SUBJECT: Follow-up Regarding Removal Of Two Delinquent Civil Fines From
Special Assessments (Continued from June 19th Council Meeting)
At the June 19, 2006 City Council meeting, a resolution was adopted certifying special
assessments for collection of delinquent civil fines for Municipal Code violations on several
properties. Two residents requested the City Council withhold placing a special
assessment on their property due to notification issues and attempts to bring the property
into compliance. The City Council directed staff to further review the resident's claims and
case files and determine the validity of the fines issued to these residents.
Staff reviewed the case files and contacted the residents to further review their claims.
Based upon the residents' information provided, the information in the case files, and
discussions with and the recommendations of the issuing officers, staff has determined that
the mitigating factors have merit. Therefore, the civil citations will be dismissed, and the
properties subsequently removed from the special assessment list. The following is a
summary of staff's findings for each resident:
Mr. Shannon Gallagher, 8532 Glasgow Circle
A code enforcement case was initiated in April of 2005.for dilapidated conditions, including
overgrown vegetation, faulty weather protection, a dangerous structure (patio support post
broken and patio cover sagging), a broken window, and the house was unsecured.
A notice of violation was issued on April 25, 2005 and sent via first class mail to Mr.
Gallagher's home address in Santa Ana. Follow-up inspections were conducted on May
12th, May 23 d, and June 8th, 2005, each time revealing non-compliance and subsequently,
citations were issued. The citations were sent via certified mail, two of which were returned
as unclaimed, and one was not returned and the corresponding return receipt card was
never received back by the City. On June 23, 2005, Code Enforcement obtained a work
phone number for Mr. Gallagher and was able to speak with him regarding his property.
Although Code Enforcement verified his home address in Santa Ana, Mr. Gallagher stated
he was not aware of the condition of his property since he had not received notice from
Code Enforcement. Within four days, the property was brought into compliance, as
observed during an inspection on June 27, 2005.

Based upon Mr. Gallagher's statements, the one certified mail envelope and the return
receipt- card not being returned, and the promptness in which Mr. Gallagher brought his
property into compliance after speaking with Code Enforcement, staff determined that there
exists some doubt as to whether or not notice had been received by Mr. Gallagher.
Therefore, staff has determined the citations should be dismissed and his property removed
from the special assessment list for collection.
Ms. Marie Smith, 8311 Reilly Drive
A code enforcement case was initiated in April 2004 for an illegally converted garage. Code
Enforcement initiated contact and was informed by Ms. Smith that she believed the garage
conversion had been permitted by the City over 20 years ago when her husband converted
it. Code Enforcement and Building Department staff conducted research and were unable
to find any permits for the conversion. Code Enforcement was subsequently contacted by
the resident's nephew, who stated he was an architect and is assisting his aunt in bringing
the garage into compliance and obtaining permits.
Between August 2004 and March 2005, Code Enforcement approved several time
extensions requested by Ms. Smith's nephew to bring the property into compliance. ,Ms.
Smith's nephew continued to request more time extensions after March, however, Code
Enforcement denied the requests since no attempts had been made to bring the property
into compliance. On May 9th, July 8th, and August 17th, 2005, inspections were conducted,
revealing no compliance and no permits issued. Citations were issued after each inspection
and sent via certified mail. On October 11, 2005, Ms. Smith contacted Code Enforcement
to state that her nephew would no longer being doing the work for her. She was lead to-
believe by her nephew that everything was being taken care of and was not aware that
citations had been issued. She further stated that she intended on complying with our
requests to bring the garage into compliance but that she was fighting cancer and would
need additional time. Code Enforcement agreed to work with her and continued to monitor
the case. Since that time, Ms. Smith has continued to make efforts to comply while
receiving treatment for cancer.
Based upon the case file, Ms. Smith's statements, and discussions with and
recommendations from the issuing Code Enforcement Officer, staff has determined that Ms.
Smith was not responsible for the violations at the time the citations were issued. Once she
became aware that no work had been done by her nephew and that citations had been
issued, she began to take action to bring the property into compliance, which continues
today. Therefore, staff has determined the citations should be dismissed and her property
removed from the special assessment list for collection.

