Statement of Issue: Staff has completed negotiations and prepared new and revised
classification specifications for marine safety positions along with a side letter of agreement
between the city and the Marine Safety Officers Association for Council approval.

Recommended Action(s): Motion to:
1. Approve the following minute actions and approve and adopt in the format of Resolution
No. 2002-28 — to be prepared by the City Attorney, executed by the Mayor and attested.to
by the City Clerk:
a. Approve new classification of Marine Safety Officer I;
b. Approve new classification of Marine Safety Officer II, include reclassification
certification and training requirements from Marine Safety Officer I to II;
c. Approve revised classification for Marine Safety Lieutenant;
d. Delete the former classification of Marine Safety Officer;
e. Temporarily reclassify all existing Marine Safety Officers (Range 476 and 501) to the
new classification of Marine Safety Officer II (Range 501);
f. Temporarily reclassify all four existing Marine Safety Lieutenants (Range 523) to the
new classification of Marine Safety Lieutenant (.Range 523).

2. Approve Side Letter between the City of Huntington Beach and the Huntington Beach
Marine Safety Officers Association and approve and adopt in the format of Resolution
No. 2002-29 —to be prepared by the City Attorney, executed by the Mayor and attested to
by the City Clerk.
3. Authorize the Director of Administrative Services to appropriate $15,000 from the
unappropriated General Fund reserve Account #100.31100.19990 into Marine Safety
Personnel Account#10045207.51100.
Alternative Action(s): Do not approve one or all of the recommended actions and direct
staff to return to negotiations with the Marine Safety Officers Association.
Analysis: During the meet and confer process leading to the current three-year
memoranda of understanding, the Marine Safety Officers Association (MSOA) proposed
various changes to the city's classification and compensation plan involving employees
represented by that unit. In response to the MSOA proposal, the city agreed to conduct a
classification study to determine which duties more appropriately described the duties being
currently performed by Marine Safety Officers and Lieutenants, certificates were required as
a minimum job qualification, appropriate job titles, and salary levels.
The Human Resources Division of the Administrative Services Department, in conjunction
with representatives of MSOA, conducted the above study. The parties met several times
during 2001 to discuss and exchange information. On February 19, 2002, a tentative
agreement was reached which proposed three distinct classification levels with specific
qualification requirements as a minimum and others as part of an incentive pay plan. In
exchange for the new classifications and pay proposals, the MSOA agreed to eliminate boat
pay, move-up pay, and night supervisory pay. Further changes were agreed upon involving
operational policies 5.1 and 5.3, which assured that relief assignments for Lieutenant and
Chief would be based upon qualifications, experience, and performance rather than seniority.
Total additional cost for 2001 —2002 = $15,000
Total additional cost for 2002 —2003 = $120,000*
Total Annual Cost = $50,000
*($70,000 is a one-time cost for overtime to backfill for certifications.)
The current total budget for 2001/2002 total permanent marine safety salary costs is
$985,776. With the additional cost, the total budget would be $1,000,776. The effective date
would be the pay period starting March 16, 2002.
Staff is recommending that Council approve the side letter between the city and the MSOA,
which memorializes this agreement.

Personnel Commission Recommendation: The Personnel Commission recommended
approval of the new and revised classification specifications, policies and procedures, and

COUNCIL POLICY REGARDING REQUESTS FOR AN APPROPRIATION OF FUNDS:
As adopted by the City Council in March 1998, all requests for appropriation of funds must
meet one of the following criteria: 1) The request is for an unanticipated emergency, 2) The
request is required to implement labor negotiations, or 3) The request will be offset by related
new revenues. The new appropriation being requested is required to implement labor
negotiations.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH TO AMEND
THE CITY CLASSIFICATION PLAN BY ADDING, DELETING,
AND MODIFYING CLASSIFICATIONS IN THE
COMMUNITY SERVICES DEPARTMENT
WHEREAS, the City Council wishes to amend the City Classification Plan; and
The provisions of Personnel Rule 12-4 have been complied with, in that the changes were f
considered by the Personnel Commission during a public hearing held on March 20, 2002, and
the Commission voted to recommend the changes to the City Council.
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
I. The City Classification Plan is hereby amended by adding the following
classifications:
Marine Safety Officer I
Marine Safety Officer H
The class specifications for the above positions are attached hereto as Exhibit A
and incorporated herein as if fully set forth.
2. The City Classification Plan is hereby amended by modifying the class

