Commission on October 21; 1980, and approved for recom- mendation to the City Council ; and Thereafter, the City Council, after giving notice as pre- scribed by Government .Code §65355, held at least one public hearing to consider said Open Space and Conservation Element Amendment No. 80-1; and At said hearing before the City Council all persons desiring to be heard on said amendment were heard, NOW; THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach, pursuant to provisions of Title 7, Chapter 3 , Article 6 of the California Government Code , com- mencing with §65350, that Open Space and Conservation Element Amendment No. 80-1 . to the General Plan, consisting of the follow- ing changes is hereby adopted : 1. The following neighborhood parks are hereby added: (a) Trinidad Beach Park (b) French Park (c) Prince Park (d) Gibbs Park Site (e) Carr Park 2 . Services DATE: December 9, 1980 SUBJECT: OPEN SPACE AND CONSERVATION ELEMENT AMENDMENT 80-1 AND ENVIRONMENTAL IMPACT REPORT 80.-4 At the November 17, 1980 meeting, the City Council opened the public hearing on Amendment 80-1 to the *Open Space and Conservation Element of the General Plan and Environmental Impact Report 80-4. The Council accepted testimony on proposed changes to the system of .neighborhood parks, including the addition, relocation, and deletion of a number of park sites. A straw vote was then taken, approving the park site changes as recommended by the Planning Commission. The primary amend- ment request, which involved the proposed expansion of Huntington ( � Central Park to Ellis Avenue, was deleted from Amendment 80-1 by the U Planning Commission, but was appealed to the City Council for recon- sideration on November 17. The proposed elimination of two neighbor- hood park sites located near the intersection of Goidenwest Street Dana Palm Avenue were also deleted by. the Planning Commission and ap- pealed to the City Council. The hearing on,.these items was opened and -continued to December, 15, 1980. At the December 15 meeting, the City Council should first continue to take testimony and close the public hearing on Area 2.1, the Huntington Central Park expansion. The Department. of Development Services recommends that the Council sustain the appeal on the Central- Park expansion only for the 65.3 acres located north of Ellis Avenue between Edwards Street and Sully Miller Lake. The 10 acre industrial site north of Ellis Avenue and west of Gothard. Street is recommended by the Planning Staff to be excluded from the recreation area designation. The City Council should next receive additional testimony and close the public hearing on Area 2.2. 10, the Goldenwest/Palm neighborhood park sites. The Department of Development Services recommends that the Council sustain the appeal on these park sites. After taking action on the appealed items, the Council should accept additional public testimony on the neighborhood park site changes recommended by the Planning Commission and then close .the hearing on Open Space and Conservation Element Amendment 80-1. The Council should first approve Environmental Impact Report 80-4, and then adopt Amendment 80-1 by Resolution 4935, incorporating actions on appeals. and straw votes on Planning Commission recommendations. Item D-la on your agenda is' a public hearing on Amendment 80-1 as recommended by the Planning Commission, which was opened on November 3, 1980 and continued to this meeting. Item D-2a is a public hearing on an appeal of the Planning Commission' s action of October 21, 1980 to delete areas of concern 2.1 and 2. 2.10 from Amendment 80-1. At the November 10 agenda review meeting, it was suggested that due to the number of public hearings scheduled for the November 17 meeting, these two hearings be opened and continued to the December 1, 1980 regular meeting without taking public testimony; the RCA includes a recommendation to continue the hearings. If, however, the Council desires to act .on these two items this evening, the following procedure is recommended. to facilitate the taking of public testimony and acting on Amendment 80-1 to the Open Space and Conservation Element. 1. Open public hearing D-la and take testimony only on those proposed neighborhood park additions, relocations, and deletions recommended by the Planning Commission. 2. After closing. the public .heari.ng ;.on these areas of concern, straw votes should be taken to approve or -deny the Planning Commission recommendations for each park„proposed -to be added, relocated, or deleted, beginning, with Trinidad Beach Park (2.2.1b) through Peterson School Site (2.2,9) . • 3. The amendment includes one primary area of concern; a request by the City Council to relocate the boundary of Huntington -Central Park to Ellis Avenue and thereby increase the ultimate size of the park by 75 acres. Several, miscellaneous changes involving the addition, relocation.;: and deletion of a number of neighborhood parks are also addressed. A public hearing on Amendment 80-1 was held before the Planning Com- mission on October 21, 1980, at which time the Planning Commission deleted the primary area of concern from the amendment. The Commission also voted not to add Conrad Park to the Open Space and (Conservation Element, and to retain two park sites generally located at the inter- section of Goldenwest Street and Palm Avenue which had been recommended for deletion from the Element by staff. The Planning Commission ap- proved staff ' s recommendations on the remaining miscellaneous park additions, relocations, and deletions. On October 30, 1980, an appeal was filed with the City Clerk concerning the Planning Commission' s deletion from the Amendment of areas of concern 2.1 (Huntington Central Park expansion) and 2. 