ENGLE, DIRECTOR, COMMUNITY SERVICE6f SUBJECT: APPROVE CITY AND AGENCY RESOLUTIONS AUTHORIZING SHARED PURCHASE OF MAIN PROMENADE PARKING STRUCTURE VEHICLE COUNTER Statement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: There is a need to provide an electronic vehicle counter at the Main Promenade Parking Structure to inform the public when the parking structure is full or nearing full capacity. The counter would provide better customer service for the public as well as provide more efficient traffic flow within the parking structure. As the Main Promenade Parking Structure is in the Downtown Redevelopment Sub-Area, and as this proposed purchase is a valid use of Redevelopment Agency funds, a shared purchase between the City and Agency is possible. Funding Source: $20,000 allocated from the FY 05-06 General Fund Account #10045202 for Community Services; and $20,000 from FY 06-07 monies budgeted in Account #30580101.69505 for the Redevelopment Agency. The Agency portion of funding requires an authorizing resolution. Recommended Actions: Motions to: City Council: Adopt Resolution No. 2006- 6,3 : A Resolution of the City Council of the City of Huntington Beach Consenting to the Payment by the Redevelopment Agency of the Cost Associated with the Purchase and Installation of an Electric Parking Space Counter and Two Reader Boards for the Main Promenade Public Parking Structure and Making Certain Determinations and Findings pursuant to Health and Safety Code Section 33445. REQUEST FOR COUNCIL/REDEVELOPMENT AGENCY ACTION MEETING DATE: 10/2/2006 DEPARTMENT ID NUMBER: CS06-016 Redevelopment Agency: Adopt Resolution No. A Resolution of the Redevelopment Agency of the City of Huntington Beach Agreeing to Pay the Cost Associated with the Purchase and Installation of an Electric Parking Space Counter and Two Reader Boards at the Main Promenade Public Parking Structure and Making Certain Determinations and Findings pursuant to Health and Safety Code Section 33445; and, authorize the expenditure of$20,000 for this project. Alternative Action(s): 1. Do not move forward with the purchase of an electronic vehicle counter for the Main Promenade Parking Structure at this time. 2. Direct staff to utilize the General Fund Unappropriated Fund Balance instead of Redevelopment funds as an alternative funding source. Analysis: The Main Promenade Parking Structure continues to grow in popularity. This is especially true in the summer when there will be times of the day when the parking structure is full or near capacity. This creates potential congestion at the entrances to the parking structure on Olive and on Walnut, as well as internally within the structure. Even though "FULL" signs are physically put out in front of the entrances, the public still desires to drive into the parking structure to look for potential open spaces. The parking structure would operate more effectively if those persons wishing to enter were aware of how many spaces were still available. This can be accomplished by having electronic reader boards above both entrances to the parking structure; the boards would indicate the number of spaces that are still available within the parking structure. This would not only provide better customer service for the public, but also would permit the parking structure to operate in a more effective and efficient manner. The cost to purchase and install these electronic counters and reader boards at both entrances is $40,000. There is $20,000 available within the Community Services budget, but an additional $20,000 in Redevelopment funds would need to be made available. Environmental Status: Not applicable. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH CONSENTING TO THE PAYMENT BY THE REDEVELOPMENT AGENCY OF THE COST ASSOCIATED WITH THE PURCHASE AND INSTALLATION OF AN ELECTRIC PARKING SPACE COUNTER AND TWO READER BOARDS AT THE MAIN PROMENADE PUBLIC PARKING STRUCTURE AND MAKING CERTAIN DETERMINATIONS AND FINDINGS PURSUANT TO HEALTH AND SAFETY CODE SECTION 33445 WHEREAS,the Redevelopment Agency of the City of Huntington Beach(the"Agency")is engaged in activities necessary to carry out and implement the Redevelopment Plan for the Merged Redevelopment Project Area(the"Project Area") of the City of Huntington Beach; and Pursuant to Section 33445(a)of the California Community Redevelopment Law(Health& Safety Code Section 33000 et seq.)("CRL"),the Agency may, with the consent of the City Council (the"City Council")of the City of Huntington Beach(the"City"),pay all or part of the value of the land for and the cost of the installation and construction of any facility, structure, or other improvements which is publicly owned either within or outside a project area, if the City Council makes certain determinations; and The Agency desires to pay all or part of the cost associated with the purchase and installation of an electronic parking space counter and two(2)reader boards(the"Improvements")at the Main Promenade Public Parking Structure(the "Parking Structure"),which is located within the Project Area; and It is in the best interests of the City and for the common benefit of residents, employees, business tenants and property owners within the Project Area and the City as a whole for the Improvements to be purchased and installed at the Parking Structure; and Since there are no other reasonable means available to the City to finance the purchase and installation of the Improvements at the Parking Structure, the Agency proposes to pay all or part of the cost associated with the purchase and installation of the Improvements; and The Agency's agreement to pay all or part of the value of the cost associated with the purchase and installation of the Improvements constitutes an indebtedness of the Agency for the purpose of carrying out the redevelopment for the Project Area; and 1 Reso . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AS FOLLOWS: 1. The City Council hereby finds and determines that the foregoing recitals are true and correct. 2. Based on substantial evidence in the record, the City Council hereby finds and determines that: a. The purchase and installation of the Improvements is of benefit to the Project Area and the immediate neighborhood in which the Parking Structure is located and is consistent with the goals of the Five-Year Implementation Plan for the Project Area, including, without limitation, the goal of improving public facilities. This determination is based, in part, on the fact that the purchase and installation of the Improvements is in the best interests of the City and the health,safety,and welfare of its taxpayers,employees,business tenants,property owners and residents. The purchase and installation of the Improvements will benefit all employees, business tenants and property owners of the Project Area, as well as the residents, employees, business tenants and property owners of the City; b. No other reasonable means of financing the purchase and installation of the Improvements are available to the City. This determination is based,in part, on the fact that the City itself is not in a position to finance the purchase and installation of the Improvements. Without the assistance of the Agency, the purchase and installation of the Improvements would not be feasible;and C. The payment of funds by the Agency for the costs related to the purchase and installation of the Improvements will assist in the elimination of one or more blighting conditions within the Project Area and is consistent with the Agency's Five-Year Implementation Plan for the Project Area. This determination is based,in part,on the information contained in paragraph a., above. 4. The City Council hereby consents to payment by the Agency for costs of the purchase and installation of the Improvements as agreed upon and directed by the Agency Executive Director(or her designee). 4. The City Administrator(or her designee)is authorized to take any action and execute 2 R so. No . 2006-63 any and all documents and agreements necessary to implement this Resolution. 5. This Resolution shall take effect immediately upon its adoption.
