This District can be applied to any area which is general planned Open Space: Water. RECOMMENDATION: The Planning Commission and planning staff recommend that the City Council approve Code Amendment No. 83-23 and adopt the attached ordinance. ANALYSIS: Planning Commission Action on. September 20, 1983: ON MOTION BY ERSKINE AND SECOND BY LIVENGOOD, CODE AMENDMENT NO. 83-23 WAS APPROVED AND RECOMMENDED FOR COUNCIL ADOPTION BY THE FOLLOWING VOTE: AYES: Livengood, Erskine, Higgins, Winchell, Porter, Schumacher, Mirjahangir NOES: None ABSENT: None ABSTAIN: None General Information: Code Amendment No. 83-23 was initiated by the City in order to implement the General Plan designation of Open Space: Water. The following summarizes in general terms the provisions of the "WR" District: Permitted Uses. Private: beaches, boat slips, cantilever decks, and docks. Consistency Determination, Made by the Director of Development Services, Public Works and Community Services for permitted uses, as explained below. .a . PIO 4/81 CA 83-23 October 6, 1983 Page Two Conditional Uses. Examples include public and semi-public: Beaches, docks, marinas, marine fueling, sight-seeing vessels. Discussion: The area seaward of the mean-high tide is currently planned for Open Space: Water. The "WR" District is an appropriate regula- tory mechanism for implementing this planning designation. All of the water area within Huntington Harbor may be subject to the public trust; because of this, every use and structure within the "WR" District will require approvals and/or permits from various public agencies. These. agencies have the ultimate jurisdiction on what uses and structures are acceptable at a particular location. However, the "WR" District gives maximum control over potential development and activities by subjecting them to City review for consistency with the purpose of this District. The "WR" District is a necessary addition to the Huntington Beach Ordinance Code, for without it the City could not implement the Open Space:Water designation within the coastal zone, Environmental Status: Pursuant to Section 15079. 3 of the California Environmental Quality Act, Code Amendment No. 83-23 is exempt from environmental review, FUNDING SOURCE: Not applicable, ALTERNATIVE ACTION: The City Council can deny Code Amendment No. 83-23.
