HomeMy WebLinkAboutHOUSING ELEMENT AMENDMENT 84-1 to General Plan - Negative D RESOLUTION NO. 5405 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ADOPTING HOUSING ELEMENT AMEND- MENT NO. 84-1 TO CITY'S GENERAL PLAN WHEREAS, the City Council of the City of Huntington Beach desires to update . and refine the General Plan in keeping with changing community needs and objectives ; and A public hearing on adoption of Housing Element Amendment No. 84-1 to the General Plan was held by the Planning Commission on June 5, 1984 , and its Resolution No. 1323 rec- ommending adoption to the City Council was passed on June 19, 1984 ; and California Government Code section 65586 requires that the city conform its Housing Element to meet the provisions of Title 7, Division 1, Chapter 3, Article 10. 6, commencing with sections 65580 et seq. by July 1, 1984 ; and The City Council, after giving notice as prescribed by law, held at least one public hearing to consider said Housing Element Amendment No. 84-1; and At said hearing all persons desiring to be heard on such amendment were heard, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach, pursuant to Title 7 , Division 1, Chapter 3, Article 6 of the California Government Code, com- mencing -with section 65350, that Housing Element Amendment No. 84-1 to the city' s General Plan is hereby adopted. The City adopted the present housing element in November of 1979 in conformance with the 1977 guidelines promulgated by the California Department of Housing and Community Development. Since that time, the guidelines were adopted by the legislature and made a part of the Government Code. Other requirements to be addressed in housing elements were also incorporated into the Government Code. Housing Element Amendment No. 84-1 would revise and update the City' s Housing Element and bring it into conformance with the current requirements. RECOMMENDATION : Adopt Negative Declaration No. 84-17 and the attached resolution approving Housing Element Amendment No. 84- 1. One goal in revising the Housing Element was to update the statistical information with 1980 census data and the new RHAM data from SCAG. In addition, recent changes in the Government Code require that several new sections be added to the Housing Element addressing housing in the coastal zone, energy conservation opportunities, and an evaluation of the adequacy of the previous element including an assessment of how well the City implemented its goals. When the 1977 HC D housing element guidelines became part of the Government Code, the requirements were made more stringent than they had been in the guidelines, so some portions of the element also had to be strengthened . This revision of the Housing Element incorporates the policies adopted by the City Council in October of 1983 as part of the comprehensive housing strategy recommended by the Housing Committee and the Planning Commission. The revised element also references the report of the City Council-appointed Joint Housing Study Committee that was issued in November of 1982. All wording changes and new wording in the draft Housing Element have been underlined for ease of review. New or revised tables or charts are indicated. Where entire sections or chapters are new, they are so marked if they are not underlined. A number of new policies relating to energy conservation have been added for your consideration. These *tie in with the new chapter on energy conservation, and were adapted from Huntington Beach Energy Series Report No. 5, Energy Conservation Initiatives in Local Building and Land Use Policies, printed in March 1982 by the Department of Development Services. Programs and policies from the 1979 Housing Element which the City is no longer pursuing or which have not proven feasible to undertake have been eliminated. One such program was the possible utilization of inclusionary zoning within the City. Investigation since 1979 has shown inclusionary zoning would not be an appropriate means of increasing affordable housing in Huntington Beach at present. Density bonuses, however, are being used very -2- 6-20-84 - RCA successfully in the City. Section 8 .2, Adequate Provision, has been modified to reflect this fact. The Planning Commission recommended that the changes as indicated in the attached addendum, be incorporated into the final document. ENVIRONMENTAL STATUS: Tentative Negative Declaration No. 84-17 has been advertised and posted for ten days as required by CEQA. No comments have been received on Negative Declaration No. 84-17. The negative declaration should be approved prior to approval of Housing Element Amendment No. 84-1. FUNDING SOURCE : None needed. ALTERNATIVE ACTIONS: 1. Do not adopt the attached resolution approving Housing Element Amendment No. 84-1. In this case, the General Plan would not be in compliance with the Government Code. 2. Modify Housing Element Amendment 84-1 as desired by Council. Box 190 Huntington Beach, CA 92648 Honorable Council Members: Members of the Board of REALTORS Government and Political Affairs Committee have re- viewed the proposed Housing Element Amendment which will be considered as Item D-2b on your agenda this evening, and we would like to offer the following comments for your consideration. First of all, we appreciate the concern expressed in the Housing Element Amendment for the provision of housing within the City of Huntington Beach. We share that concern. Our members felt that the section on Housing Problems and Needs clearly acknowledged this need. We were particularly impressed with the section on Housing Constraints, and appreciated and agreed with the statements regarding the role that local government can play in decreasing housing costs through more reasonable development standards, lessening of regulations, fast track permit processing, land cost write downs, tax exempt bond financing, density bonuses, etc. 5.2 Retrofitting: While we certainly understand and can support energy conservation, we strongly oppose development of an ordinance to require energy retrofit at time of resale. We believe that energy conservation should be encouraged, but to impose new standards upon already constructed residences simply because of sale or property im- provement is unfair and a violation of private property rights. (The possibility of such action is noted on page 44, section 5.2 and again under Policies, page 75, section 8.6.1.) 8.5 Preserving Affordability: As you know, we support the conversion of apartment units to ownership condominiums. Therefore, we are concerned that the statements in sections 8.5.1 and 8.5.2.2 which state a policy to "Regulate the conversion of existing apart- ment units to condominiums to minimize the impact of such conversion on the supply of low and moderate income rental housing." While rental housing serves a valid purpose in the availability of housing, we believe that provision of affordable ownership housing is a worthy goal. We believe that conversion of apartment,iunits can provide an excellent source of affordable owner- ship units, and we believe that permitting conversions will have a beneficial effect upon the housing stock available in our community, and will provide the opportunity for home ownership to renters who wish to purchase a residence in Huntington Beach and could not otherwise afford to do so. Somehow, the statements in this section appeared to favor rental vs. ownership housing. 8.2 Adequate Provision: This section addresses a number of policies which could assist in' the provision of housing opportunities. We note, however, that there is no state ment relative to condominium conversions, and we would like to suggest that a policy ,statement referring to encouragement of condo conversions might be appropriate. In addition, all of the statements regarding housing refer to NEW construction. We would suggest that you give some consideration to the availability of resale housing to meet the housing needs of residents in this community.