DUTIES SUMMARY — The incumbent provides supervision of recurrent personnel and
lifeguards, patrols beach and ocean areas from an assigned tower, emergency rescue
vehicle, or patrol vessel in order to provide first line protection of the lives and property
of beach patrons; and participates in aquatic and other related emergencies and
rescues, and prevents marine accidents.
DISTINGUISHING CHARACTERISTICS — The incumbent works under the supervision
of Marine Safety Lieutenant. This position is distinguished from the open water
Lifeguard in that the latter is a . recurrent position. The Marine Safety Officer I is
distinguished from the Marine Safety Officer II in that the latter has completed specific
advanced trainings, (such as cliff and.helicopter rescue), which result in an advanced
scope of responsibilities, and two years of full-time experience as a Marine Safety
Officer I.
EXAMPLES OF ESSENTIAL DUTIES — Under direct supervision of the Marine Safety
Lieutenant, the incumbent establishes command and control of . emergencies until
relieved; lifeguards an assigned area from a tower or an emergency rescue vehicle;
performs ocean rescues, informs bathers and boaters of hazardous ocean conditions;
removes dangerous objects from beach and ocean areas; supervises, trains, and
evaluates the lifeguarding activities of subordinates and shares supervisory
responsibilities of all recurrent staff; participates in flood and swiftwater, and basic
SCUBA rescue/recovery operations; briefs subordinates concerning conditions; assigns
personnel to designated areas of beach; performs routine preventative maintenance on
towers, vehicles, vessels, equipment and other facilities within assigned area; maintains
daily records of activities and completes reports on same; receives and records National
Weather Service reports; interacts with the public on the beach; answers questions and
assists patrons with problems; enforces Municipal Ordinances, issues citations for
violations of beach, parking and:parks ordinances as necessary as a peace officer under
PC 830.31; works with Police, Fire and other agencies as required; operates specialized .
lifesaving equipment; performs various first aid practices of a highly skilled nature; and
performs other related duties as assigned.

Waterways Master Mariner, 200 hrs.; HBMSD Rescue Vessel. In addition, two
years of satisfactory performance evaluations as an MSO I (or equivalent) are
required to promote to Marine Safety Officer II.

is distinguished from the Marine Safety Lieutenant in that the latter supervises all
MSO I's and II's, requires a greater scope of responsibility, and has additional years of
experience.

and recurrent personnel; trains and coordinates activities of permanent and recurrent
personnel, and provides beach safety through education, prevention and emergency

DISTINGUISHING CHARACTERISTICS — The incumbent works under the supervision
of Marine Safety Division Chief. This position is distinguished from the MSO II in that it
is responsible for the supervision, direction and training of all Marine Safety Officers,
and possesses a minimum of two years of additional Marine Safety experience.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH AMENDING THE
MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND
THE HUNTINGTON BEACH MARINE SAFETY OFFICERS' ASSOCIATION,
BY ADOPTING THE SIDE LETTER OF AGREEMENT
WHEREAS, on December 18, 2000, the City Council of Huntington Beach
adopted Resolution No. 2000-123 for the purpose of adopting the 2000/03 Memorandum
of Understanding(MOU) bet-ween the City and the Huntington Beach Marine Safety
Officers' Association(HBMSOA);
Subsequent to the adoption of the MOU, the City of Huntington Beach and the
HBMSOA agreed to changes, corrections, and clarifications to the MOU that are reflected in a
Side Letter of Agreement between the City of Huntington Beach and the HBMSOA("Side Letter
of Agreement") attached hereto as Exhibit A and incorporated herein by this reference.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Huntington Beach as follows:
Section 1. The Side Letter of Agreement attached hereto as Exhibit A is
approved and adopted.
Section 2. The Side Letter of Agreement amends the MOU between the City
of Huntington Beach and the HBMSOA.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach
at a regular meeting thereof held on the 1st day of April ,