Statement of Issue: Should the City record notice of special assessments against private
property for the value of unpaid civil fines, plus interest and penalties, pursuant to Ordinance
#3397 adopted by City Council on June 15, 1998?

Recommended Action Adopt resolution no. D entitled "A Resolution of the City
Council of the City of Huntington Beach certifying Special Assessments for Collection of
Delinquent Civil Fines for Municipal Code Violations."
Alternative Action(s): Do not adopt Resolution No. 2,006 -33
Analysis: In June 1998, City Council adopted Huntington Beach Municipal Code Chapter
1.18, authorizing the issuance of administrative citations that impose civil fines for violation of
the Municipal Code of the City of Huntington Beach. Pursuant to section 1.18.150 of the
Municipal Code, the City may certify certain fines, interest, and penalties as delinquent and
have them collected as special assessments against the real property involved.
Assessments are limited to property related violations wherein the fines exceed $250.00
cumulatively and are sixty days past due. In addition, all hearing or appeal rights of the cited
persons have been exhausted.
At this time, certain administrative citations have been issued on the following property for
housing, building, zoning, nuisance and/or health and safety violations:

The civil fines identified on Exhibit A to this Resolution have not been paid. The fine amounts
would be levied against the properties, non-payment of which would incur penalties and
would appear as an exception to the title on a title report at the time of transfer of the
property. In addition, the fines will be reported to the County Tax Assessor for inclusion on
the property tax bills.
An administrative hearing is required by the Huntington Beach Municipal Code Chapter 1.18.
Only property owners are entitled to speak at the administrative hearing. All other interested
parties may speak at the regular public comment portion of the meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH CERTIFYING
SPECIAL ASSESSMENTS FOR COLLECTING DELINQUENT
CIVIL FINES FOR MUNICIPAL CODE VIOLATIONS
WHEREAS, the City Council has adopted Huntington Beach Municipal Code 1.18 which
authorizes the issuance of administrative citations that impose civil fines upon persons who
violate the Municipal Code of the City of Huntington Beach; and
WHEREAS, certain administrative citations have been issued and the civil fines imposed
thereby have not been paid by the responsible persons who committed the Municipal Code
violations; and
WHEREAS, section 1.18.150 of the Municipal Code provides that certain delinquent
fines, interest and penalties may be collected as part of the nuisance abatement procedures
authorized by Government Code section 38773.5; and
WHEREAS, the City Council wishes to certify certain fines, interest, and penalties as
delinquent and have them collected as special assessments against the real property involved,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City-of Huntington
Beach as follows:
1. The City Council held an administrative public hearing on June 19, 2006, which
was properly noticed as required by Government Code section 38773.5, for the purpose of
certifying special assessments against properties where public nuisances have occurred.
2. The special assessments designated on Exhibit A, which is attached and
incorporated herein by this reference, are hereby certified as being delinquent civil fines, interest
and penalties owing to the City of Huntington Beach and qualified for collection as special
assessments under section 1.18.150(c).
3. The City Council as part of the City's nuisance abatement program orders that
these delinquent fines, interest and penalties are to be collected as special assessments against the
respective properties shown on Exhibit A pursuant to the provisions of Municipal Code section
1.18.150 and Government Code section 38773.5.
4. Pursuant to such authority, the City Treasurer is directed to take the requisite steps
for recording notice of such assessments against the respective properties in the property records
of the County of Orange and for obtaining the collection of such assessments by the Tax
Collector of the County of Orange.

5. The City Treasurer is also authorized to take the necessary steps to have releases
filed with the County Recorder when any such special assessments have been paid.

garage to house, broken glass window on left side of house, and is a public nuisance.
2- You must resecure the house immediately.
Remove the dead fatlen tree and repair/replace the damaged support post immediately. -
Cut/mow all overgrown vegaetation.
