K Yes [ ] New Policy or Exception q 3 s Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF ISSUE: Transmitted for your consideration is the Bolsa Chica Regional Park General Development Plan (GDP) and Environmental Impact Report (EIR No. 521) . Prepared by the County of Orange Department of Harbors, Beaches and Parks in a coordinated effort with the City and the Bolsa Chica Regional Park Citizens Advisory Committee, the GDP and EIR presents the development concept and development phasing plan for the Bolsa Chica Regional Park and analyzes the environmental impacts associated with the plan, respectively. The County of Orange is requesting that the City Council make a recommendation to the Board of Supervisors on certification of Environmental Impact Report No. 521, and approval of the Bolsa Chica Regional Park including the park boundary and GDP with the formal interpretive center facility. The County is also requesting that the City defer it' s Coastal Development Permit processing authority to the Coastal Commission. RECOMMENDATION: Planning Commission Recommendation: Motion to: A. "Recommend to the Board of Supervisors certification of Environmental Impact Report No. 521 and approval in concept of , the Bolsa Chica Regional Park including the park boundary and General Development Plan with the formal interpretive center facility subject to the following stipulations: • Prior to any construction of the park, the County shall submit to the City of Huntington Beach Planning Commission for review and approval a detailed design plan showing proposed landscape materials (native and non-native) , layout of picnic facilities and parking lots, and the footprint, height, bulk, size and ` operating program for any interpretive center. PIO 5/85 P • The interpretive center facility should be limited to park related uses. Ancillary uses, such as proposed office uses, should not be included. • Bicycle, pedestrian and equestrian trail systems should be designed to provide three separate trails. Joint bicycle/pedestrian trail systems should be avoided. • Efforts to expand the park boundary should be continued. • On street parking on Seapoint Street should not be removed until necessary. • Bike lanes should be provided on both sides of Seapoint Street, if possible, to provide an alternative bicycle route for higher speed bicycle traffic. B. Defer Coastal Development Permit processing authority to the California Coastal Commission. Staff Recommendation: Motion to: "Approve the Planning Commission's recommendation with the exception of the restriction on ancillary uses in the interpretive center facility." ANALYSIS: The County of Orange Department of Harbors, Beaches and Parks, in a coordinated effort with the City of Huntington Beach and the Bolsa Chica Regional Park Citizens Advisory Committee, has prepared a General Development Plan (GDP) and Environmental Impact Report (EIR) for the Bolsa Chica Regional Park. The proposed GDP presents the ultimate development concept and development phasing for the 106 acre park site and is intended to serve as a guide for future detailed park plans. The GDP emphasizes low intensity recreational uses. Proposed park facilities include a continuous pedestrian/bike trail connection to planned City trails from Huntington Beach Central Park to existing County trails along Pacific Coast Highway; an equestrian trail connecting to planned city equestrian trails from the equestrian center at Huntington Beach Central Park; a small, static interpretive area including an option for an interpretive center building facility, vista points, picnic and play areas and approximately 15 acres of Environmentally Sensitive Habitat Areas (ESHAs) which may be displaced by development that may be allowed within the larger Bolsa Chica Local Coastal Plan segment area. RCA 10/19/92 -2- (4519d) f The County has submitted the GDP and EIR to the City of Huntington Beach for review and is requesting approval in concept of the following specific items: 1) Certification of Environmental Impact Report No. 521 (EIR No. 521) ; 2) The Bolsa Chica Regional Park including the park boundary, the General Development Plan, and the Formal Interpretive Center Facility; and 3) A recommendation on the deferral of Coastal Development Permit processing authority to the Coastal Commission. Project Description The Bolsa Chica Regional Park consists of a passive park facility which is intended to serve the area by providing a connection between the local and regional recreational facilities between Huntington Central Park and the Bolsa Chica Beach. The park will be a regional park and by definition is intended to be utilized by residents of the Orange County area. The proposed park site consists of 106 gross acres, primarily situated on the blufftop of the Huntington Beach mesa, and located within the jurisdictions of both the City of Huntington Beach and County of Orange; approximately 40 acres of the park site are located in the City of Huntington Beach. The proposed park boundary extends northerly from Pacific Coast Highway to approximately Talbert Avenue and has predominantly been finalized by development agreements and alignments of approved plans for the surrounding areas. The park