SIDELETTER OF AGREEMENT
Between the City of Huntington Beach
And
The Huntington Beach Marine Safety Officers' Association
This is to memorialize an agreement between the City of Huntington Beach and
the Huntington Beach Marine Safety Officers' Association (HBMSOA) that provides for
revisions to classification specifications for Marine. Safety Officer positions represented
by HBMSOA and specific agreed upon changes to the existing . 2000-2003
Memorandum of Understanding and 5.1 and 5.3 of the Marine Safety Policies and
Procedures Manual.
Article II — Representation Unit/Classifications
(Replaces Existing Article II)
It is recognized that the Marine Safety Officer's Association is the employee
organization, which has the right to meet and confer in good faith with the City on behalf
of the employees of the Huntington Beach Community Services Department within the
following classifications:
Marine Safety Lieutenant
Marine Safety Officer II
Marine Safety Officer I
With the approval of the Personnel Commission, and upon adoption of the
revised classification specification for Marine Safety Lieutenant, Marine Safety Officer I,
and Marine Safety Officer II by the Huntington Beach City Council; all existing Marine
Safety Officers shall be temporarily "grand fathered" into the new classification of
Marine Safety Officer II for a period not to exceed the current MOD's expiration date of
September 30, 2003. Any temporarily "grand fathered" Marine Safety Officer who does
not obtain all required qualifications for Marine Safety Officer 11, as specified in the
classification specification, shall be reclassified to Marine Safety Officer I effective
October 1, 2003.
All existing Marine Safety Lieutenants shall be temporarily reclassified into the
new revised classification of Marine Safety Lieutenant for a period not to exceed the
current MOU expiration date of September 30, 2003. .Any temporarily reclassified
Marine Safety Lieutenant that does not obtain all of the required qualifications for
Marine Safety Lieutenant, as specified in the classification specification, shall be
reclassified to Marine Safety Officer II effective October 1, 2003.

Extensions to the "grand fathered" deadline for obtaining the requirements of the
above classifications shall be allowed if the City, due to its scheduling needs, does not
allow an employee the time to obtain the required certifications; or, if the employee is
unable to obtain these requirements due to work related injury or illness. Time
extensions may also be granted at the option of the City if the required classes or
training for such requirements were unavailable during the "grand father" time period.
All time extensions will be considered on a case-by-case basis after considering the
circumstances causing the delay. It is the intent of both the City and the Association to
make their best effort to obtain all required qualifications by September 30, 2003.
Article V— Salary Schedules
(Replaces Existing Article V)
Employees shall be compensated at rates by classification title and salary range
during the term of this agreement as set out in Exhibit Al .attached hereto and
incorporated herein.
Article VI — Special Pay
(Replaces Paragraph C —Assignment Pay with the Following Language)
C. Incentive Pay:
1. Marine Safety Officer II — Employees classified as MSO II shall receive
an additional five (5) percent in pay, over their base pay for
obtaining and maintaining active certification in all seven of the
following specialties: SCUBA/Rescue; ICS Incident Command System
100 and 200; Instructor 1A and 1 B; SCUBA/Dry Suit; and Instructor
Emergency Response Red Cross.
2. Marine Safetv Lieutenant — Employees classified as Marine Safety
Lieutenant shall receive an additional five (5) percent incentive pay,
over their base pay for obtaining and maintaining active certification in
all four of the following specialities: ICS Incident Command System
300; Command 1A and 1 B; and Management I.

DUTIES SUM M- AI&Y: To patrol beach and ocean areas from an assigned tower or emergency
rescue vehicle or patrol vessel in order to provide for the first line protection of lives and
property of beach patrons.
DISTINGUISHING CHARACTERISTICS: This classification supervises Recurrent Lifeguard
personnel on a seasonal basis.
EXAMPLES OF DUTIES: Patrols the beach and ocean area from an assigned tower, patrol
vehicle or vessel. Performs ocean rescues, informs bathers, beach patrons and boaters of
hazardous conditions and removes dangerous objects from the water and beach area.
Performs routine preventative maintenance on assigned vehicles, vessels and equipment in
the assigned area. Maintains daily records of activities and completes reports on same.
Interacts with the public on the beaches; answers questions, and assists patrons with
problems; enforces Municipal Ordinances; issues citations for violations as necessary; works
in concert with the Police Department as required. Supervises and participates in
Underwater Rescue and Recovery Operations as required. Supervises and participates in
specialized rescue activities including swiftwater rescue and limited access cliff/bluff
rescues and extrication. Operates specialized lifesaving equipment and performs various
first aid practices of a highly skilled nature. Assumes control in all rescue, first aid and
aquatic emergencies until relieved by a superior officer. Supervises the lifeguarding
activities of Recurrent Lifeguard personnel. Briefs subordinate personnel concerning
conditions, assigns personnel to a designated area of beach; assists in practical training of
subordinates; evaluates performance of subordinates; provides backup for rescues performed
by personnel in his area of responsibility. Performs other related duties as assigned or
needed.
KNOWLEDGE, SKILLS, ABILITIES & PERSONAL ATTRIBUTES: Knowledge of principles
and practices of modern, open-water lifesaving techniques, small boat safety and
operations. Knowledge of equipment and apparatus used in ocean lifesaving operations.
Knowledge of first aid and EMT practices. Knowledge of and ability to utilize the principles
and practices of underwater search and recovery techniques and basic diving physics.
- Ability to swim in adverse weather and surf conditions for extended periods of time and to
perform ocean rescues under said conditions. Ability to size up emergencies and adopt
effective courses of action. Ability to perform underwater search and recovery operations.
Ability to perform rescue operations in Swiftwater conditions. Ability to perform rescue
operations adjacent to or from low level cliffs or bluffs.
MINIIMUM QUALIFICATIONS: Education/Experience: High school graduation. Minimum
180 work days of experience as ocean lifeguard. Physical: Minimum age: 21 years.
Excellent health (Must pass a City physical before appointment). Vision requirement 20/40
un-corrected. Licenses/Certificates Required: California Driver's license, current at time
of appointment. EMT I Certification, current at time of appointment. SCUBA Certification

