; and
O. Assistant Chief of Police.

SECTION 2. That this Ordinance shall become effective thirty (30) days after its
adoption.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on November 19, , 2018.
