Mayor Mays called the regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 7 p.m. ROLL CALL PRESENT: MacAllister, Winchell , Green, Mays, Bannister, Silva, Erskine ABSENT: None (City Council) PUBLIC HEARING - PUBLIC NUISANCE DECLARED - ABATEMENT ORDERED - 211-6TH STREET (570.60) The Mayor announced that this was the day and hour set for a public hearing pursuant to Huntington Beach Municipal Code S.17.10.010 to determine whether certain premises situated in the City of Huntington Beach, State of California designated as 211-6th Street constitutes a public nuisance subject to abatement by the rehabilitation of such premises or by the repair or demolition of buildings or structures situated thereon. Legal notice as provided to the City Clerk' s Office by staff had been mailed, published, and posted. No communications or written protests were received on the matter. The Community Development Director presented a staff report. Sarah Lazarus, Deputy City Attorney, reported on the matter. Mike Strange, Senior Planner, presented a staff report with slides. The Mayor declared the public hearing open. Jack Herrell stated he was the neighbor and complained of vagrancy, fires, and recommended the structure be torn down. Loretta Wolfe stated she lives in the neighborhood and requested the destroyed structure be demolished. There being no one present to speak on the matter and there being no protests filed, either oral or written, the hearing was closed by the Mayor. Page 2 - Statement of Action - 2/20/90 A motion was made by Erskine, seconded by Green, to declare the structure a public nuisance based on findings set forth on the February 20, 1990 RCA and require the property owner to abate the public nuisance by posting a bond for demolition. Rehabilitation must begin within thirty (30) days of council action and must be completed by August 27, 1990 or the bond will be exercised and demolition will occur. The motion carried by the following roll call vote: AYES: MacAllister, Winchell , Green, Mays, Bannister, Silva, Erskine NOES: None ABSENT: None The City Attorney advised Council of the necessity to include additional findings other than those in the staff RCA. A motion was made by Erskine, seconded by Winchell , that the council has had evidence in form of slides and testimony of the public who live in the vicinity of the structure, that the property is extremely dilapidated, is unsafe, is unhealthful , is a site for vagrance subject to fire, subject to vandalism, is a threat to the security of the area, and for all of those reasons the council has .sufficient findings to declare the property a public nuisance and to seek its immediate demolition. Discussion was held regarding the word "immediate" demolition due to procedures which must be followed and Councilman Erskine stated the motion was not to change the recommended action but to cite the urgency. The motion made by Erskine, seconded by Winchell , that the council has had evdidence in form of slides and testimony of the public who live in the vicinity of the structure, that the property is extremely delapitated, is unsafe, is unhealthful , is a site for vagrance subject to fire, subject to vandalism, is a threat to the security of the area, and for all of those reasons the coun has sufficient findings to declare the property a public nuisance and to seek its immediate demolition carried by the following roll call vote: AYES: MacAllister, Winchell , Green, Mays, Bannister, Silva, Erskine NOES: None ABSENT: None Mayor Mays adjourned the regular meeting.of the City Council and the regular meeting of the Redevelopment Agency of the City of Huntington Beach to 5:30 p.m. , Monday, March 5, 1989, to Room B-8, Civic Center. Since that time, the structure has become a haven for transients and has twice been set on fire by them. On two (2) separate occasions, Mr. Cade, property owner, has hired a contractor to ostensibly repair the building and fence in an attempt to exclude the transient element . On each occasion, the contractor did minor repair work, but improvement to the building was not completed and the fence is still in disrepair. RECOMMENDATION• After receiving testimony, declare the structure a public nuisance based on findings set forth herein and require the property owner to abate the public nuisance by posting a bond for demolition. Rehabilitation must begin within thirty (30) days of council action and must be completed by August 27, 1990 or the bond will be exercised and demolition will occur. ANALYSIS: Property Owner: Merle E. Cade 827 Frankfort Avenue Huntington Beach, CA 92648 Property Location: 211 6th Street Lots : 2 - 25 foot x 117 . 5 foot lots Zone: Downtown Specific Plan District 4a General Plan: Mixed Use Office/residential P10 5/85 J DISCUSSION: This property has been causing problems to neighbors and to the City for about one and a half years. It has been a haven for transients and, on at least two occasions, the transients have been thought to be responsible for fires in the residence. On two occasions during this period, Mr. Cade has hired a contractor to remodel the residence. The first contractor conducted some minor clean-up work to the fire damage only. The second contractor procured remodel permits, stripped the residence of all siding and drywall, and cleaned up the trash and debris. That is the extent of the work that has been conducted. Mr. Cade .has stated that he wishes to remodel the residence and obtain income from the property as the oil well will produce for some time to come and is leased out. ENVIRONMENTAL STATUS: Exempt - pursuant to Class 1 Section 15301 of the California Environmental Quality Act. FINDINGS FOR PUBLIC NUISANCE: 1. The structure located at 211 6th Street in it ' s existing state of disrepair is detrimental to the public health, safety and welfare of the neighborhood. 2. The structure is not secured to prevent entry, thus creating an attractive nuisance, and has become a home for transients . FUNDING SOURCE: General funding will be required for finances needed to demolish the existing building. To be refunded by tax lien on the property.