site's westerly boundary is the five (5) foot contour above mean sea level and is adjacent to the Bolsa Chica wetlands. The park site's easterly boundary has been set by the alignments of Edwards Street and Seapoint Avenue, the Holly-Seacliff Specific Plan boundary, and Tract 14135 (Surfcrest) . The proposed park boundary is consistent with the conceptual boundary previously approved by the City of Huntington Beach City Council and maintains the minimum 106 acre size with a minimum 71 acres of useable area as recommended by Council. General Development Plan The GDP presents the development concept plan for the Bolsa Chica Regional Park by establishing the types of facilities which are considered consistent with the passive nature of the park and by identifying the general areas in which the facilities would be located. (The GDP does not identify precise location, design, and materials to be used in facilities provided in the areas. Precise design will be determined at the time of development and will be reviewed by the Regional Park Citizens Advisory Committee at that time. ) The park site is located in an area of natural, scenic, cultural and ecological resources. The proposed facilities and elements have been selected and located with the intent of maximizing opportunities for public enjoyment in a manner consistent with the enhancement and preservation of these resources. RCA 10/19/92 -3- (4519d) The primary park activity areas are located in the bluff top areas. The lowland and bluff face areas are primarily devoted to Environmentally Sensitive Habitat Areas (ESHA'S) and buffer areas. Proposed park elements and facilities are described below. It should be noted that the GDP represents the outcome of a 15 year coordinated park planning effort between the City of Huntington Beach and the County of Orange. The proposed uses and park character reflected in the GDP have been developed through regularly held meetings with the Regional Park Citizens Advisory Committee (CAC) which is comprised of the County of Orange, City of Huntington Beach, local community groups, private landowners and interested citizens. The GDP was reviewed and unanimously approved by the regional park CAC at their August 19, 1992 meeting. However, some park elements, as proposed, did raise concern with some members of the public. These park features have been identified with astericks and a discussion of the associated concern has been provided following the features description. 1. Bike/Pedestrian Trail* - The proposed bike/pedestrian trail is intended to provide a connection between local and regional trail facilities and to provide a continuous trail system from Huntington Central Park to the Bolsa Chica Beach trails. The joint bike/pedestrian trail is an approximately 1. 6 mile concrete trail continuing the full length of the park and located along the blufftop edge to take advantage of open vistas of the Bolsa Chica Wetlands and the ocean. The trail is intended to link vista points, the interpretive area and other park facilities ; additional pedestrian paths will also be provided to provide pedestrian circulation routes between points of access and other park facilities. Required bike/pedestrian roadway crossings (Talbert/Edwards, proposed Garfield Extension, and Pacific Coast Highway) will occur "at-grade" at controlled intersections. The proposed bike/pedestrian trail is a single trail which may create the potential for pedestrian and bicyclist conflicts. In addition, the bike/pedestrian trail roadway crossings are at grade. Although all are located at controlled intersections, some of the crossings, especially at Pacific Coast Highway and at the proposed Garfield Avenue extension are in areas which are anticipated to experience high levels of high speed traffic which may create a hazardous situation for trail users. The concerns associated with the bike/pedestrian trail are related to the specific designs of the trail and the trail-roadway crossings. The specific designs of the bike/pedestrian trail feature will be addressed during the detailed design stage. At that stage, the trail system will be brought back before the Regional Park CAC and incorporation of trail separations or safe crossing designs will be analyzed. RCA 10/19/92 -4- (4519d) 2. Equestrian Trail - The proposed equestrian trail is intended to provide a linkage to a planned equestrian trail from the Huntington Beach Equestrian Center. The regional park equestrian trail will be a ten-foot wide trail which begins at Ellis Avenue and runs southward along the bottom of the bluff to Garfield, where the trail alignment moves to the bluff top edge, westerly of the joint bike/pedestrian trail (the two trails will be separated by grade separation, dense vegetation and a split rail fence to prevent conflict between equestrian trail and bike/pedestrian trail users) . The equestrian trail continues southward to approximately 1, 100 feet north of Pacific Coast Highway where the trail loops around an "equestrian rest area" which includes benches, water faucets/troughs, hitching posts and restroom access. The trail does not provide access to Pacific Coast Highway or the beach. The required roadway crossing points are proposed to be an "at-grade" equestrian crossing at Ellis Avenue which will be a controlled crossing designed to equestrian standards and a "below-grade" crossing at the Garfield extension. The Garfield crossing can be relocated to an "at-grade" crossing if the Garfield extension is not constructed. 