PROPOSITION 50 LETTER OF DEMAND
STATEMENT OF ISSUE: n
I have become quite concerned about the expenditure of Proposition 50 money, a concern I
share with all who wish to have the Bolsa Chica Mesa purchased by the State. We have heard
that the Wildlife Conservation is buying Cargill, Ballona Wetlands and Ahmanson Ranch with
Proposition 50 money. The only purchase of land that is specifically spelled out in this
Proposition is Bolsa Chica and yet we have heard nothing about its purchase. I would like a
legal letter of demand for an accounting of Proposition 50 money asking:
How much money was set aside for property acquisition?
How much money has been spent?
How much money do they have remaining?
How much money is earmarked for Bolsa Chica?
I would like to get this information as soon as possible, and ask for a unanimous vote of the
Council.
RECOMMENDED ACTION: Motion to:
Direct the City Attorney to draft a letter of demand for an accounting of Proposition 50 money.

WETLANDS CONSERVANCY LETTER OF SUPPORT
STATEMENT OF ISSUE:
The Huntington Beach Wetlands Conservancy has applied for a grant from the State
Coastal Conservancy for the acquisition of 46 acres at the Huntington Beach Wetlands.
Acquisition of this property will create the potential to establish over 180 acres of
restored salt marsh and coastal dune habitat. I have been requested by the Conservancy
to send a letter of support from the City.
RECOMMENDED ACTION (motion to):
Authorize the Mayor to send a letter on behalf of the city to Mr. Paul Morabito, Chair of
the Coastal Conservancy, in support of the funding request by the Huntington Beach
Wetlands Conservancy.

Dear Mr. Morabito:
The City of Huntington Beach is pleased to lend its enthusiastic support to the
Huntington Beach Wetlands Conservancy's request for funding to acquire land to be
used for their Wetlands Restoration Project.
Funding from the grant will used to acquire 45 acres of degraded coastal salt marsh
habitat. State and local partners have been trying to acquire this property for over a
decade. Acquisition of the Huntington Beach wetlands is a key component of the
Orange Coast River Park plan. This project will create the potential to establish over
100 acres of restored salt marsh and coastal dune habitat at the Huntington Beach
wetlands.
Acquisition of the 45 acre Piccirelli Property will be added to the 37 acres previously
acquired by the Huntington Beach Wetlands Project. Seventeen acres of these have
thus far been restored.

In this period of budget crunch when personnel are being laid off and humanitarian
programs eliminated it is absolutely obscene to spend dwindling tax money to
purchase land to create a swamp just to satisfy a few self serving individuals that
contribute absolutely nothing to the greater good of our city. The Huntington Beach
wetlands conservancy begged for this land, let them raise the money without further
depletion of money that could be used for other much needed projects that would
benefit all the people of our STATE. This action is so obnoxious it is unbelievable
that an elected official would propose it.

In November, voters approved proposition 50, which includes the following language
under Chapter 1.2 Section 79572 (b)
" ... that the Wildlife Conservation Board shall give priority to the acquisition of not less
than 100 acres consisting of upland mesa areas, including wetlands therein, adjacent to
the State Ecological Reserve in the Bolsa Chica Wetlands in Orange County. "
Recommended action: to authorize the Mayor to send a letter on behalf of the city to Mr.
Bob Hight, Director of State Department of Fish and Game, urging him to direct the
Wildlife Conservation Board to move forward in the negotiations with the landowners of
the Bolsa Chica Mesa so that it may be acquired for the public good.

"Those that govern do so with the consent of the governed". Does that sound

familiar? What justification does the city council have to enter into litigation
without the consent of the people of Huntington Beach? Our new mayor, a
radical enthusiast to provide land and swamp for the birds over the building of
homes for the people is using our money to first; sue Rosalyn Lever,Register of
Voters and Scott Baugh, Orange County Superior Court Case No. 022CC14276.
(I20.80), presumably to negate the FAIR Districting Initiative that 23,000
Huntington Beach voters signed to be placed on ballot. The only plausible reason
the city council could have to take this action is their,knowledge that if the FAIR
initiative is placed on ballot it will pass,just as the anti Wal-Mart Measure I
Connie Boardman viciously supported was defeated by the majority. This is
absolute proof that Connie Boardman does not speak for the majority and is
ignoring her duties as a representative of the people for her own personal desires.
Secondly, our new mayor,probably bloated with her new post wants to send a
letter to Bob Hight,Director of State Department of Fish and game, urging him
to"direct the Wildlife Conservation Board to move forward in the negotiations
with the land owners of the Boisa Chica Mesa so it may be acquired for the public .
good." This is the first time I have heard that the birds(non-taxpayers)are part of
the public.
This lady is running amok to pursue her personal goals and should she continue
be removed from office.

The City Council has been asked to support efforts to find funding to acquire the mesa area of
the Bolsa Chica. In a previous action of Council, dated May 5, 1997,the Council unanimously
approved the following motion:
"The Huntington Beach City Council applauds the acquisition of all of the Bolsa
Chica Wedands for the benefit of future generations.
The City Council wishes to offer its congratulations to all of those who were
responsible for bringing the wetland acquisition to a successful close.
The City Council also recognizes the ecological importance of the area known as
the Bolsa Chica Mesa which is important to the Bolsa Chica Wetlands.
Should the current owners of the Bolsa Chica Mesa agree, the Huntington Beach
City Council supports preservation of the Bolsa Chica Mesa through acquisition by
direct purchase or land exchange. It is acknowledged that city funds are not
available for such a purchase."
We also recognize the importance of the Bolsa Chica Mesa as an educational resource for
millions of visitors, particularly children,who could continue to learn about its ecosystem.
Additionally,Assemblyman Harman is introducing legislation requesting an appropriation of$25
million to help acquire the Bolsa Chica Mesa. In light of these facts, I would like to make the
following motion:
MOTION:
That the City start negotiations with the landowner to purchase the Bolsa Chica Mesa
and at the same time direct staff,through the Intergovernmental Relations Committee,to
work on identifying and securing funding at the Federal, State,and local level for the
acquisition of this property.

[Added to the Main Motion: Councilmember Dettloff made
amendment to the motion to set up a series of meetings:
(1) Start with either a conference call or meeting in person with
representatives/lobbyists at both federal, state, and local
levels to examine potential sources of funding and get their
advice.
(2) The second meeting would be with Intergovernmental
Relations Committee to meet with environmental groups and
all interested parties to see how they feel about the
acquisition and what their goals are for the Bolsa Chica
Mesa.

(3) At anytime the Mayor wishes to continue, if there is a willingL
seller, meet with the seller to get input and report back to
Council with inputs from landowner.
(4) Contact Senator Barbara Boxer to be able to get the ability
for having an appraisal done.

definition and know of any obstacles present.]
