At the last Council meeting the bid award was made to Inspection Engineering.
On May 16, 2003 the original grant deed from the Grammar School District of H. B. to the City was returned from the
County Recorder for correction as to how the Grammar School representatives had signed. I transmitted the original deed
to the City Attorney's Office on May 16, 2003 so that direction could be given to Administrative Services on how to get the
deed in order.
I have not received a reply as to the date the deed will be corrected so that the County will be able to record it.
I am informing you in case it may have a bearing on when the contractor can start.
Please advise me as to whether the execution of the CC contract can proceed even though the deed has not been
recorded

Statement of Issue: Acceptance of property located at the east corner of 17th Street and
Palm Avenue will allow for design and construction of street improvements and signal poles
at their ultimate configuration, for the Safe Routes to School project.
Funding Source: Not required for this action.
Recommended Action: Motion to:
1. Authorize the City Clerk to accept, record and file the Huntington Beach Grammar School
District Grant Deed.
Alternative Action(s): Do not accept the Huntington Beach Grammar School District Grant
Deed and direct staff on how to proceed with the project. Not accepting the Grant Deed
would result in the construction of the improvements within a constrained area, impacting
design.
Analysis: In May 2001, the City submitted an application to Caltrans under the Safe Routes
to School Program, requesting 90% funding for design and construction improvements
associated with the Agnes L. Smith Elementary School Enrollment Area Improvements
Project. In November 2001, Caltrans approved the application and authorized grant funds in
the amount of $237,000 for the project. /

REQUEST FOR COUNCIL ACTION_

With full support from Huntington Beach City School District, staff prepared the necessary
documents to acquire approximately 136 square feet of additional right of way on the east
corner of 17th Street and Palm Avenue. The acquisition comes at no cost to the City and will
accommodate the operational and future traffic signal equipment at the intersection.
The project's estimated cost for design and construction is $264,000. Measure M will provide
matching funds of approximately $27,000. The construction phase consists of various types
of street improvements at numerous locations within the Agnes L. Smith Elementary School
enrollment area. Improvements will consist of street, intersection and signal improvements;
curb and gutter; sidewalk; curb ramps; traffic loops; signage and striping. Construction will
be scheduled for the summer.
Public Works Commission: Not required for this action. Upon completion of the street and
signal improvement plans, staff will submit the project's construction plans to the Public
Works Commission for its review and approval.
Environmental Status: This project is Categorically Exempt pursuant to the California
Environmental Quality Act, Class 3, Section 15303.

The Temporary Construction Easement is hereby granted to the City of Huntington Beach, or its
authorized agent, specifically for the purpose of completing improvements to the northeast
corner of the intersection of 17th Street and Palm Avenue in the City of Huntington Beach per the
project plans and described in Exhibit"C"attached hereto.
The Temporary Construction Easement is granted to facilitate the construction of
improvements as part of the"Safe Route to Schools"program. The location,
improvements, and construction of such improvements and incidentals thereto; also, the
construction and improvements are required by the City of Huntington Beach to complete
the project.
The Temporary Construction Easement shall terminate upon completion of the
improvements as detailed by the street improvement plan referenced above.
The City of Huntington Beach agrees to repair any damages caused by the use of the property by
the City of Huntington Beach at its sole cost and expense, and to restore said property as nearly
as practicable to the state in which it existed prior to the use of the property by the City of
Huntington Beach.
The Temporary Construction Easement granted by the owner of the said property to the City of
Huntington Beach, and its agents or representatives, is personal and the City of Huntington
Beach agrees not to assign, transfer, lease, pledge, surrender or otherwise dispose of its
Temporary Construction Easement without the prior express written approval of the owner of
said property.