3 . Overlooks/Vista Points/Informal Interpretive Area - Overlooks/vista points are proposed at several locations along the bluff edge to provide both scenic viewing opportunities of the coastal areas to the northwest and nature interpretation of ESHA and wetland habitats. The overlook/vista points will also provide "rest stops" for bike/pedestrian trail users and are anticipated to include bench seating areas, interpretive exhibits, and directional signage where appropriate. 4 . Open Meadow Areas - The proposed open meadow areas consist of open turf areas suitable for low intensity recreational activities such as frisbee throwing or kite flying. The areas will not include any formal field equipment and will have a rolling topography to discourage organized recreational activity such as soccer or softball games. Meadow areas are located away from residential uses and will be surrounded by shrubs and trees. 5. Adventure Play Areas - The intent of the adventure plan areas is to provide facilities where children can climb and play without adversely impacting trees and fencing. Play equipment will be natural color and constructed of concrete, wood, etc. , to conform with the character of the park. Adventure play areas are generally located adjacent to open meadow and picnic areas. 6 . Picnic Areas* - Picnic areas are areas with single tables or groups of a maximum of four (4) tables and are generally located adjacent to open meadow and adventure play areas. Tables will be located to maximize open view opportunities of the wetlands and oceans. RCA 10/19/92 -5- (4519d) The residents of the Seacliff Estates have expressed opposition to the proposed general location of the two (2) picnic areas located in the vicinity of the Estates entrance and have requested that these areas be removed or relocated. These picnic areas are located at one of the widest usable areas of the park in an open area expected to be between 550-600 feet in width. As previously discussed, the GDP is a general plan and is not intended to identify the specific locations or design of park equipment and features within the park. These issues will be addressed during the detailed design stage. 7. Parking Areas* - Two (2) - 40 space pocket parking areas are proposed for the park. Located along Seapoint and Edwards Street, in areas where on-street parking will be prohibited, the pocket parking lots were distributed to facilitate vehicle access throughout the length of the park. On-street parking will be utilized along the internal tract street north of Garfield Avenue. In order to minimize conflicts, the GDP proposed to prohibit on-street parking on Seapoint and Edwards and proposes to provide 40 space parking lots on each of the arterials adjacent to the park. In addition, on-street parking for approximately 46 vehicles will be provided on the internal collector street, adjoining the park (north of Garfield Avenue) . This provides a total of 126 spaces. The environmental impact report projects that the park will generate approximately 106 average daily trips which translates to a parking requirement of approximately 53 parking spaces. 8. Optional Interpretive Center* - An optional feature of the regional park plan includes a 10,000 square foot interpretive center facility centrally located within the park at the existing oil facility site. The facility is planned to incorporate several components designed to facilitate a comprehensive and functional public service facility by providing group/visitor display areas (local history, oil use, geology, etc. ) , Ranger areas, meeting room(s) , office areas, restrooms, storage/lab area, public transit drop-off area, and a 50 space off-street parking lot. The conceptual design for the center incorporates grade-adaptive design techniques so as to minimize aesthetic impacts upon users within the park as well as minimizing view impacts from Seapoint Avenue and surrounding residential areas. The interpretive center has been located to take advantage of wetland vistas and access. In the event that plans for the formal interpretive center are implemented, the informal interpretive area (as previously described) would be redesigned as a park vista point. RCA 10/19/92 -6- (4519d) The Seacliff Estates residents expressed concerns over the visual and traffic circulation impacts (on their tract entrance) associated with the proposed "Optional Interpretive Center" . In response to their concerns, the County relocated the facility to the location of the existing gas plant and re-oriented the accessway to align with the existing gas plant facility access road. This locates the facility at a lower elevation so that views of the interpretive center from the Estates would consist of approximately four (4) to six (6) feet of the facility and roof line. The parking lot will be entirely screened from view. Additional concerns have been expressed that the proposed Interpretive Center Facility