This job title no longer exists.. Should the Deputy City Administrator be named as the Plan Administrator for employees deferred compensation plans? Funding Source: Not applicable Recommended Action: Motion to: Adopt Resolution Z0010 -22-/ , a Resolution of the City Council of the City of Huntington Beach amending City Council Resolution No. 2001-59 and designating the Deputy City Administrator as Plan Administrator for the employees deferred compensation plan, and directing the City Treasurer to approve the investment of funds. Alternative Action(s): No action would default plan administration to the City Administrator. JPQUEST FOR COUNCIL ACTI%A MEETING DATE: 5/15/2006 DEPARTMENT ID NUMBER: ADCS-66-16 Analysis: The City of Huntington Beach originally adopted a deferred compensation plan in 1972, amended it in 1989, 1991. and .2001. The 2001 amendment; adopted by Resolution No. 2001-59, specified the Director of Administrative Services as the Plan Administrator and the City Treasurer was authorized to approve the mode of investment. On March 21, 2005, the City -Council approved an organizational change which eliminated the position of Director of Administrative Services and created the new position of Deputy City Administrator - City Services.. Since the job classification of Director of Administrative Services no longer exists, responsibility for plan administration defaults to the City Administrator. This City Council action delegates plan administration authority to the Deputy City Administrator - City Services, while the City Treasurer would continue to approve the mode of investment. The Deputy City -Administrator - City Services, provides oversight on employee benefit programs through the Human Resources Manager; therefore, is proposed as the appropriate position for this designation. P:\RCA\RCA 2006\RCA.457 Plan Admin.051506.doc -2- 5/3/2006 9:37 AM ATTACHMENT #1 RESOLUTION NO. 2006-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING CITY COUNCIL RESOLUTION NO.2001-- 59 AND DESIGNATING THE DEPUTY CITY ADMINISTRATOR AS PLAN ADMINISTRATOR FOR THE EMPLOYEES DEFERRED COMPENSATION PLAN AND DIRECTING THE CITY TREASURER TO APPROVE THE INVESTMENT OF FUNDS WHEREAS, on December 2, 1991, the City Council of the City of Huntington Beach adopted Resolution 6336 for the purposes of updating and implementing a Deferred Compensation Plan ("Plan") which enabled employees to defer a portion of their compensation to a future time. Pursuant to the Plan, such deferred compensation monies are, in effect, held in trust by the City and invested in a manner allowed by the Plan; and Resolution 2001-59, authorized the Director of Administrative Services to implement the Plan as the Plan Administrator; and On March 21, 2005, the City Council eliminated the position of Director of Administrative Services and authorized two new positions: Deputy.City Administrator -City Services and Deputy City Administrator -Development; and The City Council of the City of Huntington Beach desires to amend Resolution No. 2001-59, and authorize the Deputy City Administrator -City Services to implement the Plan as Plan Administrator. The City of Huntington Beach desires to continue to have the City Treasurer;, or her designee approve the mode of investment of the funds in the Plan, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Huntington Beach that the Deputy City Administrator -City Services is authorized to implement the Plan and is designated Plan Administrator. IT IS HEREBY FURTHER RESOLVED that the mode of investment of funds in the Plan must be approved by the City Treasurer or her designee.
