General Plan Conformance No. 91-2 is a request to determine that the vacation of an easement for public street purposes is in conformance with the General Plan. Planning Commission Action on April 2, 1991 A motion by Leipzig and second by Ortega, to deny General Plan Conformance No. 91-2 with findings passed by the following roll-call vote: AYES: Leipzig, Ortega, Newman, Richardson, Shomaker, Kirkland, Bourguinon NOES: None ABSENT: None ABSTAIN: None MOTION PASSED GENERAL INFORMATION: General Plan Conformance No. 91-2 is a request to review the proposed vacation of approximately 6, 500 square feet of a public street easement (a portion of old Lake Street, approximately 380 feet south of Pecan Avenue) for conformance with the General Plan. P10 5/85 The Government Code of the State of California, Section 65402, provides that a local agency shall not acquire real property nor dispose of any real property, nor construct a public building or structure in any county or city until the location, purpose and extent of such activity has been reported upon as to conformity with the adopted General Plan. ENVIRONMENTAL STATUS: This project is categorically exempt pursuant to Section 15312 of the California Environmental Quality Act . ANALYSIS• The property is an approximate 6, 500 square foot portion of the old Lake Street. This right-of-way area is 45 ' in width and currently serves as a driveway for a single family residence to the west . In addition, it contains public easements (gas and sewer) and is part of a fire lane that extends from Lake Street to Orange Avenue on a north-south axis to ensure proper emergency access to the Huntington Bayshore condominium project to the east. The property would be vacated to the parcel to the west for residential purposes . The property was considered recreation open space as part of an approved master development plan for the Huntington Bayshore condominium project immediately south and east of the subject property. At the time the master development plan was approved, the area of Lake Street proposed to be vacated as part of the Lake Street realignment was incorporated into the Bayshore condominium project as recreation open space. All portions have been vacated to the Bayshore project except this property. If this property is conveyed to the westerly parcel, it would be inconsistent with the master development plan. Attachment #2 shows the subject property as designated open space for the Bayshore Condominiums . The subject property has a General Plan land use designation of Mixed Development (Office/Residential) and is zoned Downtown Specific Plan, District 6 (Commercial/Office/Residential) . They are defined as follows : General Plan The mixed use category in the General Plan allows for a mix of medium to high density residential with professional office space. This can be accomplished by integrating residential and office uses within the same general area or by vertically mixing these uses within the same building. Zoning The Downtown Specific Plan, District 6, is intended to provide a location for residential, neighborhood commercial as well as office space, and public facility uses . RCA 8/19/91 -2- (9619d) The applicant has appealed General Plan Conformance No. 91-2 on the following grounds : 1. Lake Street right-of-way is not owned in fee by the City, it is a public easement that reverts to abutting property owners when the right-of-way is vacated. Staff Response Staff concurs with this statement. Lake Street right-of-way is not owned in fee by the City and would revert to the abutting property owner when vacated. 2 . When the Lake Street right-of-way was vacated, that portion abutting the Bayshore condominium project was incorporated into the project as open space, while the property in question did not revert back to owner of the adjacent single family home. Staff Response Staff concurs with this statement. The southern portion of the Lake Street right-of-way was included in the calculations for Huntington Bayshore Condominium project ' s open space when Lake Street was vacated. The portion of Lake Street in question was also intended as open space in the Master Plan for the Huntington Bayshore condominium project when the Planning Commission approved Site Plan Amendment No. 87-15 on October 20, 1987 . However, as staff ' s recent research has indicated, Final Tract Map No . 12268 for the Huntington Bayshore condominium project, recorded with the County of Orange, did not incorporate the property in question into the condominium development. 3 . That portion of Lake Street covered by this application should have been reverted to the applicant subject to the same restrictions placed on the right-of-way vacated to the Huntington Bayshore Condominiums and any other restrictions deemed within the public interest. Staff Response Should the City Council overturn the Planning Commission' s denial of General Plan Conformance No. 91-2 and approve the vacation of the remaining portion of the Lake Street right-of-way, the same restrictions, particularly a fire lane easement and public utilities easement, must be maintained. 