(HUNTINGTON BEACH HOSPITAL COMPLEX
Dear Council Members:
Huntington Beach Hospital opposes the rezotlitig of the 13.8-acre Huntington Beach Hospital complex from
CO (Office Commercial) to PS (Public-Semipublic). As you are aware, the City of Huntington Beach
Planning Depart-nent staff and Planning Commission recommend the approval of Zoning Map Amendment
01-01 in order to bring the Huntington Beach Hospital complex property into conformance with the
:isa, Q City Plan designation. The hospital supports the overall.Huntington Beach City General Plan but
;s iimitiug this property to only the Public and Semipublic category.
Huntington Beach Hospital has had a long history of serving the healthcare needs of the residents of
Huntington Beach. It is our intention to continue to do so for many years to come. However, the proposed
rezoning will limit the property's future uses. For example, the hospital plaits to renovate its physical plant
in the next several years to meet state seismic requirements. The design of the reconfiguration of the
`—spital's footprint, although not currently developed,may result in a smaller and more compact physical
plant. Any footprint space saved during this reconfiguration will provide the hospital an opportunity to add
additional services to its property. A service expansion may be the addition of a convalescent facility. Such
:, t permitted in the PS zone but is allowed under the CO category, Therefore,the hospital
rcz-=lends that you do not adopt the change to the Zoning Plan for the Huntington Beach Hospital
property.

NOTICE IS HEREBY GIVEN that on Monday, July 16, 2001, at 7:00 p.m. in the
City Council Chambers, 2000 Main Street, Huntington Beach, the City Council
will hold a public hearing on the following planning and zoning item:
O 1. ZONING MAP AMENDMENT NO. 01-01 (HUNTINGTON BEACH
HOSPITAL GENERAL PLAN CONSISTENCY): Applicant: City of
Huntington Beach Request: To rezone the Huntington Beach Hospital
complex from CO (Office Commercial) to PS (Public-Semipublic) to make
the zoning designation consistent with the General Plan land use
designation of P (Public). Location: Southeast corner of Beach
Boulevard and Newman Avenue Project Planner: Ricky Ramos
NOTICE IS HEREBY GIVEN that Item No. 1 is covered under Environmental
Impact Report No. 94-01.
ON FILE: A copy of the proposed request is on file in the City Clerk's Office,
2000 Main Street, Huntington Beach, California 92648, for inspection by the
public. A copy of the staff report will be available to interested parties at the City
Clerk's Office after Friday, July 13, 2001.
ALL INTERESTED PERSONS are invited to attend said hearing and express
opinions or submit evidence for or against the application as outlined above. If

City Treasurer Freidenrich reported on the drop in the interest rates, which is anticipated for the
remainder of the fiscal year. She informed Council that the city continues to maintain adequate
cash reserves. City Treasurer Freidenrich stated in conclusion, that the city is in compliance
with the investment policy.
A motion was made by Garofalo, second Dettloff to review and accept the monthly report.
Following review of the report, by motion of Council, accept the Monthly Investment Report
Summary of City Investment Portfolio, Bond Proceeds, and Deferred Compensation Activity for
May 2001, pursuant to Section 17.0 of the Investment Policy of the City of Huntington Beach.

Mayor Julien Houchen announced that this was the time scheduled for a public hearing to
consider a communication from the Planning Director for a public hearing to consider the
approval of Zoning Map Amendment No. 01-01 — Huntington Beach Hospital General Plan
Consistency.
Applicant: City of Huntington Beach
Request: To rezone the Huntington Beach Hospital complex from CO (Office Commercial) to
PS (Public-Semipublic) to make the zoning designation consistent with the General Plan land
use designation of P (Public).
Location: Southeast corner of Beach Boulevard and Newman Avenue
Environmental Status: This application is covered under Environmental Impact Report
No. 94-01 certified by the City Council on May 13, 1996.
Legal notice as provided to the City Clerk's Office by staff had been mailed, published and
posted.
Principal Planner Scott Hess presented a PowerPoint slide report, which was included in the
agenda packet and is titled Zoning Map Amendment No. 01-01 (Huntington Beach Hospital
Complex).
Principal Planner Hess informed Council of the option to continue the public hearing, referring to
the Late Communication that pertains to this item, which had been announced earlier by the
City Clerk. The Late Communication dated July 13, 2001 from David K. Culberson, Chief

