Issues pertaining to land use compatibility and appropriate land use designations were previously analyzed as part of the 1996 General Plan update. The zoning map amendment would correct the inconsistency between the General Plan and zoning designations for these properties that was created as a result of the comprehensive update. The Planning Commission approved the request and is recommending approval because this action would bring the zoning of the properties into conformance with the General Plan and would not have any negative impacts on the existing uses. Funding Source: Not applicable. PROJECT PROPOSAL: Applicant: City of Huntington Beach, 2000 Main Street, Huntington Beach, CA 92648 Location: Seven locations throughout the City of Huntington Beach (see page 3 for addresses). Zoning Map Amendment No. 99-4 represents a request by the City of Huntington Beach to rezone seven areas with current zoning designations of RMH (Medium High Density Residential), RH (High Density Residential), IG (General Industrial), IL (Limited Industrial) or CO (Office Commercial). These areas will be rezoned to: RM (Medium Density Residential), RMP (Residential Manufactured Home Park), CG (General Commercial), or IG (Industrial General) in order to bring the subject areas into conformance with the City's General Plan designations pursuant to Section 247.02 of the Huntington Beach Zoning and Subdivision Ordinance (ZSO). The subject sites are summarized below. Additional information for each site and individual vicinity maps are provided in Attachment No. 3. BACKGROUND California State law (Government Code Section 65300) requires that each City prepare and adopt a comprehensive, long-term General Plan for its future development. This plan shall contain seven required elements, including land use, circulation, housing, conservation, open space, noise and safety. State law also requires that each city's daily decisions follow logically from and be consistent with the General Plan policies and goals. The General Plan includes a Land Use Map that delineates land uses such as residential, commercial, industrial and open space. PL00-24 -3- 4/13/00 9:12 PM REQUEST FOR ACTION MEETING DATE: May 1, 2000 DEPARTMENT ID NUMBER: PL00-24 In the early 1990s, the City initiated a comprehensive update of its General Plan. The new General Plan was adopted by the City Council on May 13, 1996 and created a vision for development within the City. An objective of the update was to amend the Land Use Map to reconcile certain inconsistencies between land use designations and existing uses. Examples of such conditions of use and general plan inconsistency that were reconciled through the GPA include re-designating: a. Commercial or retail businesses denoted as Residential b. Low or Medium Density Residential uses denoted as High Density Residential C. Places of religious assembly denoted as Residential, Commercial, or Industrial As part of this effort the City Council redesignated 97 areas throughout the city. In 17 of these areas (160 parcels), this action created inconsistencies between the General Plan land use designation and zoning district designations. The City Council directed staff to complete Zoning Map Amendments to reconcile any differences between the zoning and General Plan designations. Following this direction, the seven sites proposed with this Zoning Map Amendment represent the second group of sites before the City Council. Staff will present additional groups of sites to the Planning Commission and City Council for review in the near future. These future sites include commercial properties along Beach Boulevard, in addition to other residential and industrial properties throughout the City. C. PLANNING COMMISSION MEETING AND RECOMMENDATION: On February 23, 2000 the Planning Commission held a public hearing on the subject request. There were no persons to speak during the public hearing. The Planning Commissioners agreed to pull subarea A and take a straw vote on subareas B-G. The straw vote approving the change for these subareas passed 6-0. The Planning Commission then discussed subarea A and the relationship of this corner property to the industrial corridor along Gothard and the Edinger Corridor Specific Plan concept. The Planning Commission then voted to approve the zoning map amendment for all seven properties. D. STAFF ANALYSIS AND RECOMMENDATION: During the process of updating the General Plan, the potential impacts of placing a different General Plan land use designation on the subject properties were analyzed. The land use changes were considered by the General Plan Advisory Committee, the Planning Commission and the City Council. These groups considered compatibility of surrounding land uses, traffic impacts, and public health and safety in their recommendations and ultimate approval. Zoning Map Amendment No. 99-4 is a follow-up to that 1996 action in order to bring the properties into conformance with the General Plan. As such, issues related to compatibility, PL00-24 -4- 4/13/00 9:12 PM REQUEST FOR ACTION MEETING DATE: May 1, 2000 DEPARTMENT ID NUMBER: PL00-24 traffic, etc. were analyzed previously in EIR No. 94-1. There have been no significant changes in land use or development in the immediate vicinity of any of the properties that would nullify that previous analysis or the current General Plan designations. By bringing the zoning into compliance with the General Plan, Zoning Map Amendment No. 99-4 helps to fulfill the City's goals for these sites. For Sub-area A the goal is to continue to improve the commercial viability of the Edinger Corridor. In the case of Sub-areas B and D, the redesignations provide more flexibility for future development. For Sub-areas C, E and F, the