will increase activity at the park and is not compatible with the low intensity nature of the park. The EIR for the GDP analyzed the inclusion of the optional Interpretive Center Facility as one of the project alternatives. The EIR indicated that although the facility will increase the level of activity on the site, the environmental impacts associated with the use would not be substantially different from those resulting from park development without the facility. For instance, traffic generation by the Interpretive Center is projected to be approximately 200 trips per day resulting in a maximum total trip generation of 306 total trips per day for the entire park. The total projected trip generation will be less than 1% of the peak hour traffic in the area and is not considered significant. In addition, the uses proposed in the Interpretive Center Facility, are directly related to the preservation and enhancement of the area's resources and are intended to maximize opportunities for providing public enjoyment and education about the natural, scenic, cultural and ecological value of the area. If approved, the facility will be financed through private parties; no City or County funding will be involved. The Planning Commission is requested to make a recommendation on the inclusion or deletion of the formal Interpretive Center Facility as part of the park development plan. 9 . General Facilities - Five (5) restroom facilities with drinking fountains, trash containers and other general facility items are located at various locations throughout the park. These facilities are proposed to be located along the park' s trail system for park use convenience. RCA 10/19/92 -7- (4519d) 10. Security Fencing and Lighting - Security fencing, consisting of an un-obtrusive black vinyl chain link fence and shrub vegetation, is proposed at a variety of areas within the park for both public safety purposes and to discourage park users from entering areas unsuitable for human activity. Because the regional park is designed as a daytime use facility, park lighting requirements will be limited primarily to security lighting. Twelve-foot high vandal resistant lighting fixtures on concrete poles are proposed to illuminate parking areas, bike/pedestrian trials, the interpretive area, restrooms and roadway crossings. In addition, all proposed parking facilities will be gated and locked to prevent use when the park facilities are closed. 11. Park Entry Features/Graphic Displays - These consist of park signage and special landscape treatments and will be located at park entry areas. The entry features are intended to maximize park identification by providing a stronger image and major design statement for the park. Development Phasing Plan The majority of the site is currently used for oil and gas production activities, and on-site facilities include oil wells and storage facilities, a natural gas treatment facility, above- and under-ground pipelines, and a wastewater evaporation pond. Because the availability of much of the land for park development is dependent upon the expiration of leasehold and the removal of existing oil and gas production uses, a phased implementation plan for the park was developed. This plan basically consists of a three (3) phase development, including an interim plan for lands most immediately available for park use, and overall development plan for the entire park site. Phase I The Phase I area is located adjacent to Seapoint Avenue between the Shell Oil facility in the southernmost portion of the site and the existing gas treatment plant and is currently the most readily accessible area within the park. Development of this phase will require minimal grading and the removal and relocation of nine (9) existing above-ground pipeline facilities. Numerous oil production facilities also occur on this parcel under lease agreement with Signal Bolsa Corporation and the Huntington Beach Company. These facilities will also require removal and site clean-up prior to park development. RCA 10/19/92 -8- (4519d) Phase II The Phase II area is located both adjacent to Seapoint Avenue south of Garfield Avenue and all park areas north of Garfield Avenue adjacent to planned residential areas of the Holly-Seacliff Specific Plan area and areas adjacent to Edwards Street. Development of this parcel will establish regional park linkages with the planned local trail system extending from the Huntington Beach Central Park. Completion of this phase is tied to the estimated 1994 scheduled removal of the existing gas treatment plant facility operated by Shell Oil and to entitlement for future development of adjoining residential areas. Implementation of this phase requires removal and clean-up of existing oil facilities and some grading work. No completion date is proposed. Phase III Phase III is located in the southern most portion of the site, adjacent to Pacific Coast Highway. Currently this area is under intense oil development activity conducted by Shell Oil Company. Shell estimates that some oil extraction activity will continue to occur in this location for another 30 years. Prior to park dedication of this area the removal and clean-up of existing oil facilities will occur. During