Executive Officer of the Huntington Beach Hospital transmits opposition to the proposed
rezoning of the 13.8 acre Huntington Beach Hospital complex and is titled Zoning Map
Amendment No. 01-01 (Huntington Beach Hospital Complex).
Councilmember Dettloff requested and received clarification from Principal Planner Hess that
the proposed zoning amendment will bring the hospital complex into compliance with the
existing General Plan.
Councilmember Dettloff inquired about the intent of the continuation of the public hearing and
what it would accomplish. She asked if in the interim period, staff plans to meet with the people
who are in opposition to the item, in order to provide them with a clearer understanding of the
issues, or whether staff is considering a different process.
Principal Planner Hess responded that the Late Communication is from the Huntington Beach
Hospital transmitting opposition to the zoning map amendment as the hospital is in the process
of considering the development of a convalescent site which is not allowed in the proposed land
use designation. Principal Planner Hess stated that Council could consider a zoning text
amendment, in addition to a zoning map amendment to change the existing General Plan.
Principal Planner Hess stated further that the current use of the space for vehicle storage has
also prompted the proposal for a change in the current zoning designation from Office
Commercial (CO) to Public-Semipublic (PS).
Councilmember Boardman initiated considerable discussion on the impact of the storage of
vehicles; how long it has been occurring and how many spaces in the hospital parking structure
are occupied for this use by the neighboring car dealerships.
Mayor Pro Tern Cook pointed out that the law requires the finding of economic hardship in order
to permit the car dealers to store the vehicles, to which Principal Planner responded that staff is
looking into this issue.
Mayor Julien Houchen declared the public hearing open.
John Glovacz spoke in opposition to the proposed zoning map amendment, stating that the
storage of vehicles is an infraction of the zoning code, which he stated the city has failed to
enforce for the last six months.
David K. Culberson, Chief Executive Officer, Huntington Beach Hospital, stated his opposition
to the proposed zoning map amendment on the basis that it would take away the flexibility of the
hospital in planning to meet the needs of the community and offer high quality services.
Mr. Culberson reiterated from his Late Communication that the hospital's future plan for a
reconfigured design of the hospital footprint could include a convalescent facility, which is
allowed in the present Commercial Office, but is not allowed under the proposed Public-
Semipublic zoning designation.
There being no persons present to speak further on the matter and there being no protests filed,
either written or oral, the hearing was continued open by the Mayor.
Councilmember Garofalo stated that he was amenable to deferring the item.

Councilmember Bauer expressed the opinion of the importance of retaining the focus on the
health care facility in consideration of the aging population in the city, stating that land use for
the storage of vehicles does not seem to be appropriate for the site.
After ascertaining the number of spaces maintained in the parking structure for vehicle storage
use, Councilmember Boardman concurred with Councilmember Bauer, stating her reluctance to
approve a change in the zoning designation.
Councilmember Dettloff spoke in favor of the hospital's position, although she stated that she
empathized with the auto dealers. Councilmember Dettloff recommended that staff return with a
proposal for a zoning text amendment to change the existing General Plan.
A motion was made by Green, second Garofalo to continue the public hearing open to a date
uncertain; however to be re-advertised and re-noticed with new date when determined. The
motion carried by the following roll call vote:

A. PROJECT PROPOSAL:
Applicant: City of Huntington Beach, 2000 Main Street, Huntington Beach, CA 92648
Location: 17742, 17752, 17772, and 17822 Beach Boulevard (Southeast corner of
Beach and Newman)
Zoning Map Amendment No. 01-01 represents a request by the City of Huntington Beach to
rezone the 13.8 acre Huntington Beach Hospital complex from CO (Office Commercial) to
PS (Public-Semipublic) in order to bring the zoning designation of the site into conformance
with the City's General Plan land use designation of P (Public) pursuant to Section 247.02 of
the Huntington Beach Zoning and Subdivision Ordinance (HBZSO).
B. BACKGROUND
California State law (Government Code Section 65300) requires that each City prepare and
adopt a comprehensive, long-term General Plan for its future development. This plan shall
contain seven required elements, including land use, circulation, housing, conservation,
open space, noise and safety. State law also requires that each city's daily decisions follow
logically from and be consistent with the General Plan policies and goals. The General Plan