proposed zoning designations reflect what is on the ground as well as what is desired long-term. Finally, in the case of Sub-area G, the redesignation indicates the intensity of development desired by the City in the event that the existing property is redeveloped. Attachment No. 3 describes the subject properties in detail. A letter describing the proposed action was sent to all 28 property owners of the affected properties on November 17, 1999. No phone calls or correspondence were received in response to that notification. In response to the public hearing notice for the Planning Commission meeting, the property owner of the existing nonconforming residential use in Sub-area D inquired as to the ramifications of the proposed action. He expressed some concern about allowing greater flexibility for future development because he lives in the area. Staff believes that the proposed request is consistent with City Council direction as a result of the 1996 General Plan update. Staff recommends the City Council approve Zoning Map Amendment No. 99-4 for the following reasons: Zoning Map Amendment No. 99-4 will bring the properties into conformance with the existing General Plan designations. The proposed project will not have any adverse environmental impacts. Zoning Map Amendment No. 99-4 is within the scope of the previously certified EIR 94-1 for the comprehensive General Plan update. The proposed project sites are consistent with the goals and objectives of the City's General Plan which encourage the development of residential, commercial and industrial uses. Zoning Map Amendment No. 99-4 to change the zoning at seven specific locations from Medium-High and High Density Residential, General Industrial, Limited Industrial and Office Commercial to General Commercial, General Industrial, Medium Density Residential, and Residential Manufactured Home Park is consistent with the objectives, policies, general land uses and programs specified in the General Plan and any applicable specific plan. The subject locations have General Plan designations of Commercial Regional, Commercial General, Residential Low Density with a Residential Mobile Home Park Overlay, Residential Medium Density, and Industrial. The Zoning Map Amendment would bring the zoning into conformance with the General Plan. This action is consistent with objectives and policies of the General Plan because it supports existing uses in the city which serve Huntington Beach residents. 2. In the case of a general land use provision, the zoning map amendment is compatible with the uses authorized in, and the standards prescribed for, the zoning district for which it is proposed. This amendment would change the land use designation rather than a general land use provision. Future development will be compatible with the development standards. 3. A community need is demonstrated for the change proposed. The new zoning will permit the proposed facilities to continue and provide services which have been offered to residents in the vicinity. It will also ensure development that is compatible with the surrounding land uses. 4. Its adoption will be in conformity with public convenience, general welfare and good zoning practice. The sites are presently designated on the General Plan; the proposed rezoning action will bring each site into conformity with the current General Plan designation. STATEMENT OF ISSUE: On May 13, 1996 the City Council adopted General Plan Amendment (GPA)No. 94-2. GPA No. 94-2 was a city initiated comprehensive update to the City's General Plan. As part of the update, the Land Use Element and Map were modified. Land use designations for 97 areas were changed to fulfill City goals and policies. As a result of the GPA reclassification, numerous properties now have zoning designations that are not consistent with their General Plan designations. Zoning Map Amendment No. 99-4 represents the second in a series of amendments that are being proposed by staff to correct these inconsistencies. Specifically, Zoning Map Amendment No. 99-4 proposes to rezone seven areas (see Sub Areas A-G, on page 3) currently used for a variety of land uses. Issues pertaining to land use compatibility were previously analyzed as part of the General Plan, and the proposed designations were deemed to be compatible with the surrounding areas. BACKGROUND: California State law (Government Code Section 65300) requires that each City prepare and adopt a comprehensive, long-term General Plan for its future development. This plan shall contain seven required elements, including land use, circulation, housing, conservation, open space, noise and safety. State law also requires that each city's daily decisions follow logically from and be consistent with the General Plan policies and goals. The General Plan includes a Land Use Map that delineates land uses such as residential, commercial, industrial and open space. In the early 1990s, the City initiated a comprehensive update of its General Plan. The new General Plan was adopted by the City Council on May 13, 1996 and created a vision for development within the City. An objective of the update was to amend the Land Use Map to reconcile certain inconsistencies between land use designations and existing uses. Examples of such conditions of use and general plan inconsistency that were reconciled through the GPA include re-designating: a. Commercial or retail businesses denoted as Residential b. Low or Medium Density Residential uses denoted as High Density Residential C. Places of religious assembly denoted as Residential, Commercial, or Industrial As part of this effort the City Council redesignated 97 areas throughout the city. In 17 of these areas (160 parcels), this action created