Item Submitted by Council Member Peterson and Council Member Posey for the May 2, 2016, City Council Meeting — Requiring Residential Properties Providing Commissioned Recovery, Health, and/or Medical Services to Comply with State and Federal Laws STATEMENT OF ISSUE: Our City embraces diversity in our businesses and residential neighborhoods. Some of our residential housing is home to recovery, healthcare, and assisted living for the disabled and other members of our community in need. In order to preserve and maintain the integrity, quality, standards, and order of our residential communities and to ensure the public's safety and accessibility to recovery and commissioned health services provided in residential units, the following is recommended: RECOMMENDED ACTION: Direct the City Attorney to conduct the necessary research to explore options available to the City to require residential properties providing recovery, health, and/or medical services (for rent(s) and/or fee(s)) to comply with all applicable State and Federal laws (including ADA requirements for the disabled). Those residences providing such commissioned services shall also be required to obtain a City permit and be subject to City inspection. Once the options have been identified by the City Attorney, the City Attorney shall prepare an Ordinance to accomplish such compliance. xc: Fred Wilson, City Manager Ken Domer, Assistant City Manager Joan Flynn, City Clerk Michael Gates, City Attorney Recommended Action: Approve for introduction Ordinance No. 4085, "An Ordinance of the City of Huntington Beach Amending Section 7.14.030 of the Huntington Beach Municipal Code Relating to the Performance of Wild or Exotic Animals for Public Entertainment or Amusement." Approved 6-0-1 (O'Connell Out of Room) 19. Approve for introduction Ordinance No. 4088 amending Section 10.60.020 of the Huntington Beach Municipal Code (HBMC) relating to Meter Zones by bringing Pier Plaza parking lot into compliance with other parking meter zone hourly rates Recommended Action: Approve for introduction Ordinance No. 4088, "An Ordinance of the City of Huntington Beach Amending Section 10.60.020 of the Huntington Beach Municipal Code relating to Meter Zones." Approved 5-2 (Posey, Peterson — No) LMEMBER 20.