includes a Land Use Map that delineates land uses such as residential, commercial,
industrial, and open space.
In the early 1990s, the City initiated a comprehensive update of its General Plan. The new
General Plan was adopted by the City Council on May 13, 1996 and created a vision for
development within the City. An objective of the update was to amend the Land Use Map to
reconcile certain inconsistencies between land use designations and existing uses. The City
Council directed staff to complete Zoning Map Amendments to reconcile any differences
between the zoning and General Plan designations resulting from the General Plan update.
Following this direction, staff has presented Zoning Map Amendments for three groups of
properties before the Planning Commission and City Council. The most recent of these
included six sites along the Beach Boulevard corridor one of which was the Huntington
Beach Hospital complex. On September 26, 2000, the Planning Commission approved
Zoning Map Amendment No. 00-03 to change the zoning of the hospital complex from CO
(Office Commercial) to PS (Public-Semipublic). On November 20, 2000, the City Council
denied this zone change and directed staff to amend the General Plan land use designation
to match the existing CO zoning designation. The City Council believed that the current
zoning designation of CO gave the property owners greater flexibility than the proposed PS
zoning district. Subsequent to that action, the City Council learned that an entitlement
application to allow vehicle storage on the site has been submitted. Vehicle storage is not
permitted in the current CO zoning district but is allowed in the proposed PS zoning district
subject to Planning Commission approval of a Conditional Use Permit. Based on this new
information, the City Council directed staff to process this zone change once again.
C. PLANNING COMMISSION MEETING AND RECOMMENDATION:
On May 22, 2001 the Planning Commission held a public hearing on the subject request.
One person spoke in opposition because approval of the zone change will allow a separate
entitlement request to permit vehicle storage at the site to be processed through the city.
Another person spoke in favor of the request. A discussion ensued regarding parking and
whether vehicles can be stored on site. Staff explained that a separate entitlement must be
approved to allow the proposed vehicle storage at this site and that the discussion on
parking should be deferred to such time as when this separate entitlement is presented
before the Planning Commission. The Planning Commission voted to recommend approval
of Zoning Map Amendment No. 01-01.

D. STAFF ANALYSIS AND RECOMMENDATION:
During the process of updating the General Plan, the potential impacts of placing different
General Plan land use designations on all the affected properties citywide were analyzed.
The land use changes were considered by the General Plan Advisory Committee, the
Planning Commission and the City Council. These bodies considered compatibility of
surrounding land uses, traffic impacts, and public health and safety in their
recommendations and ultimate approval. In the case of the hospital complex, the General
Plan land use designation was changed from RM (Residential Medium Density) to P (Public)
to better reflect the actual use of the site as a public facility.
Zoning Map Amendment No. 01-01 would bring the subject property into conformance with
the General Plan and better reflect what presently exists on the site. Issues related to
compatibility, traffic, etc. were analyzed previously in EIR No. 94-1. By bringing the zoning
into compliance with the General Plan, this Zoning Map Amendment helps to further the
following goals, policies, and objectives:
a. Accommodate existing uses and new development in accordance with the Land
Use and Density Schedules. (LU 7.1.1)
b. Provide for the continuation of existing and development of new uses, such as
governmental administrative, public safety, human service, cultural, educational,
infrastructure, religious, and other uses that support the needs of existing and future
residents and businesses. (LU 13.1)
c. Allow for the continuation of existing public and private institutional, cultural,
educational, and health uses at their present locations and development of new
uses in areas designated on the Land Use Plan Map in accordance with Policy LU
7.1.1. (LU 13.1.1)
Both the CO (Office Commercial) and PS (Public-Semipublic) zoning districts (see
Attachments No. 6 and 7) permit both the existing hospital and medical office uses on the
subject site. However, Section 214.04 of the Huntington Beach Zoning and Subdivision
Ordinance specifies that the PS zoning district is the appropriate base district for public
facilities such as the hospital complex that have a contiguous site area of two acres or more.
This coupled with the existing General Plan designation for the site being P (Public) makes
the PS zoning district the appropriate zoning designation for the hospital complex.
E. SUMMARY
Staff recommends the City Council approve Zoning Map Amendment No. 01-01 for the
following reasons:

It will bring the property into conformance with the existing General Plan designation
and is consistent with City Council direction resulting from the 1996 General Plan

The proposed PS zoning district is a better reflection of the actual use of the site as a
public facility.
Approval of the request will not have any adverse environmental impacts. Zoning Map
Amendment No. 01-01 is within the scope of the previously certified EIR 94-1 for the
comprehensive General Plan update.
This action is consistent with goals, objectives, and policies of the General Plan
because it supports development in accordance with the land uses depicted on the
Land Use Plan Map. It will also further goals, objectives, and policies that pertain to the
achievement of a variety of land uses that sustain the City's economic viability, and
provide employment opportunities as well as services to meet the needs of the citizens
of Huntington Beach.
Environmental Status:
In accordance with the California Environmental Quality Act, Environmental Impact Report
(EIR) No. 94-1 was prepared and certified by the City Council on May 13, 1996, for
preparation of the City's comprehensive General Plan Amendment. This EIR analyzed all
potential impacts and provided mitigation measures sufficient to mitigate any potential
impacts to a level of insignificance. Zoning Map Amendment No. 01-01 has been
determined to be within the scope of the previously certified EIR No. 94-1; therefore, no
additional environmental review is required.

