Recommended Action: 1. Appropriate $25,000 from the General Fund for consultant services to assist the City in Lobbying for its interests in the Bolsa Chica; and 2. Direct staff to negotiate with Susan McCabe, of Rose and Kindal, for services to assist the City in addressing the City's Coastal Act related issues with the Bolsa Chica Land Use Plan during the Coastal Commission processing of the Bolsa Chica Local Coastal Program (LCP) in an amount not to exceed $25,000, and return to City Council for action on a contract on August 7, 1995. Mayor Leipzig and fellow council members . My name is Chuck Nelson, and I am speaking to you tonight on behalf of the Amigos de Bolsa Chica. The Amigos are addressing Agenda item For almost 20 years, the Amigos have led the community on issues reagarding the Bolsa Chica Area. Over that period, the Amigos have sheherded an idea that initially involved preservation for 528 acres of wetlands, to the plan now being reviewed by you, as encapsulated by the County LCP, that provides for over 1100 acres of restored wetlands and open space. The increase in what the Amigos first sought, and the LCP, reflects the Amigos and communities dedication to the Bolsa Chica wetlands . The signficant preservation reflected in this plan demonstrates the Amigos focus on the accomplishment of our mission statement, and the Amigos ' willingness and ability to work through the system to accomplish our goals . In a few short months, it ' s very possible that all the Amigos set out to accomplish those 20 years ago will be accomplished - that being the preservation and restoration of the Bolsa Chica wetlands . There still remain issues regarding this proposal that City staff has capably addressed. The Amigos, as reflected in the statements of Mrs . Housseal, Mrs. Morrison, and myself, are identifying our position regarding the 7 identified city issues . I wish to address the remaining issues . The Amigos firmly believe that any wetlands restoration plan must include adequate buffers and measures that provide habitat and wildlife with protection from urban impacts . The Amigos have closely examined this issue, We believe that the size type of buffers should be determined by those most qualified. In this case, the California the Department of Fish and Game, in consultation with the Coastal Commission, should determine what type of buffers are necessary. A second issue that is covered by the city report is what we refer to as the "memmorialization" issue, the recordation of the significant cultural, historical, and archealofical artifacts associated with the Bolsa Chica area. The need to take action on this is reflected and aknowledged within the WRP of the LCP, and we support the effort to document this rich history. The final two issues are related - those being the city' s concerns /v regarding regarding the product type and density of residential housing that will be built on the Bolsa Chica Mesa, specifically that adjoing the already existing housing on Los Patos . This is an issue that is far beyond the focus of the Amigos . However, we believe there is still room for discussion on this . Further planning and discussion is expected and advisable in this area. One issue that most people are championing is the issue of a restoration that is based upon the needs of the wetlands resource. The city has aknowledged that the plan now referred to as the "Coastal Conservancy Plan", with a tidal inlet restoring fresh saltwater and bio-diversity of habitat, is scientifically the best for the Bolsa Chica resource. It is interesting to note also that this is the plan that emerged from the public plannning process . We applaud city staffs support of this plan, as we believe it promises the best restoration for Bolsa Chica Along those lines, the Amigos have begun circulating a support statement, that we have had great success having citizens sign at our wetlands our public tours of the wetlands . This statement essentially indicates that signatores agree with the concept of the best wetlands restoration plan at Bolsa Chica, no matter who pays for it, and they want the resource optimally restored. This brings up the last issue. On the table is a proposal for the purchase and restoration of the Bolsa Chica wetlands . The Amigos have followed this development closely over the past months, and have in fact been actively involved in both encouraging it, and in sculpting a plan that provides for the greatest amount of public input possible. Should the plan move forward, the Amigos will continue to strive for a restoration plan with signmificant public input that arrives at a restoration plan similar to the Coastal Conservancy plan. Should this proposal not reach fruition, then the Amigos will continue to stand by the elements of the Bolsa Chica Coalition Concept plan, which provide for significant wetlands preservation and restoration. In the LA times this morning, and editorial warned the public about the dire consequences for wetlands that could confront wetlands if legislation currently proposed is passed. It even mentioned the Bolsa Chica wetlands as an area that could be significantly affected should the legislation be passed. Fortunately, due to the journeywork of the Amigos de Bolsa Chica, an agreement is in place that will guarantee wetlands preservation and protection, even if other proposals fall through and this legislation passes . As we have for the past 20 years, the Amigos will continue to work toward the ultimate accomplishment of our goal - the preservation and restoration of the Bolsa Chica wetlands . r Good evening, my name is MaryEllen Houseal, I have lived in Huntington Beach for "0 years. As