4 . It is inappropriate to consider this property as a part of the adjacent condominium project ' s open space. RCA 8/19/91 -3- (9619d) Staff Response Since the property in question was not ultimately incorporated into the Bayshore tract map, staff concurs that it would be inappropriate to consider this portion of old Lake Street as part of the adjacent condominium project ' s open space. At the time the Huntington Bayshore condominium project was approved that portion of realigned Lake Street from Lake Street to Orange Ave. was to be vacated. The master plan for the Huntington Bayshore condominium project did incorporate all of realigned Lake Street as open space for the condominium project. SUMMARY: In summary, staff recommends that the City Council uphold the appeal and overturn the Planning Commission' s denial of General Plan Conformance No. 91-2 . Although the master plan for the Huntington Bayshore Condominiums calculated the property in question for open space, the recorded tract map did not include this portion of old Lake Street in the property. Should the City Council approve General Plan Conformance No. 91-2, the parcel must be maintained as a fire lane easement. Buildings at 410 and 320 Lake Street, in the Huntington Bayshore complex, both have exterior doors facing the fire lane and therefore depend on the fire lane for emergency personnel access. (See Attachment #3) . The entire property in question may be used for density calculations for the property to the west when it is vacated. FUNDING SOURCE: No funds required. ALTERNATIVE ACTION: The City Council may deny the appeal and uphold the Planning Commission' s denial of General Plan Conformance No. 91-2 . ATTACHMENTS: 1. Area Map 2 . Since this is a very large complex with an underground parking structure, primary foot access for emergency personnel must be taken through the exterior doors to these buildings . The exterior doors for both 410 and 320 Lake Street take access from this fire lane. It is therefore essential that this fire lane be maintained so that proper emergency access is assured. Fire Department needs for this access are best provided by a dedicated right-of-way or a recorded easement on the subject property. The Government Code of the State of California, Section 65402, provides that a local agency shall not acquire real property nor dispose of any real property, nor construct a public building or structure in any county or city until the location, purpose and extent of such activity has been reported upon as to conformity with the adopted General Plan. 3 . 0 ENVIRONMENTAL STATUS: This project is categorically exempt pursuant to Section 15312 of the California Environmental Quality Act. A-FM-23C 4 .0 DISCUSSION: The subject property is an approximate 6, 500 square foot portion of the old Lake Street. This right-of-way area is 45 ' in width and currently serves as a driveway for a single family residence to the west. In addition, it contains public easements (gas and sewer) and is part of a fire lane that extends from Lake Street to Orange Avenue on a north-south axis to ensure proper emergency access to the Huntington Bayshore condominium project to the east. The property would be vacated to the parcel to the west for residential purposes . The subject property was considered recreation open space as part of an approved master development plan (SPA 87-15) for the Huntington Bayshore condominium project immediately south and east of the subject property. At the time the master development plan was approved, the area of Lake Street proposed to be vacated as part of the Lake Street realignment was incorporated into the Bayshore condominium project as recreation open space. All portions have been vacated to the Bayshore project except this property. If this property is conveyed to the westerly parcel, it would be inconsistent with the master development plan. The subject property has a General Plan land use designation of Mixed Development (Office/Residential) and is zoned Downtown Specific Plan, District 6 (Commercial/Office/Residential) . They are defined as follows : Land Use The mixed use category of Office/Residential is to allow for a mix of medium to high density residential with professional office space. This can be accomplished by integrating residential and office uses within the same general area or by vertically mixing these uses within the same building. Limited ancillary retail commercial and service uses are also conditionally allowed; however, the emphasis is on the office/residential mix. In the Downtown, intensified residential uses would provide housing close to employment and add support for planned general and visitor commercial . The offices would provide work opportunities and services to the residential community. Zoning The Downtown Specific Plan, District 6, is intended to provide a location for residential, neighborhood commercial as well as office space, and public facility uses . Since the subject property currently has the public utility easements, is used for fire lane purposes, and is considered recreation open space as part of the Bayshore master development plan, conveyance of the subject property to the westerly property would not conform with the General Plan. Staff Report - 4/2/91 -2- (9063d) 5 . 0 RECOMMENDATION: Staff recommends that the Planning Commission deny General Plan Conformance No. 91-2 pursuant to Section 65402 of the California Government Code with the following suggested findings for denial : SUGGESTED FINDINGS FOR DENIAL: 1. General Plan Conformance No. 91-2, requesting a portion of old Lake Street, north of Atlanta Avenue, to be vacated to the parcel to the west for residential purposes, would be inconsistent with the General Plan based upon the following policies : a.