SUGGESTED FINDINGS FOR APPROVAL -ZONING MAP AMENDMENT NO. 01-01:
1. Zoning Map Amendment No. 01-01 to change the zoning of the 13.8 acre Huntington Beach Hospital
Complex located at Beach and Newman from the current zoning designation of CO (Office
Commercial) to PS (Public-Semipublic) is consistent with the objectives, policies, general land uses
and programs specified in the General Plan. The subject location has a General Plan designation of P
(Public). The Zoning Map Amendment would bring the zoning into conformance with the General
Plan. This action is consistent with goals, objectives, and policies of the General Plan including:

3. A community need is demonstrated for the change proposed. With the adoption of the General Plan in
1996, the City determined that a P (Public) land use designation would better reflect the actual use of
the subject site. The Zoning Map Amendment from CO (Office Commercial) to PS (Public-
Semipublic) will also better reflect the actual use of the site. It will facilitate the continued existence
of the hospital complex and the provision of services which have been offered to residents in the
community.
4. Its adoption will be in conformity with public convenience, general welfare and good zoning practice.
The site is presently designated on the General Plan as P (Public); the proposed rezoning action will
bring the subject site into conformity with the current General Plan designation.
5. The City Council finds that Zoning Map Amendment No. 0 1-0 1 is covered within the scope of
Environmental Impact Report No. 94-1 which was certified by the City Council on May 13, 1996 and
that no further environmental review is required.

AMENDING THE HUNTINGTON BEACH ZONING AND SUBDIVISION
ORDINANCE BY CHANGING THE ZONING DESIGNATION FROM
CO (OFFICE COMMERCIAL) TO PS (PUBLIC-SEMIPUBLIC)
ON REAL PROPERTY LOCATED AT THE SOUTHEAST CORNER
OF BEACH BOULEVARD AND NEWMAN AVENUE

WHEREAS, pursuant to the State Planning and Zoning Law, the Huntington Beach
Planning Commission and Huntington Beach City Council have held separate public hearings
relative to Zoning Map Amendment No. 01-1, wherein both bodies have carefully considered all
information presented at said hearings, and after due consideration of the findings and
recommendations of the Planning Commission and all evidence presented to said City Council,
the City Council finds that such zone change is proper, and consistent with the General Plan,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
ordain as follows:
Section 1. That the real property located at the southeast corner of Beach Boulevard
and Newman Avenue, and more particularly described in the legal description and sketch
collectively attached hereto as Exhibit A and incorporated by this reference as though fully set
forth herein, is hereby changed from CO (Office Commercial) to PS (Public-Semipublic).
Section 2. That the Director of Planning is hereby directed to amend Sectional
District Map 30Z of the Huntington Beach Zoning and Subdivision Ordinance to reflect the
changes contained in this ordinance. The Director of Planning is further directed to file the
amended map. A copy of such map, as amended, shall be available for inspection in the Office
of the City Clerk.

STATEMENT OF ISSUE:
• Zoning Map Amendment No. 01-01 request:
- City-initiated rezoning of the 13.8 acre Huntington Beach Hospital complex from CO (Office
Commercial) to PS (Public-Semipublic) in order to bring the zoning designation of the site into
conformance with the existing General Plan land use designation of P (Public).
Staff s Recommendation: Approve Zoning Map Amendment No. 01-01 with findings and forward it
to the City Council based upon the following:
- It will bring the property into conformance with the existing General Plan designation and is
consistent with City Council direction resulting from the 1996 General Plan update.
- The proposed PS zoning district is a better reflection of the actual use of the site as a public
facility.
- Approval of the request will not have any adverse environmental impacts. Zoning Map
Amendment No. 01-01 is within the scope of the previously certified EIR 94-1 for the
comprehensive General Plan update.
- This action is consistent with goals, objectives, and policies of the General Plan because it
supports development in accordance with the land uses depicted on the Land Use Plan Map. It
will also further goals, objectives, and policies that pertain to the achievement of a variety of land
uses that sustain the City's economic viability, and provide employment opportunities as well as
services to meet the needs of the citizens of Huntington Beach.
RECOMMENDATION:
Motion to:
"Approve Zoning Map Amendment No. 01-01 with findings (Attachment No. 1) and forward to the City
Council for adoption."