A. PURPOSE

B. POLICY

C. PROCEDURE
1.. Marine Safety Lieutenants shall draft schedules that best utilize available
personnel. These schedules may include both short-term and long-term
assignments.
2. The Marine Safety Main Chief shall approve or modify the schedules
submitted by the Marine Safety Lieutenants.
3. The operations supervisor or his designee may, in the interest of public
safety, assign personnel to positions that differ from their normal schedules.

5. Assignments to rescue boat operator, Lieutenant, and Chief will be

Ocean Lifeguard II's, Recurrent Ocean Lifeguard III's, Marine Safety
Officers and Marine Safety Lieutenants whenever possible.
7. The Junior Lifeguard Coordinator II shall make recommendations for new
Junior Lifeguard Instructor assignments based on the results from oral
interviews of qualified applicants. To qualify, applicants must have a
minimum of 720 hours experience as a Huntington City Beach Recurrent
Ocean Lifeguard I, II, or equivalent (evaluated on a case by case basis).
8. Deckhand appointments will be based on Rescue Boat Operator
evaluations of candidates during deckhand training and recommendations
from Recurrent Ocean Lifeguard Ill's, Marine Safety Officers and Marine
Safety Lieutenants.

9. Dispatcher appointments will be based on recommendations from Marine

Subject: Item E-14: Classification/Specification for Marine Safety positions
and the Side Letter of Agreement
Honorable City Council,
As a matter of pride, duty to our community and in the interest of public safety the
MSOA and I respectfully request that you consider and pass item E-14 listed above.
If passed, item E-14 would:
• Support the unanimous recommendation of the Personnel Commission
• Resolve several management issues
• Resolve several classification issues
• Protect the considerable investment of time and effort towards the Study
In October of 2000 the City and the MSOA agreed (within the MOU) to complete a
comprehensive Job Study. For all of 2001 and part of 2002 we aggressively worked on
the study and a solution. We reached a consensus for a final product before you tonight.
Without going into detail,I can give you an example of the revised classification
proposed for myself, one of ten Marine Safety Officers.
The current minimum job requirements for Marine Safety Officer are:
1) Social Security Card 2) CDL license 3) EMT license 4) Special Officer card and
5) In house basic lifeguard training.
The City and the MSOA agreed this did not accurately reflect what an MSO already does
and what and MSO should do. The Marine Safety job description and the beach at
Huntington Beach have changed a great deal since the job requirements listed above were
created.

The proposed minimum job requirements for MSO II in addition to the 5 listed above are:
1) Annual swim fitness - USLA standard 2) AED 3) SCUBA Basic 4) Calif. Dept. of
Boating & Waterway Basics 5) Basic Supervision 6) Swiftwater 1 —NFPA 7) Personal
Watercraft 8) Inflatable Rescue Boat 9) Swiftwater 2 —NFPA 10) Cliff Rescue 11)
HBPD Helicopter 12) SCUBA Advanced 13) Calif. Dept. of Boating & Waterways
Masters 14) HBMSD Rescue Vessel
And for an additional certification pay are:
1) Red Cross Emergency Responder 2) SCUBA Rescue 3) Incident Command 100 and
200—State Fire Marshall 4) Instructor 1 A and 1 B — State Fire Marshall
5) SCUBA Dry Suit.
As you can see, your Marine Safety Officers are prepared to serve this community.
