State Board of Equalization, et al. Sacramento County Superior Court Case Nos. 34-2015-00.175631, 34-2015-00175609,34-2015-00175621 and 34-2015-00175627 Dear City Clerk/City Manager: This letter is to notify you of the above -referenced lawsuits that have been filed by Verizon California Inc. against the State Board of Equalization, the County of Orange, and thirty-four other California counties. The complaints seek a refund of state -assessed unitary taxes for the January 1, 2011-2014 lien dates. Please note that these lawsuits are different from the lawsuits you were previously notified of as they are for different tax years. Under the relevant statute, the County is required to give notice of these actions to all cities on whose behalf taxes were collected. Any city receiving notice of the action may, within 30 days of the receipt of the notice, intervene in the action. (Cal. Rev, & Tax. Code § 5148 (b).) Please be advised that these cases will be consolidated and defended by counsel for the State Board of Equalization since the assessments at issue were not done at the local level. If you have any questions about this, please feel free to contact the undersigned. If you are interested in a copy of the lawsuits please let me know or you can access the pleadings on the Court's website www.saccourt.calov. Very truly yours, NICHOLAS S.