the interim, bike/pedestrian trail connections to Pacific Coast Highway will be available in front of the Surfcrest project once the Seapoint Avenue extension has been constructed. ENVIRONMENTAL STATUS: In accordance with the California Environmental Quality Act, Environmental Impact Report No. 521 (EIR No. 521) was prepared by the County of Orange to analyze the potential impacts of the project. The requisite procedure that was followed is outlined below: December 20, 1989 The County of Orange Environmental Management Agency conducted an initial study and determined that an EIR would be necessary for the project. January 20, 1990 A Notice of Preparation was filed with the State Clearinghouse and distributed to the City of Huntington Beach and other interested/responsible parties to notify them of intent to prepare an EIR. RCA 10/19/92 -9- (4519d) February 19, 1992 Notice of Completion filed with the State Clearinghouse. Draft EIR available for public review and comment for fifty days (Comment period: February 19, 1992 to April 8, 1992) . September 15, 1992 Public hearing before City of Huntington Beach Planning Commission to recommend Certification of EIR No. 521. September 16, 1992 Public hearing before Orange County Planning Commission to Certify EIR No. 521. The County of Orange has responded to all comments received, and has been included in the Final EIR (See Attachment No. 7) . Environmental Impact Report No. 521 was prepared by PBR consultants for the County of Orange. The environmental impact report discusses potential adverse impacts in the areas of land use, traffic/circulation, air quality, acoustic environment, landform/hydrology, cultural biological resource, public services and utilities, health and safety and aesthetics. The direct, indirect and cumulative impacts of the proposal are addressed, as are the impacts of project alternatives. Through the use of appropriate mitigation measures identified in the EIR, the majority of the potentially adverse impacts associated with the project can be mitigated to a level of insignificance. There are, however, some adverse environmental impacts anticipated from the proposed project that cannot be completely eliminated through mitigation measures. These include impacts from water service and cultural resources associated with the project, and both project-specific and cumulative impacts to air quality. These effects can be lessened by mitigation measures suggested in the environmental impact report, but can not be mitigated to a level of insignificance and will require a Statement of Overriding Considerations by the County of Orange. DEFERRAL OF COASTAL DEVELOPMENT PERMIT PROCESSING AUTHORITY: The park site is located within the certified area of the City's Local Coastal Program and is subject to Coastal Development Permit approval by the City of Huntington Beach. Subsequent to approval by the Board of Supervisors, projects of this nature, which are located in both the City and Coastal Commission's jurisdiction, are typically brought back before both the Planning Commission and Coastal Commission separately for Coastal Development Permit approval. RCA 10/19/92 -10- (4519d) The County is requesting that the entire project be reviewed and acted upon by the Coastal Commission to expedite processing and to avoid duplication of efforts by the City and the Coastal Commission. The County of Orange is therefore requesting that the Planning Commission recommend to the City Council that the City relinquish Coastal Development Permit processing authority for the Bolsa Chica Regional Park EIR and GDP to the Coastal Commission. This request applies only to approval of the Coastal Development Permit for the GDP. The proposed park would remain subject to all other City regulations. The Planning Commission is recommending deferral of Coastal Development Permit processing to the Coastal Commission based upon public testimony received at the hearings. Although the Planning Commission received comments from several parties at the September 1 and 15, 1992 meetings, testimony related to the park development plan was predominantly associated with the precise design of park facilities. As previously indicated, these issues will be addressed during the specific design stage at which time the specific detailed plans will be brought back before the Bolsa Chica Regional Park Citizen's Advisory Committee for approval. As such, the Commission expressed general approval and satisfaction with the plan, and did not consider it necessary that the General Development Plan to be brought back to the City for Coastal Development Permit approval. Applicability of Measure C In addition, the Planning Commission has requested a legal opinion on the applicability of Measure C to the proposed interpretive center facility. The City Attorney' s Office has determined that the interpretive center is not subject to Measure C and will not require voter approval. The City Attorney' s office has indicated that although Measure C requires a vote of the people prior to the transfer of parkland or the construction of any structure costing more than $10,000, the State constitution forbids laws which impair the obligations of contracts. Therefore, since