Location: 17742, 17752, 17772, and 17822 Beach Blvd. (southeast comer of Newman Ave.) Environmental Status: An initial environmental assessment was processed and completed in accordance with the California Environmental Quality Act. It was determined that this item would not have any significant environmental effect and, therefore, a negative declaration is warranted. PROJECT PROPOSAL Applicant: City of Huntington Beach, 2000 Main Street, Huntington Beach, CA 92648 Location: Huntington Beach Hospital and Medical Office Complex - 17742, 17752, 17772, and 17822 Beach Boulevard (Southeast corner of Beach and Newman) Negative Declaration No. 01-10 addresses the potential environmental impacts resulting from the proposed General Plan amendment on the property pursuant to the California Environmental Quality Act. General Plan Amendment No. 01-02 represents a request to amend the General Plan Land Use Map to re-designate approximately 13.8 acres from P (Public) to CO-F2A (Commercial Office with maximum floor-area ratio of 0.75) pursuant to the California Planning and Zoning Laws and the Huntington Beach General Plan. B. BACKGROUND • May 1996 — City Council adopted new General Plan which resulted in, among other changes, the re-designation of the hospital complex from Office Professional to Public, a new land use designation for institutional uses. ■ September 2000 - Planning Commission approved Zoning Map Amendment (ZMA) No. 00-03 to change the zoning of the hospital complex from CO (Commercial Office) to PS (Public-Semipublic) to conform to the General Plan. ■ November 2000 - City Council denied ZMA No. 00-03 and directed staff to amend the General Plan land use designation to match the existing CO zoning. The City Council believed that the current zoning of CO gave the property owners greater flexibility than the proposed PS zoning district. ■ Subsequently, the City Council learned that an entitlement application to allow vehicle storage on the site had been submitted to the Planning Department. Because the request was contingent on approval of the PS zoning, the City Council directed staff to process the zone change to PS again. ■ May 2001 - Planning Commission approved ZMA No. 01-01 to again change the zoning of the hospital complex from CO to PS. ■ July 2001 - City Council continued ZMA No. 01-01 to a date uncertain. The owners of the hospital and medical offices were both concerned about the limited uses in the PS zone in contrast to the CO zone, and the City Council directed staff to address the property owners' concerns. PL02-10 -4- 3/12/2002 2:46 PM REQUEST FOR ACTION MEETING DATE: April 1, 2002 DEPARTMENT ID NUMBER: PL02-10 The existing hospital and medical office uses at the site will remain. No new construction or any other physical changes are proposed with this request; however, the hospital is considering establishing a convalescent facility at the site in the future which will require a conditional use permit approval from the Planning Commission under the existing CO zoning district but is not permitted in the PS zoning district. C. PLANNING COMMISSION MEETING AND RECOMMENDATION At the February 12, 2002 Planning Commission hearing, no one from the public spoke regarding this request. In response to a question from the Planning Commission, staff explained that in July 2001 the City Council continued the previous request to rezone the site to PS to a date uncertain because the property owners of the subject site were concerned about the limited uses in the PS zone in contrast to the CO zone, and the City Council directed staff to address the property owners' concerns. The Planning Commission concurred with the staff recommendation for approval and forwarded the request to the City Council for final action (Attachment No. 3). D. STAFF ANALYSIS AND RECOMMENDATION The primary issue with this request is land use compatibility. The Good Shepherd Cemetery and vacant land surround the complex to the south and east respectively. Beach Boulevard is to the west and commercial, office, and multi-family residences are located to the north across Newman Avenue. The proposed Commercial Office designation is compatible with and will be an extension of the surrounding area which is primarily commercial in nature. A commercial designation is appropriate for the hospital and medical complex because it has frontage along Beach Boulevard, a major arterial, and the city's primary commercial corridor. In fact, there are other similar sites along Beach Boulevard that have a Commercial Office designation such as the Hoag medical complex on the east side of beach, south of Yorktown. Additionally, offices are also compatible with residential uses because of their low intensity and are commonly used as buffers between commercial and residential uses. While some general commercial uses are allowed in the Commercial Office designation, they are ancillary in nature and not as intensive as those in the Commercial General or Commercial Visitor districts. Since no new construction or any other physical changes are proposed at this time, the land use amendment will not have any noticeable impact on the area. If the existing buildings were to be demolished in the future, a conditional use permit will be required to build a new development at the site to assure compatibility with the surroundings. Moreover, the site is buffered from the nearest residential use by Newman Avenue. Based on these points, staff believes the Commercial Office designation is compatible with the area and will not be detrimental to surrounding properties. PL02-10 -5- 3/21/2002 11:40 AM I REQUEST FOR ACTION MEETING DATE: April 1, 2002 DEPARTMENT ID NUMBER: PL02-10 The General Plan amendment also provides the benefit of making the General Plan and zoning designations consistent. It addresses the property owners' concern about maintaining a broader selection of potential uses at the site compared to the existing designation of P (Public). Approval of the Commercial Office designation will also allow the hospital to proceed with future plans to construct convalescent facilities at the site which requires conditional use permit approval from the Planning Commission in the CO zoning district but is not permitted in the PS zoning district. Floor-Area Ratio The Land Use Element of the General Plan includes density limits in the form of floor-area ratios for nonresidential sites. Floor-area ratio (FAR) represents the total building area (gross floor area) on a lot divided by the total net area of that lot. While other CO sites on the General Plan land use map have FARs of 0.5, staff is recommending an FAR of 0.75 for the hospital and medical office complex to allow the existing development as well as future additions to comply. A similar approach was taken with Charter Center on the southwest corner of Warner and Beach which was given a higher FAR than most other commercial sites to allow the existing office tower to conform. Environmental Status: Staff has reviewed and prepared the environmental assessment and determined that no significant impacts are anticipated as a result of the proposed land use amendment. Subsequently, Negative Declaration No. 01-10 (Attachment No. 4) was prepared pursuant to Section 240.04 of the HBZSO and the provisions of the California Environment Quality Act (CEQA). The Planning Department advertised draft Negative Declaration No. 01-10 for twenty (20) days commencing on December 27, 2001 and ending on January 15, 2002. No comments, either verbal or written were received. Prior to any action on General Plan Amendment No. 01-02, it is necessary for the City Council to review and act on Negative Declaration No. 01- 10. Staff, in its initial study of the project, is recommending that the negative declaration be approved with findings. PROJECT PROPOSAL: Negative Declaration No. 01-10 addresses the potential environmental impacts resulting from the proposed General Plan amendment on the property pursuant to the California Environmental Quality Act. General Plan Amendment No. 0 1-02 represents a request to amend the General Plan Land Use Map to re- designate approximately 13.8 acres from P (Public)to CO-F2A(Commercial Office with maximum floor- area ratio of 0.75) pursuant to the California Planning and Zoning Laws and the Huntington Beach General Plan. Background: ■ May 1996—City Council adopted new General Plan which resulted in, among other changes, the re- designation of the hospital complex from Office Professional to Public, a new land use designation for institutional uses. ■ September 2000 - Planning Commission approved ZMA No. 00-03 to change the zoning of the hospital complex from CO (Commercial Office) to PS (Public-Semipublic) to conform to the General Plan. ■ November 2000 - City Council denied ZMA No. 00-03 and directed staff to amend the General Plan land use designation to match the existing CO zoning. The City Council believed that the current zoning of CO gave the property owners greater flexibility than the proposed PS zoning district. ■ Subsequently, the City Council learned that an entitlement application to allow vehicle storage on the site had been submitted to the Planning Department. Because the request was contingent on approval of the PS zoning, the City Council directed staff to process the zone change to PS again. ■ May 2001 - Planning Commission approved ZMA No. 01-01 to again change the zoning of the hospital complex from CO (Commercial Office) to PS (Public-Semipublic). The owners of the hospital and medical offices were both concerned about the limited uses in the PS zone in contrast to the CO zone and the City Council directed staff to address the property owners' concerns. The existing hospital and medical office uses at the site will remain. No new construction or any other physical changes are proposed with this request; however, the hospital is considering establishing a convalescent facility at the site in the future which will require a conditional use permit approval from the Planning Commission under the existing CO zoning district but is not permitted in the PS zoning district. The existing hospital and medical office uses at the site will continue to be permitted under this designation. Additionally, the proposed General Plan Amendment is consistent with the other elements of the General Plan as well as the following goals, policies, and objectives: A. Land Use Element LU 1: Achieve development that maintains or improves the City's fiscal viability and reflects economic demands while maintaining and improving the quality of life for the current and future residents of Huntington Beach. LU 10: Achieve the development of a range of commercial uses. L U 13.1: Provide for the continuation of existing and development of new uses, such as governmental administrative, public safety, human service, cultural, educational, infrastructure; religious, and other uses that support the needs of existing and future residents and businesses. L U 13.1.1: Allow for the continuation of existing public and private institutional, cultural, educational, and health uses at their present locations and development of new uses in areas designated on the Land Use Plan Map in accordance with Policy LU 7.1.1 B. Economic Development Element ED 1.1: Enhance the City's market potential in terms of retail, office, industrial, and visitor serving activity. This would allow Huntington Beach to provide for retail, office, and industrial opportunities that serve the current and projected population and enhance sales and occupancy tax revenue. The General Plan Amendment from Public to Commercial Office complies with these goals, objectives, and policies because the Commercial Office designation provides the property owners a broader selection of potential uses which improves the fiscal viability of the site and the City as a whole in the long run. In the short term, it will allow the hospital to apply for a conditional use permit to the Planning Commission to add a convalescent facility at the site in conformance with policy LU 13.1.1. Zoning Compliance: The site is located in the CO (Commercial Office) zoning district which conforms to the proposed CO General Plan land use designation and permits the existing hospital and medical office uses. Urban Design Guidelines Conformance: Not applicable. Environmental Status: Staff has reviewed and prepared the environmental assessment and determined that no significant impacts are anticipated as a result of the proposed land use amendment. Subsequently, Negative Declaration No. 01-10 (Attachment No. 4) was prepared pursuant to Section 240.04 of the HBZSO and the provisions of the California Environment Quality Act(CEQA). The Planning Department advertised draft Negative Declaration No. 01-10 for twenty (20) days commencing on December 27, 2001 and ending