BACKGROUND:
California State law(Government Code Section 65300) requires that each City prepare and adopt a
comprehensive, long-term General Plan for its future development. This plan shall contain seven required
elements, including land use, circulation, housing, conservation, open space, noise and safety. State law
also requires that each city's daily decisions follow logically from and be consistent with the General Plan
policies and goals. The General Plan includes a Land Use Map that delineates land uses such as
residential, commercial, industrial, and open space.
In the early 1990s, the City initiated a comprehensive update of its General Plan. The new General Plan
was adopted by the City Council on May 13, 1996 and created a vision for development within the City.
An objective of the update was to amend the Land Use Map to reconcile certain inconsistencies between
land use designations and existing uses. Examples of such conditions of use and General Plan
inconsistency that were reconciled through the GPA include redesignating:
a. Commercial or retail businesses denoted as Residential
b. Low or Medium Density Residential uses denoted as High Density Residential
C. Places of religious assembly denoted as Residential, Commercial, or Industrial
As part of this effort the City Council redesignated 97 areas throughout the city. In 17 of these areas (160
parcels), this action created inconsistencies between the General Plan land use designation and zoning
district designations. The City Council directed staff to complete Zoning Map Amendments to reconcile
any differences between the zoning and General Plan designations resulting from the General Plan update.
Following this direction, staff has presented Zoning Map Amendments for three groups of properties
before the Planning Commission and City Council. The most recent of these included six sites along the
Beach Boulevard corridor one of which was the Huntington Beach Hospital complex. On September 26,
2000, the Planning Commission approved Zoning Map Amendment No. 00-03 to change the zoning of
the hospital complex from CO (Office Commercial) to PS (Public-Semipublic). On November 20, 2000,

the City Council denied this zone change and directed staff to amend the General Plan land use
designation to match the existing CO zoning designation. The City Council believed that the current
zoning designation of CO gave the property owners greater flexibility than the proposed PS zoning
district. Subsequent to that action, the City Council learned that an entitlement application to allow
vehicle storage on the site has been submitted. Vehicle storage is not permitted in the current CO zoning
district but is allowed in the proposed PS zoning district subject to Planning Commission approval of a
Conditional Use Permit. Based on this new information, the City Council directed staff to process this
zone change once again.
PROJECT PROPOSAL:
Zoning Map Amendment No. 01-01 represents a request by the City of Huntington Beach to rezone the
13.8 acre Huntington Beach Hospital complex from CO (Office Commercial) to PS (Public-Semipublic)
in order to bring the zoning designation of the site into conformance with the City's General Plan land use
designation of P (Public)pursuant to Section 247.02 of the Huntington Beach Zoning and Subdivision
Ordinance (HBZSO).

General Plan Conformance:
The purpose of Zoning Map Amendment No. 01-01 is to bring the zoning of the Huntington Beach
Hospital complex into conformance with the existing General Plan land use designation. By changing the
zoning from CO to PS as recommended by staff, the subject property will be in conformance with the

General Plan. Approval of the zone change is also in conformance with the following goals, policies, and
objectives:
a. Accommodate existing uses and new development in accordance with the Land Use and Density
Schedules. (LU 7.1.1)
b. Provide for the continuation of existing and development of new uses, such as governmental
administrative,public safety, human service, cultural, educational, infrastructure, religious, and
other uses that support the needs of existing and future residents and businesses. (LU 13.1)
c. Allow for the continuation of existing public and private institutional, cultural, educational, and
health uses at their present locations and development of new uses in areas designated on the Land
Use Plan Map in accordance with Policy LU 7.1.1. (LU 13.1.1)
Environmental Status:
In accordance with the California Environmental Quality Act, Environmental Impact Report (EIR)No.
94-1 was prepared and certified by the City Council on May 13, 1996, for preparation of the City's
comprehensive General Plan Amendment. This EIR analyzed all potential impacts and provided
mitigation measures sufficient to mitigate any potential impacts to a level of insignificance. Zoning Map
Amendment No. 01-01 has been determined to be within the scope of the previously certified EIR No. 94-
1; therefore, no additional environmental review is required.
Coastal Status: Not applicable.
Redevelopment Status: Not applicable.
Design Review Board: Not applicable.
Subdivision Committee: Not applicable.
Other Departments Concerns and Requirements: There are no concerns from other City Departments.
Public Notification: Legal notice was published in the Huntington Beach/Fountain Valley Independent
on May 10, 2001, and notices were sent to property owners of record as well as occupants of the subject
site and properties within a 300 ft. radius, individuals/organizations requesting notification (Planning
Department's Notification Matrix), and interested parties. As of May 17, 2001, no communication
supporting or opposing the request has been received.
ANALYSIS:
During the process of updating the General Plan, the potential impacts of placing a different General Plan
land use designation on all the affected properties citywide were analyzed. The land use changes were
considered by the General Plan Advisory Committee, the Planning Commission and the City Council.