the City's obligation to acquire and transfer parklands to the County, pursuant to the 1979 agreement, predates Measure C, the measure does not apply to the City' s conveyance of parkland to the County for Bolsa Chica Regional Park development. Once title to the parkland is vested in the county, Measure C does not apply as a restriction on buildings or structures. Therefore, since construction of the interpretive center will occur after the parkland has been transferred to the County, Measure C does not apply. A copy of the City Attorney's opinion has be provided as Attachment No. 8. RCA 10/19/92 -11- (4519d) In summary, the Bolsa Chica Regional Park GDP will provide a beneficial expansion of recreational amenities in the area and will maximize opportunities for public enjoyment of the natural, scenic, and cultural resources of the area. The plan will allow for a continuous bike/pedestrian trail system from Huntington Central Park to the Pacific Ocean as well as an extension of the equestrian trail system. In addition, the plan provides a combination of low intensity park uses, which with inclusion of the formal Interpretive Center Facility, will provide for public use and enjoyment of the area in a manner consisted with the preservation and enhancement of the area ' s resources. ALTERNATIVE ACTION: The City Council may take one of the following actions: A. Recommend to the County Board of Supervisors certification of Environmental Impact Report No. 521; and B. Recommend to the Board of Supervisors approval of the Bolsa Chica Regional Park including the park boundary, the General Development Plan. C. Defer Coastal Development Permit processing authority to the Coastal Commission by adopting resolution no. FUNDING SOURCE: Funding and Maintenance As previously mentioned, the project site is located in both the City of Huntington Beach and County of Orange. However, based upon An agreement between the City and the County, the City will dedicate the park property within the jurisdiction to the County for park development. Pursuant to that agreement the park will be a County facility. The County will be responsible for funding, construction, operation and maintenance of the park and the City will provide emergency service (Fire and Police) in the park. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Huntington Beach recommends certification of Environmental Impact Report No. 521 and approval in concept of the Boundary as established by the General Development Plan with the Formal Interpretive Center as shown in Exhibit A; and the following additional directions: - Prior to any construction of the park, the County shall submit to the City of Huntington Beach Planning Commission for approval a detailed design plan showing proposed landscape materials (native and non-native) , layout of 10/6/92:364 : sg -2- picnic facilities and parking lots, and the footprint, height, bulk, size and operating program for any interpretive center. Bicycle, pedestrian and equestrian trail systems should be designed to provide three separate trails. Joint bicycle/pedestrian trial systems should be avoided. - Efforts to expand the park boundary should be continued. On street parking on Seapoint Street should not be removed until necessary as deemed necessary by traffic standards. Bike lanes should be provided on both sides of Seapoint Street, if possible, to provide an alternative bicycle route for higher speed bicycle traffic. ANSWER: No. ANALYSIS: The Bolsa Chica Regional Park is a proposed 106 acre park facility, located in both the city and unincorporated county land. An agreement made on November 27, 1979, between the city and the county requires dedication of land to the county for regional park purposes. Measure C (Charter S 612) requires a vote of the people before any parkland may be transferred and before any building over 3000 square feet or any structure costing more than $10,000 may be built. The plans for the regional park include construction of an interpretive center building facility. The agreement with the county vests the county with the role to "develop, operate and maintain" the linear park and facilities. The city's obligations include the acquisition and transfer of title of parklands to the county. Measure C was added to the charter on December 7, 1990. The obligation to acquire and transfer parklands to the county predates Measure C. The Constitution forbids laws which impair the obligations of contracts. (Calif. Const. , Art. I, Sec. 9) Therefore, Measure C does not apply as a limitation on the right or duty of the city to convey parklands to the county for the regional park under the 1979 agreement. I would like to reiterate my recommendation to modify the revised plan in order to incorporate the existing fresh water marsh within the gully into the plans for the Regional Park. I was involved in similar deliberations 4 years ago involving a small fresh water wetland at the bottom of Cliff Drive Park in Newport Beach. This wetland was proposed to be covered up by a parking lot. This wetland, even smaller than the one in the Linear Park, was considered to be very important to the science faculty of Newport Harbor High School, who sent a letter to the Mayor