STATEMENT OF ISSUE•
The Government Code of the State of California, Section 65402,
provides that a local agency shall not acquire real property nor
dispose of any real property, nor construct a public building or
structure in any County or City until the location, purpose and
extent of such activity has been reported upon as to conformity with
the adopted General Plan.
General Plan Conformance No. 89-11 is a request by the
Administrative Services Department to review for conformity with the
General Plan, the conveyance of property from the County to the City
for park and recreation purposes . The property encompasses
approximately 11. 86 acres and is on the west side of Gothard
approximately 640 feet south of Talbert Avenue and is commonly
referred to as the Orange County Transfer Station (APN 111-071-35 &
37)
General Plan Conformance No. 89-11 was reviewed and denied by
Planning Commission on December 5, 1989 . It was subsequently
appealed by Councilman John Erskine.
RECOMMENDATION•
Planning Commission Recommendation:

Staff Recommendation:
Overturn the Planning Commission' s decision and approve General Plan
Conformance No. 89-11 with the following findings based upon
elements and policies of the General Plan.
Findings for Approval:
The acceptance of the conveyance of the transfer station parcel
would help to:
1. Maximize the outdoor and environmental potential of the City
by providing comprehensive, coordinated recreation, parks and
open space programs that fulfill the needs of all segments of
the community (Open Space and Conservation Element) .
2 . Find alternative methods of providing parks if park fees are
inadequate or non-existent (Recreation Element) .
3 . Acquire land for parks, open space and recreation prior to
land development (Recreation Element) .
4 . Provide additional community facilities within Huntington
Central Park to help satisfy the deficiency in community park
space (Recreation Element) .
5 . Capitalize on the outdoor and environmental potential of the
City by acquiring land for parks, open space, and recreation
prior to land development, where possible (Land Use Element) .
6 . Site new City buildings and facilities in areas where existing
and planned land uses are compatible with the facility that is
being proposed (Community Facilities) .
7. Promote the provision of adequate community facilities within
the City of Huntington Beach (Community Facilities) .
8 . Locate industrial uses adjacent to compatible land uses (Land
Use Element) . This may include a hazardous waste facility
pursuant to a Conditional Use Permit .
ANALYSIS•
This item was originally submitted to the Planning Commission on
November 21, 1989 . At that meeting the Planning Commission
continued the item with direction to staff to: 1) clarify land use
designations and possible uses for the site; 2) include findings to
indicate the possibility of using the subject parcel as a hazardous
materials site pursuant to the Tanner Act (AB 2948) ; and 3) discuss
what plans and possible uses for the site have been acted upon by
the City Council .

Land Use•
The subject parcel is currently zoned M1-CD (Light Industrial-Civic
District) and has a General Industrial land use designation. The
General Plan land use designation is defined as :
General Industry: Most industry that is considered desirable
and compatible with the residential character of Huntington
Beach is commonly known as "light industry" . Light industry
produces minimum emissions of smoke, dust, fumes, vibration
and noise.
Article 953 of the Huntington Beach Ordinance Code lists permitted
uses for M1 zones . A copy of this list is included as an
attachment, as well as a list of Unclassified Uses pursuant to
Article 963 . Unclassified uses are activities that are permitted
within the M1 zone subject to conditional use permit approval.
Hazardous Waste:
The Tanner Act (AB 2948) authorized local governments to develop
comprehensive county hazardous waste management plans . As a result
the Orange County Hazardous Waste Management Plan was developed.
The plan was adopted by the City Council on May 1, 1989, after
having been approved by the County. The plan establishes siting
criteria for various types of Offsite Hazardous Waste Facilities so
as not to create significant risks or cause adverse impacts to the
health and safety of populations in surrounding public and private
areas . The criteria are as follows:
Must be a minimum of 2, 000 feet from residences .
Must be a minimum of 200 feet from active earthquake
faults .
Should not be within flood hazard areas, including dam
inundation areas (100 year floodplain) .
Shall not be within areas prone to slope failure,
subsidence or liquefaction.
Shall be prohibited in areas restricted due to present
or designated land use (State and regional parks,
national forest, military installations, prime
agricultural lands, designated open space) unless
necessary to handle hazardous wastes generated by
workers, residents or visitors in these areas .
Prohibited in areas of high ground water.
The City recently evaluated a proposal for a toxic waste facility on
the subject site. The facility was determined to be a significant
risk based upon many of the above criteria . The site is within 500
feet of a mobile home park of primarily senior citizens and is
almost directly on top of the Bolsa Fairview fault. A copy of the

