ALLISON FOR REMNANT PROPERTY AT 407 DELAWARE STREET Statement of Issue, Funding Source, Recommended Action,Alternative Action(s),Analysis, Environmental Status,Attachment(s) Statement of Issue: In 1984, the City of Huntington Beach vacated a portion of the street adjacent to 407 and 413 Delaware Street and redesigned the intersection of Delaware Street and Detroit Avenue. As part of that process, the City quitclaimed most of the excess property to the adjacent owners. In an apparent oversight, a small triangular portion of Lot 3 in front of 407 Delaware Street was not quitclaimed and is still owned by the City. The current owners of the property are requesting that the City quitclaim the remaining portion of Lot 3 to them. The property has no economic value to the City. Funding Source: Not applicable. Recommended Action: Approve the Quitclaim Deed for that portion of Lot 3 in Block 404 of the "Vista Del Mar Tract, Section 2" as set forth in the attached legal description, and authorize the Mayor and the City Clerk to notarize and execute the Quitclaim Deed and any and all documents necessary to conclude this transaction. Alternative Action(s): Do not authorize the approval and execution of the Quitclaim Deed. , i.zly sis: l:1 1984, as part of Resolution No. 5408, the City of Huntington Beach vacated a :,Mal: portion of the street adjacent to 407 and 413 Delaware Street as part of an overall redesign of the intersection of Delaware Street and Detroit Avenue. The City quitclaimed most of the excess property to the adjacent owners at that time. In an apparent oversight, it appears that the City overlooked a small triangular shaped parcel adjacent to 407 Delaware Street. The parcel, as shown in Attachment 1, is approximately 150 square feet in size and has no economic value to the City. It is improved with a driveway curb cut and has been utilized for this purpose for many years. -197Delaware -- 1/15/2003 3:59 PM REQUEST FOR COUNCIL ACTION MEETING DATE: February 3, 2003 DEPARTMENT ID NUMBER: AS 03-01 Randy J. and Deborah R. Allison recently purchased the property at 407 Delaware Street. During escrow, their title company discovered that the City owned the remnant triangular parcel. Since it does not have its own parcel number, staff was unaware that the City owned it until the Allisons contacted them. The Allisons have requested that the City quitclaim the parcel to them at no cost, since it does not have any economic value to the City, nor does it contain any mineral rights. In addition, it appears that this parcel should have been quitclaimed to the adjacent property owner in 1984 when the street project was underway. The Director of Administrative Services, the Real Estate Services Manager and the City Attorney's office concur with the recommendation to quitclaim this parcel at no cost to the Allisons.
