ADMINISTRATIVE SERVICES AS PLAN ADMINISTRATOR FOR
THE EMPLOYEES DEFERRED COMPENSATION PLANS

Statement of Issue: The current deferred compensation plans specify the Deputy City
Administrator/Administrative Services as the Plan Administrator. This title no longer exists.
Should the Director of Administrative Services be named as the Plan Administrator for
employees deferred compensation plans?
Funding Source: Not applicable
Recommended Action: Adopt Resolution260/-39-A resolution of the City Council of the
City of Huntington Beach amending City Council resolution No. 6336 and designating the
Director of Administrative Services as Plan Administrator for the employees deferred
compensation plan and directing the City Treasurer to approve the investment of funds.
Alternative Action(s):
No action would default Plan Administration to the City Administrator.

Analysis: The City of Huntington Beach originally adopted a deferred compensation plan in
1973, amended it in 1989, amended it again in 1991. The 1991 amendment, adopted by
resolution 6336, specified the Deputy City Administrator/Administrative Services as the Plan
Administrator and the City Treasurer was authorized to approve the mode of investment.
The job classification "Deputy City Administrator/Administrative Services" no longer exists.
Responsibility for Plan Administration defaults to the City Administrator. This council action
delegates this authority to the Director of Administrative Services, while the City Treasurer
would continue to approve the mode of investment.
In addition, a staff committee composed of the City Treasurer, the Director of Administrative
Services, the Finance Officer, the Principal Administrative Analyst for Employee Benefits,
and a representative from the Insurance Advisory Committee will monitor deferred
compensation plans, develop a strategy to educate employees on the plans, and solicit
employee input regarding the plans from the Insurance Advisory Committee.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
AMENDING CITY COUNCIL RESOLUTION NO. 6336 AND DESIGNATING THE
DIRECTOR OF ADMINISTRATIVE SERVICES AS PLAN ADMU41STRATOR FOR THE
EMPLOYEES DEFERRED COMPENSATION PLAN AND DIRECTING THE CITY
TREASURER TO APPROVE THE INVESTMENT OF FUNDS
WHEREAS, on December 2, 1991, the City Council of the City of Huntington Beach
adopted Resolution 6336 for the purposes of updating and implementing a Deferred Compensation
Plan ("Plan") which enabled employees to defer a portion of their compensation to a future time.
Pursuant to the Plan, such deferred compensation monies are, in effect, held in trust by the City and
invested in a manner allowed by the Plan.
Pursuant to Resolution 6336, the mode of investment of the funds in the Plan is to be
approved by the City Treasurer or her designee, and the Deputy City Administrator/Administrative
Services is authorized to implement the Plan.
The City Council of the City of Huntington Beach desires to amend Resolution No. 6336,
and authorize the Director of Administrative Services to implement the Plan as Plan Administrator.
The City of Huntington Beach desires to continue to have the City Treasurer, or her designee
approve the mode of investment of the funds in the Plan.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Huntington
Beach that the Director of Administrative Services is authorized to implement the Plan and is
designated Plan Administrator.
IT IS HEREBY FURTHER RESOLVED that the mode of investment of funds in the Plan
must be approved by the City Treasurer or her designee.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular
meeting thereof held on the 4th day of September- , 2001.