inconsistencies between the General Plan land use designation and zoning district designations. The City Council directed staff to complete Zoning Map Amendments to reconcile any differences between the zoning and General Plan designations. Following this direction, the seven sites proposed with this Zoning Map Amendment represent the second group of sites before the Planning Commission. Staff will present additional groups of sites to the Commission and City Council for review in the near future. These future sites include commercial properties along Beach Boulevard, in addition to other residential and industrial properties throughout the City. Staff Report—2/23/2000 2 (OOsr16) PROJECT PROPOSAL: Zoning Map Amendment No. 99-4 represents a request by the City of Huntington Beach to rezone seven areas with current zoning designations of RMH (Medium High Density Residential), RH (High Density Residential), IG(General Industrial), IL (Limited Industrial) or CO (Office Commercial). The proposed designations allow for the currently existing uses, as well as facilitate development for those sites which are currently vacant. By changing the zoning on each property, each property will be in conformance with the General Plan. Environmental Status: In accordance with the California Environmental Quality Act, a previous Environmental Impact Report (EIR No. 94-1) was prepared and certified by the City Council on May 13, 1996, for preparation of the City's comprehensive General Plan Amendment. This EIR analyzed all potential impacts and provided mitigation measures sufficient to mitigate any potential impacts to a level of insignificance. The process being followed for Zoning Map Amendment No. 99-4 (A-G) has been determined to be within the scope of the previously certified EIR No. 94-1, therefore, no additional environmental review is required. Coastal Status: Not applicable. Redevelopment Status: Not applicable. Design Review Board: Not applicable. Subdivision Committee: Not applicable. Other Departments Concerns: There are no concerns from City Departments. Public Notification: Legal notice was published in the Huntington Beach/Fountain Valley Independent on February 10, 2000, and notices were sent to property owners of record within a 300 ft. radius of the subject properties and to interested parties. ANALYSIS: During the process of updating the General Plan, the potential impacts of placing a different General Plan land use designation on the subject properties were analyzed. The land use changes were considered by the General Plan Advisory Committee, the Planning Commission and the City Council. These groups considered compatibility of surrounding land uses, traffic impacts, and public health and safety in their recommendations and ultimate approval. Staff Report—2/23/2000 4 (OOsr16) Zoning Map Amendment No. 99-4 is a follow-up to that 1996 action in order to bring the properties into conformance with the General Plan. As such, issues related to compatibility, traffic, etc. were analyzed previously in EIR No. 94-1. There have been no significant changes in land use or development in the immediate vicinity of any of the properties that would nullify that previous analysis or the current General Plan designations. By bringing the zoning into compliance with the General Plan, Zoning Map Amendment No. 99-4 helps to fulfill the City's goals for these sites. For Sub-area A the goal is to continue to improve the commercial viability of the Edinger Corridor. In the case of Sub-areas B and D, the redesignations provide more flexibility for future development. For Sub-areas C, E and F, the proposed zoning designations reflect what is on the ground as well as what is desired long-term. Finally, in the case of Sub-area G, the redesignation indicates the intensity of development desired by the City in the event that the existing property is redeveloped. Attachment No. 2 describes the subject properties in detail. A letter describing the proposed action was sent to all 28 property owners of the affected properties on November 17, 1999. No phone calls or correspondence were received in response to that notification. In response to the public hearing notice, one of the property owners had called as of February 15, 2000. The property owner of the existing nonconforming residential use in Sub-area D inquired as to the ramifications of the proposed action. He expressed some concern about allowing greater flexibility for future development because he lives in the area. Staff believes that the proposed request is consistent with City Council direction as a result of the 1996 General Plan update. LXTI & Comm\A 0-t oN� �� BACKGROUND • On May 13, 1996, City Council approved a comprehensive update of the City's General Plan. • The update created inconsistencies between General Plan land use designations and zoning district designations. • Purpose of this request is to bring zoning of the seven subject properties into conformance with existing General Plan designations. ANALYSIS • During the process of updating the City's General Plan, the proposed land use designations were evaluated. The following criteria were utilized: • Surrounding land uses. • Traffic impacts. • Public Health and Safety. • Staff notified the property owners of the proposed action in a letter dated November 17, 1999. 2 RECOMMENDATION • On February 23, 2000, the Planning Commission approved Zoning Map Amendment No. 99-4. • Staff and Planning Commission recommend the City Council approve Zoning Map Amendment No. 99-4 and adopt Ordinance Nos. 3460 - 3466 because: • Consistent with the General Plan designation. • Eliminates a zoning nonconformity and facilitates improvements. • Brings the properties into conformance with the General Plan.