2.10 (neighborhood park sites at Golden- west-and Palm) . Open Space and Conservation Element Amendment 80-1 was previously advertised and the City Council public hearing was opened on November 3, 1980. Page Three ENVIRONMENTAL STATUS: The potential environmental impacts associated with the amendment requests are analyzed in the amendment document which also serves as EIR 80-4. Draft EIR 80-4 was posted for a 45-day review period ending October 11, 1980. All comments have been incorporated with staff responses into the appendix of the report to constitute Final EIR 80-4. FUNDING SOURCE: None required. ALTERNATIVES• The City Council may adopt the requested amendments as recommended by staff or by the Planning Commission, modify the recommendations as desired, or retain the existing Open Space and Conservation Element. GENERAL PLAN AMENDMENT - OPEN SPACE AND CONSERVATION ELEMENT NO. 80-1/ENVIRONMENTAL IMPACT REPORT NO. 80-4 Amendment to permit expansion of Huntington Central Park by approximately 75 acres and various amendments to neighborhood park system, -consisting of the following: A. 40 acres located north of Ellis Avenue between Edwards and Goldenwest Streets. B. 25. 3 acres located north of Ellis Avenue and east of Golden- west Street. C. 10 acres located north of Ellis Avenue and west of Gothard Street. Add designations for: Conrad, Trinidad Beach, French, Prince, Gibbs, and Carr Parks . Planner Bill Holman made a presentation of the areas and issues contained in the -draft amendment. Commissioner Bannister questioned the effect this redesignation might have on property values in the area and how .property owners could be recompensed. Legal counsel Jim Georges informed the Commission that amending the General Plan does not give rise to a cause of action for in- verse condemnation.. In response to Mr. Bannister ' s inquiry as to whether or not the redesignation would make it more difficult for a property owner to develop his land, Mr. Georges noted that an owner could file a request under existing zoning; however, it would in all likelihood be denied for lack of conformance with the amended General Plana The public hearing was opened. An unidentified man addressed the Commission to request that this amendment not be approved until a specific plan has been adopted for the area and property owners have been negotiated with. J.T. Hudson, 818 14th Street also opposed the amendment, stat- ing that the City has too much parkland already. -13- 10-21-80 - P.C. N!inutes, H.B. Plannin( :)mmission. October 21, 1980 Page. 14 A.C. Marion, owner of some of the property in question, cited what he called a long history of inaction by the City and urged that some decision be arrived at. David Dahl, representing Pacific American Oil Company, asked that the City not take this kind of action unless. and 'until it is ready to pay for the additional park acquisition. Gary. Turman also spoke against the redesignation. Avery Eaton, 17524 Santa Paula Circle, Fountain Valley,. said that he owns eight lots in the area and is not against the expansion of the park if .the City is willing to pay a fair market value for the properties. Mr. Eaton added that it would be his intent to file a court action in the event that this land is bought for a park and later on developed as something else, however. Ray Hendron, 8859 Rhine River, Fountain Valley, spoke against the addition to the park, but .if the redesignation is approved the City should be prepared to pay full market price for it at its present value . Peter Laimbeer, 3704 West Camille, Santa Ana, noted that there is a great discrepancy in the prices being obtained for property directly across the street from some of the affected properties. He also questioned the addition to Central Park when the City is eliminating small parks from its plans for lack of funds. Richard Meyer, 13191 Newland, Garden Grove, opposed the addition to the park. Virginia Gross asked for a fair return on her investment in the area Two other unidentified persons also spoke to object to the taking of their properties for the park, questioning the added maintenance costs to the City which would result and the fairness of delayed compensation. There were no other persons to address the Commission, and the public hearing was closed. In the discussion among staff and the Commission which followed, Secretary Palin explained the .requirement that any land which is to be acquired. by the expenditure of recreation and parks funds must first be designated as a park site, and Commissioner Winchell pointed out that the reason this amendment is before the Commission is that the City Council directed that the redesignation be done. The desirability of adding to the park was discussed, and the general consensus of the Commission was that land should only be acquired if there were a real need for additional park acreage, not just a "want" on someone' s part, and that, "need" has not been demonstrated. The Commission also discussed the suggested additions, relocations, and deletions suggested by staff for certain neighborhood parks in the City, and staff explained the proposed action in each case. -14- 10-21-80 - P.C. Minutes, H.B. P1 ping Commission October 21, 1980 Page 15 Staff asked that Conrad Park be taken . off the list of parks to be added, as it is maintained