These bodies considered compatibility of surrounding land uses, traffic impacts, and public health and
safety in their recommendations and ultimate approval. In the case of the hospital complex, the General
Plan land use designation was changed from RM(Residential Medium Density) to P (Public) to better
reflect the actual use of the site as a public facility.
Zoning Map Amendment No. 01-01 is another follow up to that 1996 action in order to bring the subject
property into conformance with the General Plan and to better reflect what presently exists on the site. As
such, issues related to compatibility, traffic, etc. were analyzed previously in EIR No. 94-1. By bringing
the zoning into compliance with the General Plan, this Zoning Map Amendment helps to fulfill the City's
goals, policies, and objectives for the subject site as outlined in the General Plan and discussed previously
in this report. Moreover, Section 214.04 of the Huntington Beach Zoning and Subdivision Ordinance
specifies that the PS zoning district is the appropriate base district for public facilities such as the hospital
complex that have a contiguous site area of two acres or more.
SUMMARY:
Staff recommends the Planning Commission approve Zoning Map Amendment No. 01-01 and forward it
to the City Council for the following reasons:

Policy LU 9.3.2: Require the design of new residential subdivisions consider the following:
e. Cluster resi4ential units and, if possible, integrate small clusters of multi family
housing within e family areas to preserve open space.
The proposed single-family subdivision s not promote housing type or site plan layout that

large areas of pavement for an interior street, and drive s to each unit. A multi-family
project could be designed with common driveways and larger lic open space areas which
would be more in keeping with the character of the area.

subareas, the Public Hearing will be opened in accordance with each subarea followed by a
discussion and vote.
On May 13, 1996 the City Council adopted General Plan Amendment (GPA) No. 94-2. GPA No.
94-2 was a city initiated comprehensive update of the City's General Plan. As part of the update,
the Land Use Element and Map were modified. Land use designations for 97 areas were changed
to fulfill City goals and policies. As a result of the GPA reclassification, numerous properties now
have zoning designations that are not consistent with their General Plan designations. Zoning
Map Amendment No. 00-03 represents the third in a series of amendments that are being
proposed by staff to correct these inconsistencies.
Specifically, Zoning Map Amendment No. 00-03 proposes to rezone six groupings of properties
(see Subareas A-F, on page 3) currently used for a variety of land uses. Issues pertaining to land
use compatibility were previously analyzed as part of the General Plan update, and the proposed
designations were deemed to be compatible with the surrounding areas.
Staff's Recommendation:
Staff recommends the Planning Commission approve Zoning Map Amendment No. 00-03 for the
following reasons:

Jeff Lang, 5557 Toyon Bay, Long Beach, owner of a rental unit at 7922 Terry Drive, opposed the
proposed project stating that rezoning to Commercial General would have a negative impact on

property, and would restrict property upgrade ability.

use provision. Future development will be compatible with the development standards.
3. A community need is demonstrated for the change proposed. The Zoning Map Amendment
will allow the zoning designations on the subject properties to conform to the General Plan. It
will also permit the existing uses in subareas E and F to continue and provide services which
have been offered to residents in the community.
4. Its adoption will be in conformity with public convenience, general welfare and good zoning
practice. The sites are presently designated on the General Plan; the proposed rezoning action
will bring each site into conformity with the current General Plan designation.

meetings and the CEQA process required of the school district. Staff stated that they
would keep the Commission apprised as to what is occurring.
2. Does the City of Huntington Beach have a graffiti ordinance similar to that of Fountain
Valley's including the reward of$500.00? Staff stated that we do but that we do not

B-1. ZONING MAP AMENDMENT NO. 01-01 (HUNTINGTON BEACH HOSPITAL
GENERAL PLAN CONSISTENCY): Applicant: City of Huntington Beach
Request: To rezone the Huntington Beach Hospital complex from CO (Office
Commercial) to PS (Public-Semipublic) to make the zoning designation
consistent with the General Plan land use designation. Location: Southeast
corner of Beach Boulevard and Newman Avenue Project Planner: Ricky
Ramos
Zoning Map Amendment No. 01-01 request:
- City-initiated rezoning of the 13.8 acre Huntington Beach Hospital
complex from CO (Office Commercial)to PS (Public-Semipublic) in order
to bring the zoning designation of the site into conformance with the
existing General Plan land use designation of P (Public).
Staffs Recommendation: Approve Zoninq Map Amendment No. 01-01 with
findings and forward it to the City Council based upon the following:
- It will bring the property into conformance with the existing General Plan
designation and is consistent with City Council direction resulting from
the 1996 General Plan update.
- The proposed PS zoning district is a better reflection of the actual use of
the site as a public facility.
- Approval of the request will not have any adverse environmental
impacts. Zoning Map Amendment No. 01-01 is within the scope of the
previously certified EIR 94-1 for the comprehensive General Plan
update.
This action is consistent with goals, objectives, and policies of the General Plan
because it supports development in accordance with the land uses depicted on
the Land Use Plan Map. It will also further goals, objectives, and policies that
pertain to the achievement of a variety of land uses that sustain the City's
economic viability, and provide employment opportunities as well as services to
meet the needs of.the citizens of Huntington Beach.
Staff made a presentation to the Commission.
THE PUBLIC HEARING WAS OPENED:
John Glowacz spoke in opposition to the item objecting to public parking being
made available in the middle of a medical development, thereby eliminating 100
parking spaces for medical patrons.
Kelli Trachtman spoke in favor of the item as long the medical offices comply
with zoning regulations. She also stated that allowing public parking within the
structure would not interfere with parking for medical patrons.