a past president of the Amigos de Bolsa Chica. I am speaking tonight to give you background information on item Formed in 1976, the Amigos have been the stewards of the Bolsa Chica for nearly 20 years. We are dedicated to informing the public and our elected officials to the value of protecting and restoring the Bolsa Chica Wetlands. Through the years we have been essential in seeing the acreage set aside for wetlands grow from 300 acres, to 600, to the once approved marina plan with 915 acres, to the 1989 Coalition Plan which provides for 1100 acres of wetlands and open space. At the same time we have been instrumental in seeing the housing units decline from the high figure of 11,000 to 7,200 to 5,700 to 4,800 to the current plan of 3300. As you may recall, the Amigos sustained a lawsuit for nearly 10 years - which resulted in an out-of-court settlement and the Amigos receiving reimbursement for our legal expenses. During my term as president nearly 10 years ago, and with every succeeding president, the Amigos have met with port officials to explore the possibility of the ports acquiring and restoring the Bolsa Chica wetlands for mitigation needed by expanding the port's facilities. The Amigos are reviewing the current federal/port plan and are looking forward to the opportunity to have public input on the type of restoration plan being proposed. Alternative Action(s): Modify the recommended Coastal Act related issues. j REQ*ST FOR COUNCIL ACTION • MEETING DATE: July 17, 1995 DEPARTMENT ID NUMBER: Analysis: On May 15, 1995, the City Council directed staff to work with the City Council Sub- committee on the Bolsa Chica to identify the Bolsa Chica issues that the City should pursue at the Coastal Commission. On June 19, 1995, the City Council continued action on the hiring of a consultant to assist the City in lobbying the California Coastal Commission to address the City's concerns with regard to the Land Use Plan for the Bolsa Chica and directed staff to return to Council with a recommendation on the City's Coastal Act related Bolsa Chica issues and the consultant selection on July 17, 1995. (Note: Action on the hiring of a consultant is being addressed under a separate agenda item.) Coastal Act Related Bolsa Chica Issues The City Council Sub-committee on the Bolsa Chica has met during the last six weeks to formulate and finalize its recommendation on the Bolsa Chica issues which should be pursued at the Coastal Commission. Recognizing that the Coastal Commission will only address those issues which fall under the Coastal Act, the Sub-committee began with the City Council's 17 Bolsa Chica principles (adopted on November 7, 1994) and focused on the issues which were Coastal Act related. Through this process the Sub-committee further identified the following seven (7) issues which it recommends that the City pursue at the Coastal Commission. 1. Conservation Easement. The Sub-committee and staff recommend that the City pursue placement of a conservation easement over the restoration area to protect it from future use as anything other than wetland restoration uses. Staff has met with Coastal Commission staff who have also expressed concern that the mesa could be developed and the lowland sold off to another owner who could apply for a zone change to allow future development. The Sub-committee and staff believe that the application of a conservation easement would provide greater protection for the area than the conservation land use designation and zoning. The Sub-committee also recommends that the conservation easement be required under all lowland scenarios-- including: (1) if Federal permits are granted and the lowland is developed; (2) if Federal permits are not sought, (3) if Federal permits are sought, but not granted; or (4) if the property is acquired by a Federal agency. This recommendation is consistent with the Bolsa Chica Coalition plan, and is also being pursued by the Amigos de Bolsa Chica. 2. Mesa Top Buffer. The Sub-committee and staff recommend that the City pursue incorporation of an open space buffer, on top of the mesa (along the bluff edge). The mesa top buffer would protect the bluff and wetlands restoration area from the areas designated for development. The buffer should be of sufficient width to accommodate passive recreational uses, such as bicycle and/or pedestrian trails, benches and vista overlooks, (similar to those planned for the Harriet Wieder Regional Park which runs, parallel to the Bolsa Chica Mesa, along the length of the Huntington Mesa at the C1395-33.130C -2- 07/11/95 1:29 PM REQ@ST FOR COUNCIL ACTION • MEETING DATE: July 17, 1995 DEPARTMENT ID NUMBER: southern most edge of the Bolsa Chica area), as well as an area for memorialization of the historical and cultural resources found in the Bolsa Chica. Discussion of the type of memorialization has been provided under#5. 3. Wetland Restoration Plan, The Sub-committee and staff recommend that the City support the restoration plan proposed in the LCP. The Sub-committee and staff have heard presentations by Michael Josselyn, the creator of the plan in the LCP, Sharon Lockhart, an expert in wetland restoration issues, and Counsel to the Amigos de Bolsa Chica. After listening to the presentations and discussions with the presenters, they concluded that the proposed restoration plan is a well-balanced plan which provides a valuable combination of habitats and will provide winter eco-tourism opportunities to the City. In keeping with the City's original 17 principles, the Sub-committee also recommends that implementation of the restoration plan be careful to ensure that the tidal inlet is designed in a manner which will not have a negative impact to the beach, public recreation or be detrimental to public safety, health or welfare; that site planning of open space, parks, trails, ecological reserves or other open space amenities the plan should also maintain the relationship between mesa upland and lowland areas; and that the natural topography of the mesa and bluff faces need to be maintained by the limiting of grading, terracing or other similar methods. 