For Verizon and Time Warner to formally accept the utility substructures constructed as part of the project, agreement(s) transferring ownership of said structures will need to be executed. To avoid construction delays, staff is recommending the City Council approve the transfer of ownership of the utility substructures and delegate the authority to the City Administrator or designee to enter into said agreement(s). REQUEST FOR CITY C®UNCL ACTION MEETING DATE: 2/16/2010 DEPARTMENT ID NUMBER: PW 10-008 Analysis: The Newland Street Widening project includes the placement of overhead utilities underground from Pacific Coast Highway to Hamilton Avenue and on Edison Drive from Newland Street to easterly terminus. Since the project did not include any Southern California Edison (SCE) funds under the Rule 20 utility undergrounding program, the project was processed as Rule 2013, which meant the City was responsible for most of the cost. As part of the scope of the project, underground conduits, vaults, and manholes were installed for the affected utilities (SCE, Verizon, and Time Warner) at the City's cost. As background, Rule 20 includes two main components, Rule 20A and Rule 2013. Rule 20A provides local agencies a certain amount of credits (funding) per year that can be applied to utility undergrounding projects selected by the agency as long as public interest findings are met. Rule 20B applies if an area is not eligible for Rule 20A or if a local Agency cannot or chooses not to rely on the Rule 20A allocation process. Rule 20B allows rate funds to subsidize an undergrounding project by providing credits/discounts towards the cost of an undergrounding project. In November 2007, the City entered into a Rule 20B agreement with SCE. In the agreement, the City agreed to pay for all cabling cost as is required under Rule 2013. The City also authorized the transfer of ownership of substructures to SCE upon acceptance by SCE. Since the City is not required to pay for cabling costs for communication companies, no such agreement was executed for Time Warner and Verizon. Construction of the Newland Widening project is near completion. For Verizon and Time Warner to formally accept the utility substructures constructed as part of the project, agreement(s) transferring ownership of said structures will need to be executed.