Commissioner Kokal asked how many cars are parking in the facility on a
regular basis. Ms. Trachtman answered that the structure has 240 spaces with
the dealership using 112 for an occupancy rate of 25 percent.
Commissioner Hardy asked what percentage of business offices are occupied.
Ms. Trachtman answered approximately 85 percent.

Discussion ensued regarding parking requirement calculations and
vehicle storage regulations. Staff explained the rezoning process of CO

1. Zoning Map Amendment No. 01-01 to change the zoning of the 13.8 acre

current zoning designation of CO (Office Commercial) to PS (Public-
Semipublic) is consistent with the objectives, policies, general land uses and
programs specified in the General Plan. The subject location has a General
Plan designation of P (Public). The Zoning Map Amendment would bring
the zoning into conformance with the General Plan. This action is consistent
with goals, objectives, and policies of the General Plan including:
a. Accommodate existing uses and new development in accordance with
the Land Use and Density Schedules. (LU 7.1.1)
b. Provide for the continuation of existing and development of new uses,

It will also further goals, objectives, and policies that pertain to the

meet the needs of the citizens of Huntington Beach.
2. In the case of a general land use provision, the zoning map amendment is
compatible with the uses authorized in, and the standards prescribed for, the
zoning district for which it is proposed. This amendment would change the
land use designation rather than a general land use provision. Future
development will be compatible with the development standards.
3. A community need is demonstrated for the change proposed. With the
adoption of the General Plan in 1996, the City determined that a P (Public)
land use designation would better reflect the actual use of the subject site.
The Zoning Map Amendment from CO (Office Commercial)to PS (Public-
Semipublic) will also better reflect the actual use of the site. It will facilitate
the continued existence of the hospital complex and the provision of
services which have been offered to residents in the community.
4. Its adoption will be in conformity with public convenience, general welfare
and good zoning practice. The site is presently designated on the General
Plan as P (Public); the proposed rezoning action will bring the subject site
into conformity with the current General Plan designation.

5. The Planning Commission finds that Zoning Map Amendment No. 01-01 is
covered within the scope of Environmental Impact Report No. 94-1 which
was certified by the City Council on May 13, 1996 and that no further
environmental review is required.

211.02 Commercial Districts Established
The purpose of the Commercial districts is to implement the General Plan and Local
Coastal Program commercial land use designations. Three (3) commercial zoning
districts are established by this chapter as follows. (3334-6197)
A. The CO Office Commercial District provides sites for offices for
administrative, financial, professional, medical and business needs.
B The CG General Commercial District provides opportunities for the full
range of retail and service businesses deemed suitable for location in
Huntington Beach
C. The CV Visitor Commercial District implements the Visitor Serving
Commercial land use designation within the coastal zone and provides uses
of,specific benefit to coastal visitors More specifically, the CV district
provides opportunities for visitor-oriented commercial activities, including

permit from the Zoning Administrator if the laboratory space exceeds 2,500
square feet.

column refer to standards following the schedule or located elsewhere in the zoning
ordinance. In calculating the maximum gross floor area as defined in Chapter 203, the
floor area ratio is calculated on the basis of net site area. Fractional numbers shall be

(A) Dwelling units shall be subject to the standards for minimum setbacks, height
limits, maximum density, open space, balconies and bay windows, and parking
for the RMH District. The setback standards shall apply only to the stories of a
building that are intended for residential use.

Highway and Edinger Avenue or 25-foot setback with the setback area entirely
landscaped.
(F) Along a side or rear property line abutting an R district, a 10-foot setback is
required, and structures within 45 feet of the district boundary shall not exceed
18 feet in height.

(H) Planting Areas:
(1) Required front and street side yards shall be planting areas except
properties with 50 foot setback shall provide a minimum 10 foot wide
planting area along street frontages.

a solid concrete or masonry wall at least 6 feet in height.
(3) Hotels and Motels. A 15-foot wide landscaped strip shall be provided

211.08 Review of Plans
All applications for new construction, initial establishment of use, exterior alterations
and additions shall be submitted to the Community Development Department for
review. Discretionary review shall be required as follows:
A. Zonin,Administrator Review. Projects requiring a conditional use permit from
the Zoning Administrator; projects on substandard lots; see Chapter 241.
B. — ,n Review Board. Projects within redevelopment project areas and areas
subject to specific plans; projects within 500 feet of a PS District; see Chapter
244.
C. Planning Commission. Projects requiring a conditional use permit from the
Planning Commission; see Chapter 241.
D. Projects in the Coastal Zone. A Coastal Development Permit is required unless
the project is exempt; see Chapter 245.