4. Mesa Top Roadway. The Sub-committee and staff recommend that the City pursue incorporation of roadway which runs along the recommended buffer (see issue #2) and separates the buffer from development areas. The mesa roadway would serve as a distinct boundary between areas designated for development and public open space areas. It will provide public access opportunities to public open space areas while providing additional separation from development and protection to the wetland restoration area. (See Attachment No. 2 Conceptual Alignment of the Alternative Mesa Top Roadway.) 5. Cultural/Historical Memorialization. The Bolsa Chica area has a history of use by Native Americans, Oil production, and World War II bunkers. Sub-committee and staff recommend that the City pursue memorialization of the cultural and historical resources found in the Bolsa Chica. They recommend that memorialization be provided through interpretive signage and displays which depict the Bolsa Chica's history of oil production, use by Native Americans and the significance of the site during World War II; these elements should be incorporated into vista overlooks and small kiosks provided along the buffer. 6. Compatibility with Existing Los Palos Development. The proposed development does not mirror the density and scale of existing residential neighborhoods which are immediately adjacent to the Bolsa Chica. Although development standard issues are considered local planning issues and are typically not addressed by the Coastal CD95-33.DOC -3- 07/11/95 1:29 PM REQ11ST FOR COUNCIL ACTION MEETING DATE: July 17, 1995 DEPARTMENT ID NUMBER: Commission, staff believes that areas of the LCP, adjacent to the City, should consist of the same type of development that is located in the City. Therefore, the staff recommends that the City continue to pursue this issue in general terms; staff recommends that the City request that the Coastal Commission amend the plan to designate the Bolsa Chica areas, adjacent to the City, specifically along Los Patos Avenue, to a compatible land use and zoning that is of similar density, type and scale to existing development. 7. _Product Type. The LCP is not specific enough to determine the percentage of single and multi-family units proposed for development. Development of the Bolsa Chica should be compatible with the City of Huntington Beach. The Sub-committee and staff recommend that the City request that the LCP reflect the same percentage of single and multi-family units that exists in the immediate project vicinity. Sub-committee and the staff believe that the above issues are significant Coastal related issues associated with the Bolsa Chica and that they are consistent with the City Council's original 17 principles. (For the City Council's information, a matrix comparing the 17 principles with the Sub-committee and staffs Coastal Act issues has been provided in Attachment No. 1. The matrix also provides the status of on Coastal related issues identified in the principles). The Sub-committee and staff recommend that the City focus its efforts on addressing the above seven (7) issues at the Coastal Commission. Environmental Status: The above action does not constitute a project, as defined under section 15378, of the California Environmental Quality Act (CEQA) Guidelines and, therefore, is not subject to CEQA processing. Main ? j H.B. CA 92648 July 17,1995 As a resident of H.B. and having attended every meeting of the City Council ' s sub-committee on Bolsa Chica. I know you are as cognizant of the City's predicament as I am. The City of H.B. which is being treated shabbily by the County and Koll had 17 principles. The 4th principle said : "The Bolsa Chica project should not exceed the City's infrastructure and service capacity. " .streets-, water-, public safety-, libraries-, schools-, public recreation-, sewerage-, cultural activities, other city services. The committee says of principle #4. " Not applicable. As long as it can be demonstrated that essential services can be provided to the Bolsa Chica the Coastal Commission will not take a position on how they should be provided. The EIR demonstrated that adequate services can be provided to the development, therefore the Coastal Commission will not address this issue. " The environmental groups: Bolsa Chica Land Trust, Huntington Beach Tomorrow, Sierra Club Bolsa Chica Task Force, plus the Gabrielino-Shoshone Nation and the City of Seal Beach all have a law suit against the County for an EIR that violated CEQA. The School Districts of H.B. also have a law suit against the County. Is that proof that" these services are provided to the Bolsa Chica?" Koll cancelled two meetings to appear before the sub- committee to which they were invited to present their project. Then sent a letter to the Committee saying they were denied due process. Is there no end to their duplicity?. The wetlands are in the process of being saved by the Ports. With the Development Agreement approved,the Coastal commission will likely approve the project, then it goes back to the County who will approve. If we as a City don' t protect ourselves by saying loud and clear : "this project is wrong for Huntington Beach. #4 is applicable.