on January 15, 2002. No comments, either verbal or written were received. Prior to any action on General Plan Amendment No. 01-02, it is necessary for the Planning Commission to review and act on Negative Declaration No. 01-10. Staff, in its initial study of the project, is recommending that the negative declaration be approved with findings. PC Staff Report-2/12/02 4 (02SR06 GPA 01-02/EA 01-10) Environmental Board Comments: The Environmental Board reviewed the proposed Negative Declaration and concurred with the determination that there is no impact from the proposed land use amendment. Other Departments Concerns and Requirements: There are no concerns from other city departments. Public Notification: Legal notice was published in the Huntington Beach/Fountain Valley Independent on January 31, 2002, and notices were sent to property owners of record of the subject site and within a 1000 ft. radius of the subject property(and tenants within 300 ft), individuals/organizations requesting notification(Planning Department's Notification Matrix), and interested parties. As of February 7, 2002, no communication supporting or opposing the request has been received. Application Processing Dates: DATE OF COMPLETE APPLICATION: MANDATORY PROCESSING DATE(S): Not applicable Not applicable because GPA is a legislative act and not a development permit ANALYSIS: The primary issue with this request is land use compatibility. The Good Shepherd Cemetery and vacant land surround the complex to the south and east respectively. Beach Boulevard is to the west and commercial, office, and multi-family residences are located to the north across Newman Avenue. The proposed Commercial Office designation is compatible with and will be an extension of the surrounding area which is primarily commercial in nature. A commercial designation is appropriate for the hospital and medical complex because it has frontage along Beach Boulevard, a major arterial and the city's primary commercial corridor. In fact, there are other similar sites along Beach Boulevard that have a Commercial Office designation such as the Hoag medical complex on the east side of beach, south of Yorktown. PC Staff Report—2/12/02 5 (02SR06 GPA 01-02/EA 01-10) Additionally, offices are also compatible with residential uses because of their low intensity and are commonly used as buffers between commercial and residential uses. While some general commercial uses are allowed in the Commercial Office designation, they are ancillary in nature and not as intensive as those in the Commercial General or Commercial Visitor districts. Since no new construction or any other physical changes are proposed at this time, the land use amendment will not have any noticeable impact on the area. If the existing buildings were to be demolished in the future, a conditional use permit will be required to build a new development at the site to assure compatibility with the surroundings. Moreover. the site is buffered from the nearest residential use by Newman Avenue. Based on these points, staff believes the Commercial Office designation is compatible with the area and will not be detrimental to surrounding properties. The General Plan amendment also provides the benefit of making the General Plan and zoning designations consistent. It addresses the property owners' concern about maintaining a broader selection of potential uses at the site compared to the existing designation of P (Public). Approval of the Commercial Office designation will also allow the hospital to proceed with future plans to construct convalescent facilities at the site which requires conditional use permit approval from the Planning Commission in the CO zoning district but is not permitted in the PS zoning district. Floor-Area Ratio The Land Use Element of the General Plan also includes density limits in the form of floor-area ratios for nonresidential sites. Floor-area ratio(FAR) represents the total building area(gross floor area) on a lot divided by the total net area of that lot. While other CO sites on the General Plan land use map have FARs of 0.5, staff is recommending an FAR of 0.75 for the hospital and medical office complex to allow the existing development as well as future additions to comply. A similar approach was taken with Charter Center on the southwest corner of Warner and Beach which was given a higher FAR than most other commercial sites to allow the existing office tower to conform. Three(3) commercial zoning districts are established by this chapter as follows: (3334-6/97) A. The CO Office Commercial District provides sites for offices for administrative, financial, professional, medical and business needs. B. The CG General Commercial District provides opportunities for the full range of retail and service businesses deemed suitable for location in Huntington Beach. C. The CV Visitor Commercial District implements the Visitor Serving Commercial land use designation within the coastal zone and provides uses of specific benefit to coastal visitors. More specifically, the CV district provides opportunities for visitor-oriented commercial activities, including specialty and beach related retail shops, restaurants, hotels, motels, theaters, museums, and related services. (3334-6/97) 211.04 CO,CG, and CV Districts: Land Use Controls In the following schedules, letter designations are used as follows: "P" designates use classifications permitted in commercial districts. "L" designates use classifications subject to certain limitations prescribed by the "Additional Provisions" that follow. The setback standards shall apply only to the stories of a building that are intended for residential use. This district provides areas for large public or semipublic uses. (1) In the coastal zone, the maximum allowable height of structures shall be reduced as necessary to retain compatibility with the established physical scale of the area and to preserve and enhance public visual resources. (33U-6/97) 214.10 Review of Plans All applications for new construction and exterior alterations and additions shall be submitted to the Community Development Department for review. Discretionary review shall be required for projects requiring conditional use permits. Design Review shall be required for all projects except temporary uses. A Coastal Development Permit is required for projects in the Coastal Zone unless the project is exempt (see Chapter 245).