rejection letter is attached. Zoning and land use designations
would permit a hazardous waste facility at that location through the
approval of a Conditional Use Permit for an Unclassified Use.
However, this type of facility would be evaluated for compatibility
with surrounding uses and whether or not a significant risk would be
posed based upon the County siting criteria.
Plans for the Site
On October 2, 1989, the City Council reviewed the acquisition of the
Orange County Transfer Station as part of an overall plan to
increase the amount of open space within the City. The City Council
approved the following actions:
(1) Authorized the Mayor to make an offer to the Orange County
Board of Supervisors to acquire title to the 12-acre County
Transfer Station site on Gothard Street in exchange for the
City accepting maintenance responsibilities for the County
Linear Park after it is developed.
(2) Authorized staff to negotiate an agreement with the State of
California to acquire title to 2 .3 miles of State lands from
the municipal pier to the end of the bluffs between Pacific
Coast Highway and the mean low tide line in exchange for
providing the State Parks and Recreation Department up to
three acres to develop a maintenance and operation facility on
the Transfer Station site.
(3) Approved the concept of relocating the police shooting range
to the transfer station site.
A copy of the request for City Council action, the study session
minutes and regular session minutes are attached.
With the approved concept in mind the following elements would apply
to finding the proposed conveyance in conformance with the General
Plan.
Land Use Element:
The proposed maintenance facility and police shooting range would
conform with the existing General Industrial land use designation.
Both the maintenance facility and the shooting range would require a
Conditional Use Permit to be approved by the Planning Commission at
a later date.
Recreation Element:
The proposed conveyance would help to facilitate the expansion of
park and recreation areas in Huntington Beach as well as provide for
maintenance facilities for recreational lands .
Community Facilities Element :
Both the police shooting range as well as the beach maintenance
facility could be considered necessary and essential community
facilities which are permitted by the General Plan.

Qpen Space and Conservation Element:
The acceptance of this parcel would help to preserve the
environmental amenities which embody the quality of life in
Huntington Beach.
FUNDING SOURCE
Not applicable.
This action is solely to find that the acceptance of the property
would be in conformance with the General Plan. Approval of the
transfer of title including identifying the funding source will be
done at a later time.
ALTERNATIVE ACTION:
Uphold Planning Commission' s denial of General Plan Conformance No.
89-11.

2 0 GENERAL INFORMATION:
The Government Code of the State of California, Section 65402,

The County of Orange is proposing to convey property currently owned
by the County to the City. The County originally acquired the 9 .42
acre parcel (A.P. #111-071-35) and the adjoining 2 . 26 acre parcel
(A..P. #111-071-37) for use as the Orange County Transfer Station. The
site has been inactive for a number of years .
The Department of Administrative Services proposes to accept the
conveyance of the subject parcel which is currently zoned M1-CD (Light
Industrial-Civic District) and lies within the ultimate boundary of
the Huntington Central Park. The 11 . 68 acres would facilitate future
plans for Huntington Central Park, such as relocation of the police
pistol range or other park uses .
3 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approve General Plan
Conformance No . 89-11 pursuant to Section 65402 of the Government Code
of the State of California, with the following findings :

for park purposes (Item A-2) . He feels the transaction will
create a "financial Jonas" that the future homeowners will
have to swallow. He feels the land swap is being initiated to
speed up downtown development and urged the Commission to take
a closer look at the acquisition. He recommended that the
City urge the County to maintain the park and suggested an
estimate be prepared on the maintenance and the cost that will
be spent on the linear park over the years .
Paul Weatherly, 7622 Talbert Avenue, urged the Commission to
approve his extension of time request (Item D-1) .

SUBJECT: PROPOSED TOXIC WASTE FACILITY
Dear Mr. Cook:
Thank you for your inquiry concerning the installation of a toxic waste facility at the site
of the former Refuse Transfer Station #2. The information you submitted was circulated
to several departments for comments. The comments focused on five issues.
1. In the past the City has entered into discussions to obtain the subject property
with the intent to expand the recreational opportunities of Central Park to the
north and the new mobile home park immediately adjacent on the west. These
discussions are on—going.
2. . Information indicates this piece of property was previously a County landfill
site, and may require study and mitigation prior to its development. Also,
unless already completed by the County, the State's "Calderon" legislation (AB
3525) requires additional air emission and.water quality assessments to be
performed.
3. The technological process described in the proposal apparently has not received
full EPA and State Department of Health Services Approvals.
4. The proposed site is in very close proximity to the Bolsa—Fairview and
Newport—Inglewood earthquake faults. Recent maps show the Bolsa—Fairview
fault crossing Gothard at Ellis, placing the proposed facility almost directly on
top of it.
5. The "Orange County Hazardous Waste Management:Plan", adopted by the City
Council in May, 1989, was drafted in accordance with State requirements for
our area. This plan sets forth in detail the management of hazardous wastes for
all of Orange County, including a prioritized list of management options. The
primary focus of this plan is to eliminate as much of the waste stream as
possible, followed by processes to recycle, neutralized, incinerate, and as a

last resort, entomb and store the waste. Detailed requirements for waste
management facilities, aqueous treatment facilities, transfer and temporary
storage,facilities, liquid organics recovery facilities, solidification facilities,
incineration facilities, and residuals repositories are set forth in great detail.
Legal requirements for permanent storage of hazardous waste require
monitoring of the materials and tracking of ownership and responsibility for the
life of the hazardous materials. The County plan calls for this to be
accomplished through the use of residuals repositories. As the local
administering agency, it would be virtually impossible for the City's Fire
Department to manage a program where hazardous wastes were not stored in
authorized and controlled hazardous waste repositories.
Due to the possibility of pre—existing contractual commitments by the City, the problems
created by the previous use of this site as a landfill, the lack of necessary process
approvals from State and Federal agencies, possible adverse seismic conditions at this
site, and several other preferred waste management treatment, the City can not support
your proposal for the installation of this facility at the subject site.

