Approve the following minute actions and approve and adopt in the format of Resolution No. 2002-28 — to be prepared by the City Attorney, executed by the Mayor and attested.to by the City Clerk: a. Approve new classification of Marine Safety Officer I; b. Approve new classification of Marine Safety Officer II, include reclassification certification and training requirements from Marine Safety Officer I to II; c. Approve revised classification for Marine Safety Lieutenant; d. Delete the former classification of Marine Safety Officer; e. Temporarily reclassify all existing Marine Safety Officers (Range 476 and 501) to the new classification of Marine Safety Officer II (Range 501); f. Temporarily reclassify all four existing Marine Safety Lieutenants (Range 523) to the new classification of Marine Safety Lieutenant (.Range 523). CS02-015 MSOA-Side Letter -- 3/28/2002 11:05 AM REQUEST FOR COUNCIL ACTION MEETING DATE: April 1, 2002 DEPARTMENT ID NUMBER: CS02-015 2. Approve Side Letter between the City of Huntington Beach and the Huntington Beach Marine Safety Officers Association and approve and adopt in the format of Resolution No. 2002-29 —to be prepared by the City Attorney, executed by the Mayor and attested to by the City Clerk. 3. Authorize the Director of Administrative Services to appropriate $15,000 from the unappropriated General Fund reserve Account #100.31100.19990 into Marine Safety Personnel Account#10045207.51100. Alternative Action(s): Do not approve one or all of the recommended actions and direct staff to return to negotiations with the Marine Safety Officers Association. Analysis: During the meet and confer process leading to the current three-year memoranda of understanding, the Marine Safety Officers Association (MSOA) proposed various changes to the city's classification and compensation plan involving employees represented by that unit. In response to the MSOA proposal, the city agreed to conduct a classification study to determine which duties more appropriately described the duties being currently performed by Marine Safety Officers and Lieutenants, certificates were required as a minimum job qualification, appropriate job titles, and salary levels. The Human Resources Division of the Administrative Services Department, in conjunction with representatives of MSOA, conducted the above study. The parties met several times during 2001 to discuss and exchange information. On February 19, 2002, a tentative agreement was reached which proposed three distinct classification levels with specific qualification requirements as a minimum and others as part of an incentive pay plan. In exchange for the new classifications and pay proposals, the MSOA agreed to eliminate boat pay, move-up pay, and night supervisory pay. Further changes were agreed upon involving operational policies 5.1 and 5.3, which assured that relief assignments for Lieutenant and Chief would be based upon qualifications, experience, and performance rather than seniority. Total additional cost for 2001 —2002 = $15,000 Total additional cost for 2002 —2003 = $120,000* Total Annual Cost = $50,000 *($70,000 is a one-time cost for overtime to backfill for certifications.) The current total budget for 2001/2002 total permanent marine safety salary costs is $985,776. With the additional cost, the total budget would be $1,000,776. The effective date would be the pay period starting March 16, 2002. Staff is recommending that Council approve the side letter between the city and the MSOA, which memorializes this agreement. COUNCIL POLICY REGARDING REQUESTS FOR AN APPROPRIATION OF FUNDS: As adopted by the City Council in March 1998, all requests for appropriation of funds must meet one of the following criteria: 1) The request is for an unanticipated emergency, 2) The request is required to implement labor negotiations, or 3) The request will be offset by related new revenues. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: I. DISTINGUISHING CHARACTERISTICS — The incumbent works under the supervision of Marine Safety Lieutenant. This position is distinguished from the open water Lifeguard in that the latter is a . recurrent position. The Marine Safety Officer I is distinguished from the Marine Safety Officer II in that the latter has completed specific advanced trainings, (such as cliff and.helicopter rescue), which result in an advanced scope of responsibilities, and two years of full-time experience as a Marine Safety Officer I. DISTINGUISHING CHARACTERISTICS — The incumbent works under the supervision of Marine Safety Division Chief. This position is distinguished from the MSO II in that it is responsible for the supervision, direction and training of all Marine Safety Officers, and possesses a minimum of two years of additional Marine Safety experience. Time extensions may also be granted at the option of the City if the required classes or training for such requirements were unavailable during the "grand father" time period. All time extensions will be considered on a case-by-case basis after considering the circumstances causing the delay. It is the intent of both the City and the Association to make their best effort to obtain all required qualifications by September 30, 2003. For all of 2001 and part of 2002 we aggressively worked on the study and a solution. We reached a consensus for a final product before you tonight. Without going into detail,I can give you an example of the revised classification proposed for myself, one of ten Marine Safety Officers.