by a private homeonwers ' associa- tion. The Commission asked that the designation for the quarter section southeast of Brookhurst and Garfield remain flexible so that either the Edison right-of-way or Lamb School could be con- ' sidered as a neighborhood park site. Commissioner Schumacher asked that the proposed deletion of the park sites at Goldenwest and Palm Avenue not be included in Amendment 80-1. Richard Harlow, representing the Huntington Beach Company, addressed the Commission .to urge that both these sites be deleted from the General Plan, saying that the City has no interest in pursuing either of the sites. Commissioner Schumacher, however, suggested that these parcels might possibly be useful in. the future as a basis for a trade-off for another location; the Commission con- curred with this approach. Commissioner Bauer expressed the hope that any transmittal to the City Council would include the rationale of the Commission in its action on the amendment; i .e. , the feelirig that the land can be acquired if the City is willing and able to buy it now, the question of whether or not the City should be entering into the type of private enterprise proposed for the park, and is there a real need for more area in Central Park, or just a desire on someone' s part to increase the size of the park. The Commission determined to make no changes to the areas out- lined in the draft resolution (the 40 acre .area north of Ellis Avenue between Edwards Street and Goldenwest Street and the 25. 3 acre area located north of Ellis Avenue east of Goldenwest Street). Specific note was made that the 10 acre, site at north of Ellis Avenue west of Gothard Street was not to be redesig- nated to open space; this was done even though that particular area had not been included in the draft resolution prepared -for this amendment. The following specific actions are appealed: 1 . Deletion of three areas totalling approximately 75.3 gross acres F��t- located north of Ellis Avenue between Edwards and Gothard Streets from consideration for designation as a recreation area in the �"� . Open Space and Conservation Element. 2. Removal of the two neighborhood park sites located at the inter- section of Goldenwest Street and Palm Avenue fVom the list of undeveloped park sites proposed to be deleted from the Open Space and Conservation Element. 3 . Deletion of the 10-acre area located at the northwest of Ellis Avenue and Gothard Street, which was proposed to be redesignated b��„� o from industrial to open space in the Land Use Element. REASON FOR APPEAL: On August 13, 1979, the City Council held a study session to discuss the cost and revenue factors associated with the City' s park, system. After projecting operating and maintenance costs over the next ten years, staff concluded that the City could -not adequately maintain the entire system of 50 parks totalling 400 acres with existing funding sources. The City Council directed the Community Services Department to consider alternative development plans for 15 neighborhood park sites and to prepare a list of parks recommended for deletion from the program. Alternative funding sources for park maintenance were discussed, in- eluding a proposal to expand the boundaries of Central Park in order to incorporate revenue producing activities. The City Council agreed in concept with a plan to divide Central Park into th-ree areas designated for- passive, non-revenue-producing active, and revenue-producing active uses and activities. This concept was to be used as the .basis for pre- paring a schematic master plan for Central Park. On January 21, 1980, a joint study session was held with the City Council and Community Services Commission, at which time the schematic master plan was reviewed and conceptually approved. On March 3, 1980, the City Council adopted Resolution 4853, expanding the park boundary to Ellis Avenue for the purpose of conducting planning and feasibility studies, and directing the Department of Development Services to initiate an amendment to the Open Space and Conservation Element to reflect the new boundary. Page Two s' On June 1, 1979, the City applied to the State Department of Parks and Recreation for a Land and Water Conservation Grant of $1 . 2 million for the acquisition of the 8 . 9-net acre site at the northwest corner of' Ellis and Gothard for a recreational vehicle camping facility. On December 28, 1979,. the City received notification from the State that $609, 600 had been approved for the proposed acquisition. The proposed amendments to the Land Use and the Open Space and Conser- vation Elements are necessary to allow the incorporation of revenue producing uses and activities into Central Park to provide an ongoing source of revenue for park maintenance, and to allow further refine- ment of the master plan for Central Park. Additionally, the proposed general plan amendments for the property at Ellis and Gothard must be adopted in order to allow the City to apply the State grant toward acquiring this property for the RV camping facility in keeping with the overall community recreational needs and goals as stated in the General Plan. This proposed amendment would forthwith depress the value of this property , making it near valueless , and in effect , fore- close its future . sale or further development , resulting in a near " taking " by the city . It would thus impose a serious hardship on this long term property owner . Therefore , on behalf of Mr. Hudson , I respectfully urge that this proposal be defeated .