Statement of Issue:
Because of the large investment the city is making on.the state—owned land from the
municipal pier to the end of the bluffs, it is advisable to acquire title to this state land.
Also, it is necessary to relocate the police shooting range to allow development of the
Ocean View Estates Mobile Home Park.
Recommendations:
1. Authorize the Mayor to make an offer to the Orange County Board of Supervisors to
acquire title to the twelve acre County Transfer Station site on Gothard Street in
exchange for the city accepting maintenance responsibilities for the County Linear Park
after it is developed.
2. Authorize staff to negotiate an agreement with the State of California to acquire title
to 2.3 miles of state lands from the municipal pier to the end of the bluffs between
Pacific Coast Highway and the mean low tide line in exchange for providing the State
Parks and Recreation Department up to three acres to develop a maintenance and
operation facility on the transfer station site.
3. Approve the concept of relocating the police shooting range to the transfer station site.
Analysis:
Since the city intends to invest from $15 to $30 million in improvements to the beach
frpnt between the municipal pier and Bolsa Chica State Beach during the next twenty
years, it is advisable that the city acquire title to the land rather than risk turning over
the improvements to the state at the end of our current operative agreement in 37 years.

explains the advantages of this action.
In order to acquire title to the state land, the California Parks and Recreation
Department is proposing a trade for a three acre parcel in the Gothard Industrial
Corridor. The attached letter dated 9/16/88 from the State's District Superintendent,
Tom Miller, explains the steps in the proposed transactions.

The county's transfer station property, which comprises approximately twelve acres
including the transfer station which has been out of operation for several years, is
considered surplus by the county. It has an estimated value of $3 to $4 million depending
upon a thorough soils investigation. Also, the cost of clearing the site reduced the value
of the.land further due to the estimated depth of the asphalt at the transfer station.
Rather than purchasing this land at its appraised value, staff is recommending that the
city offer to enter into a maintenance agreement with the county to maintain and operate
the County's Linear Regional Park after it is developed. Based on assumptions made by
the county staff included in their attached memo to Supervisor Wieder dated 9/6/89, the
county's annual operating and maintenance cost would be $216,000. Accepting
maintenance responsibilities by the city would be a natural extension of our maintenance
efforts at Huntington Central Park and the coastal Blufftop Park and would assure our
standard level of maintenance. Maintenance of this facility by the county would be
expensive for them since they have no other park maintenance responsibilities in the
immediate area.
In addition, the development of the second phase of the Ocean View Estates Mobile Home
Park requires the acquisition of the.Mushroom Farm and relocation of the city's.police
shooting range. A staff committee has researched alternate locations for the shooting
range, and the Gothard Industrial Corridor appears to be the best location in the city.
Although the city has no legal obligation to relocate the range based on the current lease
with the Police Officers' Association, this facility provides valuable training to our
officers as well as other local law enforcement agencies and private citizens who pay a
fee to use the range.
The remaining transfer station land would be used by the city for necessary outdoor
storage, additional golf course area, or landscaped open space.
Funding Source:
No direct outlay of funds is involved in the recommended action. Maintenance costs for
the County Linear Park would be included in the city's annual budget.
Alternatives:
1. Do not acquire title to the state land at the beach.
2. Acquire the state land at the appraised value.
3. Acquire the county's land at the appraised value.
4. Do not acquire the county's land.
5. .Direct the staff toward an alternate location for the police shooting range.

The City Clerk presented a communication from the City Administrator regarding
the need to acquire title to the state-owned land from the municipal pier to
the end of the bluffs because of the large investment the City is making in
said land also the need to relocate the police shooting range to allow
development of the Ocean View Estates Mobile Home Park.
The City Administrator presented a staff report.
A motion was made by Erskine, seconded by Mays, to: (1 ) authorize the Mayor
to make an offer to the Orange County Board of Supervisors to acquire title to
the twelve acre County Transfer Station site on Gothard Street in exchange for
the City accepting maintenance responsibilities for the County Linear Park
after it is developed; (2) to authorize staff to negotiate an agreement with
the State of California to acquire title to 2.3 miles of state lands from the
municipal pier to the end of the bluffs between Pacific Coast Highway and the
mean low tide line in exchange for providing the State Parks and Recreation
Department up to three acres to develop a maintenance and. operation facility
on the transfer station site; (3) and to approve the concept of relocating
the police shooting range to the transfer station site.
Councilman Green stated he did not believe the shooting range should be so .
close to the mobilehome park. He stated he favored the purchase of the beach
property. Considerable discussion was held between Council and the City y`
Administrator.