of Newport Beach, advising that this area be protected (letter of January 29, 1988 enclosed) . Thankfully, the proposed parking lot was dropped and the wetland still serves its useful functions. The fresh water marsh in the gully also serves to filter and cleanse the water, laden with fertilizers, etc. ; from the golf course, before it reaches the Bolsa Chica.wetlands. I hope that you will vote to retain the gully and the wetland, perhaps heeding the recommendations to grade the slope to 3 : 1 and plant cottonwoods and willows in order to allay safety fears and increase habitat values , as stated in the enclosed letter from Pacific Southwest Biological Services, Inc. dated 15 August 1991 (enclosed) . This natural wetland would be severely damaged by any alteration of the landscape . The uniqueness of a natural wetland within our city has long been recognized as a valuable natural resource. For that reason alone. It is prudent to protect this area in any way possible. The channel has a total of about 025 arse of willoow and freshwatcr marsh habitat. Enclosed is a map of the various vegetation types. TMe freshwater marsh vegetation is either Typha-cat-tail stands or Euthamia-goldenrod stands. The willows are arroyo willows (Salix Imiolepis). The freshwater-adapted vegetation in-the channel appears to be there because of runoff from the off-site residential development to the south. The vegetation in the channel does not appear to be too old, perhaps S to 10 years or so. I can see that the freshwater lens is allowing the expansion of the Typha-freshwater marsh vegetation into the salt pan and coastal salt marsh vegetation north of the oil pipeline patrol road. This situation will continue so long as this water source persists. With the water-wasteful vegetation and turf on the off-site residential development site to the south, I can see no diminution of the water flow. From a biological habitat quality standpoint,the presence of the freshwater marsh and willow vegetation adds a very useful source-of habitat diversity at the site. I believe that the steep banks of the channel should be graded back to 3 to 1 slopes where possible and additional willows and perhaps cottonwoods planted to increase the channel's wildlife habitat value. Should portions of the channel require filling in conjunction with development of the park(as indicated on the refined Park Plan), provisions for maintaining the current water flow--via underground pipe--should be included in the plan and additional wetland habitat should be established at the base of the drainage channel to mitigate any habitat loss including but not limited to additional willow and cottonwood plantings. The wetland area that currently exists now on the Huntington Mesa needs to be preserved as it represents a functioning ecosytem. It is not necessary to fill in this wetland and plant grass. The Koll Company wishes to reiterate its support for the Regional Park. As you are aware, the Regional Park is included within the Coalition Plan for Bolsa Chica which is supported by the Koll Company. However, the staff report does raise the following issues which require comment from Koll: 1. Paragraph 2 of a letter from Mary Murray of County/EMA Harbor, Beaches and Parks states that the Koll Company's "land will be dedicated in conjunction with a development agreement on the Bolsa Chica development project, but is not tied to the number of units approved in their project." This statement is misleading in two respects: a. While the Koll Company anticipates applying for a development agreement for its project, the terms of such an agreement have not yet been fully addressed with staff or approved by the City Council. It is considerably premature for anyone to state what the specific terms of a possible development agreement will be. b. The Koll Company's willingness to dedicate land for the Regional Park always has been dependent on the approval by the City of a feasible development plan for the project which is satisfactory to Koll. We question the legal propriety of recommending certification of the County's EIR for the Regional Park when it does not address the same alternatives as the City's own Draft EIS/EIR for the same site which is presently distributed for public review. Further, because the Regional Park is the subject of the City's Bolsa Chica project Draft EIS/EIR, it appears that the County's EIR may create an improper "segmentation" of the project in violation of CEQA. 3. The Staff Report does not point out that, due to potential mitigation requirements, Koll will not be able to dedicate its portion of the Regional Park until after the completion of its full local, state, and federal entitlement process for its Bolsa Chica project. Koll remains supportive of the Bolsa Chica Regional Park plan and, subject to approval of its development proposals, maintains its commitment to dedicate land toward completion of the park in the normal course of the entitlements process. I am speaking to you tonight as a Board member of the Bolsa Chica Conservancy. I am here tonight to speak in favor of the plan before you. The Bolsa Chica Conservancy urges you to adopt this concept plan for the Linear Park as it is - with the Interpretive