SUBJECT: Adopt Resolution No. 2012-85 amending the City Classification Plan
by adding the Job Classification of Fire Marshal
Statement of Issue: The City's Classification Plan requires an amendment to incorporate
changes considered and approved by the Personnel Commission at their regularly scheduled
meeting held November 21, 2012. The amendment is to add the position of Assistant Fire
Marshal.
Financial Impact: Funding for the proposed job classification of Assistant Fire Marshal is
included in the FY 2012-13 budget. No additional appropriation is required.
Recommended Action: Motion to:
Adopt Resolution 2012-85, "A Resolution of the City Council of the City of Huntington Beach
Amending the City's Classification Plan by Adding the Job Classification of Assistant Fire
Marshal and Establishing the Compensation."
Alternative Action(s): Reject proposed amendment to the classification plan. In
accordance with Personnel Rule 12-4, if an amendment to the City's Classification Plan is
rejected by the City Council, the City Council is to refer such amendments or revisions back
to the Personnel Commission with reasons for rejection and its recommendation thereon.
Analysis: The Personnel Commission has considered and approved the following
amendment to the City's Classification Plan:
At the November 21, 2012 Personnel Commission meeting, staff proposed the establishment
of the new classification of ASSISTANT FIRE MARSHAL. As part of a modification of
service delivery review and analysis, the Fire Department evaluated the functional and
operational design, performance of services, and level and scope of department service
requirements with respect to its fire marshal operations. Based upon the input of the
department director and staff, it has been determined that the needs of the department and
the community with respect to fire marshal requires the establishment of a new (civilian)
ASSISTANT FIRE MARSHAL position.

Presently, sworn fire personnel perform the duties inherent to Fire Marshal services.
However, the Fire Department has determined which duties may be handled by civilian
personnel so that sworn staff may be deployed for direct fire prevention and fire protection
service delivery in the field.
The civilian ASSISTANT FIRE MARSHAL position varies significantly from the sworn
administratively-appointed position of Deputy Fire Marshal in that the latter performs direct
fire service work and requires extensive fire prevention experience, certifications, and formal
training as a firefighter.
No new funds are required in the FY 2012-13 budget as the current funding level is adequate
to support the class plan amendment. The recommend base salary range is $7,497 - $9,289
(Range 599). The City and MEO met and conferred regarding this classification. The
Personnel Commission approved the class plan modification, adding the proposed job
classification.
The approved recommended action is:
Add the job classification of ASSISTANT FIRE MARSHAL to the City's classification
plan and establish compensation at pay range 599.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
AMENDING THE CITY'S CLASSIFICATION PLAN BY ADDING THE JOB
CLASSIFICATION OF ASSISTANT FIRE MARSHAL AND ESTABLISHING THE
COMPENSATION
WHEREAS, the City Council of Huntington Beach wishes to. amend the City's
Classification Plan; and
The provisions of Personnel Rule 12-4 have been complied with, in that the changes to
the City Classification Plan were considered by the Personnel Commission during a .public
hearing on November 21, 2012.
The Commission voted to recommend to the City Council that the City's Classification
Plan be amended to include the classification of ASSISTANT FIRE MARSHAL,.
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve that the Classification Plan be amended to add the job classification of ASSISTANT
FIRE MARSHAL, and establish monthly compensation at Range 599 ($7,498 - $9,289) as set
forth in Exhibit A which is attached hereto and incorporated by this reference.
PASSED AND ADOPTED by the City Council of the city of Huntington Beach at a
regular meeting thereof held on the 17 th day of December 2012.

DUTIES SUMMARY
Under general direction, plans, directs, manages, and coordinates the inspection
activities and operations of the Fire Prevention Division within the Fire Department.
DISTINGUISHING CHARACTERISTICS
This is a non-sworn position reporting to the Division Chief/Fire Marshal.
EXAMPLES OF ESSENTIAL DUTIES
• Supervises subordinate personnel in administering programs and activities of the fire
inspection function, including fire prevention inspections of hazardous processes,
industrial and commercial occupancies, institutional and public assemblage
occupancies, and construction sites; assists in the management of other programs
and activities of the Fire Prevention Division as assigned.
• Oversees code enforcement activities related to environmental management,

As part of the FY 2012/13 budget process, the Fire Department requested a reclassification of the
existing Deputy Fire Marshal position from safety to non-safety status. Doing so requires creating a
new job classification because the current Deputy Fire Marshal position is an appointed position filled by
a Fire Captain. The Assistant Fire Marshal will be a newly created single-position classification
established at pay grade 599 and represented by the Management Employees Organization (MEO).
The position will report to the Fire Marshal. The primary responsibility will be to oversee/manage the fire
and life safety inspection programs within the Fire Prevention Division, including fire company
inspections; fire clearance, permit, state-mandated inspections; fire code implementation; the mobile
home park hydrant program; petroleum-chemical inspections; methane mitigation; and arson
investigations.
The oversight of life/safety inspection programs being performed by a non-sworn position is not unique
to the City of Huntington Beach. Several cities and the Orange County Fire Authority employ non-sworn
personnel to perform this work. The alternative to establishing a new job classification would be to
incorporate the work into an existing job class. However, in reviewing the job duties and knowledge,
skills, and abilities of comparable positions, there are none that require the specific life safety subject
matter expertise necessary to perform the work of the proposed classification.
The City and MEO have met and conferred regarding the creation of this new job and its inclusion into
the classification plan. The recommendation presented is based upon input from the Fire Department
and a review of similar internal and external jobs.
At this time, staff requests the Personnel Commission to approve staff's recommendations in
accordance with Personnel Rule 12 regarding amendments to the City's Classification Plan.
