Street Maintenance Challenges —

Legislative Update
• Senate Bill 649 (Hueso)—Wireless Telecommunication Facilities
• City took an oppose position on April 4, 2017
• Would allow bulky and large cell sites nearly everywhere.
• This proposal would prohibit local discretionary review of"small cell"
wireless antennas, including equipment collocated on existing structures
or located on new"poles, structures, or non-pole structures"
• This bill preempts adopted local land use plans by mandating that"small
cells" be allowed in all zones as use by-right, including residential zones.
• Eliminates In-kind exchanges(e.g. fiber)
• Sets lease rates
• Would go into effect on January ist and would cap lease rates to $350 -
$45o per site