Center included as both the County and the City staffs are recommending. For background information - The Conservancy was formed in 1990 and it is a non- political, non-profit organization dedicated to wetlands research and education at Bolsa Chica. The 11 member volunteer Board of Directors is a blend of private and public interests with members representing the County of Orange, The City of Huntington Beach, a citizen's group, the Amigos de Bolsa Chica, the major landowner, the Bolsa Chica Properties, managed by the Koll Company, the State Lands Commission, and the California Department of Fish & Game. We have a part time Administrative Coordinator and around 60 Trustees and a host of local citizens in our Volunteer Scientist Program. My comments will mainly be about the Interpretive Center. As you have heard, the size range studied in the EIR for the Center was from 5,000 ft. to a maximum of 10,000 feet. Personally, in my earlier dreams I had envisioned an educational center similar to the magnificent one at the Chula Vista Wetlands -----or the extensive one at Cabrillo Beach - But no, our group agreed to a more modest size for a center. To acquaint you with sizes, and these Council Chambers are about 4500 ft, B6, 7 & 8 combined with the lobby are around 4500 ft. The community building at Murdy Park is in excess of 11,000 ft. The existing gas plant building across Seapoint which is much closer to the resident's homes, then the proposed Center would ever be is between 25,000 ft. and 30,000 feet. It looms much larger than the proposed Center even at its maximum size of 10,OOOft. which would have a very low profile and be landscaped. There are no existing blue prints for the Interpretive Center, it is yet to be funded and it is yet to be designed. This planning body will have its input on that design when final plans are submitted to the city. As for the exact site, you have heard from Fish & Game that they too prefer this location and would not permit a structure, no matter how nobel the purpose, to be built in the wetlands. The Conservancy site committee went through an elaborate screening process to select this location. Goals and criteria for an educational center were objectively developed and 11 sites were examined. This location was the most desirable and realistic. The main objections of the adjacent homeowners were addressed by the County and an additional $10,000 of planning funds were spent to move the location, recess the building into the slope and relocate the parking area. The Interpretive Center in the park has many benefits. This valuable facility will have • minimal financial cost to the City, yet it will reinforce the efforts of our Tourist and Convention Bureau's outreach to visitor's who will want to stay in Huntington Beach to experience the beaches and the Bolsa Chica Wetlands. Obviously, such a nature center in the Regional County Park would be an asset which would be utilized by our local schools, Scout groups and other youth organizations. It would be a tremendous benefit N ' to the educational system at a time when education is being eroded because of.financial constraints. The use of the site would naturally be controlled by a limited amount daylight hours of operation which we would want to work out to everyone's satisfaction* At the last session one of the homeowners referred to the Nature Center as a monument. At first I was offended, but in reconsidering the label, 1 will have to agree with Mr. Stillman. It will be a monument. But not a monument to any individual or to any group, but a monument to our precious remaining 9% of California's wetlands. It will be a monument to the rich history of Huntington Beach from its Indians to the Rancheos to the early oil pioneering and the farming days. It will be a monument to public education for our youngsters, the universities and the general public, and it will be a monument to the perseverance and dedication of the many individuals and diverse groups who have been involved in the nearly two decades of planning of the Linear Park. Should the response to the recommended park land acquisition proposal discussed at the meeting be negative, may I recommend that the City of Huntington Beach and/)r County of Orange open negotiations with the owner of the property affected by the fault zone discussed above to determine the • feasibility of dedication and/or purchase of the lands, both within and without the fault zone, for the Bolsa Chica Regional Park. As we indicated, it would he of benefit to use the $1.5 million allocated in Prop. 71) for the purchase of land for the Bolsa Chica Regional Park while the plans are being circulated for comments and approval. If acquisition could he secured quickly, it may he possible that this area could be one of the first areas developed because grading has been on Suing and the division of land between different owners is less a concern at this location. We appreciated the opportunity to be included in the discussion about a park we have worked lung and hard to bring about. We would be willing to mccl to discuss additional details ol' such a land acquisition proposal. We feel that there are positive elements for the public as well as the land owner.