214.02 Public-Semipublic District Established
The PS Public-Semipublic District is established by this chapter. This district provides areas for
large public or semipublic uses. The intent of this district in the coastal zone is to implement the
Public, Quasi-Public, and Institutional land use designation of the certified Local Coastal Program
Land Use Plan. (3334)
214.04 Applicability
The PS District shall be the base district for the use classifications listed in Section 214.06 where
these have a contiguous site area of 2 acres or more, including alleys, streets,or other rights-of-way.
Public-semipublic use classifications on sites of less than 2 acres shall be subject to the provisions of
the base and overlay districts in which they are located.
214.06 PS District: Land Use Controls
In the following schedule, letter designations are used as follows:
"P" designates use classifications permitted in PS districts.
"L" designates use classifications subject to certain limitations prescribed by the "Additional
Provisions" which follow.
"PC" designates use classifications permitted on approval of a conditional use permit by the
Planning Commission.
"TU" designates use classifications allowed on approval of a temporary use permit.
"P/U" for an accessory use mean that the use is permitted on the site of a permitted use but
requires a conditional use permit on the site of a conditional use.
Use classifications that are not listed are prohibited. Letters in parentheses in the "Additional
Provisions column refer to provisions following the schedule or located elsewhere in the zoning
ordinance. Where letters in parentheses are opposite a use classification heading, referenced
provisions shall apply to all use classifications under the heading.

PS District: Additional Provisions
L-1 City-owned facilities are permitted; all other facilities require a conditional use permit from
the Planning Commission.
L-2 Permitted as an accessory use in a cultural, educational, hospital, or medical institution
occupying no more than 5,000 square feet, only if there is no separate entrance or sign.
L-3 Public parking permitted, but commercial parking facilities on City-owned land require a
conditional use permit from the Planning Commission.

214.08 PS District: Development Standards
The following schedule prescribes development standards for the PS district. The first column
prescribes basic requirements for permitted and conditional uses in the district. Letters in
parentheses in the "Additional Requirements" column refer to standards following the schedule or
located elsewhere in the zoning ordinance. In calculating the maximum gross floor area as defined
in Chapter 203,the floor area ratio is calculated on the basis of net site area. Fractional numbers
shall be rounded down to the nearest whole number. All required setbacks shall be measured from
ultimate right-of-way and in accordance with definitions set forth in Chapter 203 Definitions.

PS District: Additional Development Standards
(A) See Section 230.62: Building Site Required.
(B) See Section 230.68: Building Projections into Yards and Required Open Space. Double-
frontage lots shall provide front yards on each frontage.
(C) A minimum 50-foot setback is required along Beach Boulevard, Edinger Avenue, and Pacific
Coast Highway or 25 foot setback with the setback area entirely landscaped.
(D) Along a side or rear property line abutting an R district, a 10-foot setback is required,and
structures within 45 feet of the district boundary shall not exceed 18 feet in height.

(F) Planting Areas:
(1) Required side and rear yards shall be planting areas or shall be enclosed by a solid
concrete or masonry wall at least 6 feet in height.
(2) A 10-foot wide landscaped strip shall be provided along all street frontages, except for
necessary driveways and walks.

(1) A solid masonry or concrete wall at least 6 feet in height shall adjoin the site of an existing
ground-floor residential use. However, where the portion of the site within 10 feet of the
front property line is occupied by planting area or by a building having no openings except
openings opposite a street property line, the Director may grant an exception to this
requirement. A wall within 15 feet of a street property line shall not exceed 3.5 feet in
height.

(L) A front or street side wall surface shall be no longer than 100 feet without a break, a recess or
offset measuring at least 20 feet in depth and one-quarter of the building length, or a series of

building wall by a minimum of 4 feet. The Director may grant exceptions or allow these
standards to be modified for exceptional or unique structures subject to Design Review,
Chapter 244.
(1VI) On frontages adjacent to major or primary arterials at least 40 percent of a building surface
may be located at the minimum setback line if additional landscaping is provided on the site.
(N) In the coastal zone,the maximum allowable height of structures shall be reduced as necessary
to retain compatibility with the established physical scale of the area and to preserve and

214.10 Review of Plans

projects requiring conditional use permits. Design Review shall be required for all projects except
temporary uses. A Coastal Development Permit is required for projects in the Coastal Zone unless
