The City acquired several lots to widen Boise Chica Street. The remnant usable portion of two lots, 1,620 sq. feet, are a burden to the City. Public Works Department would like to surplus and grant this remnant portion to the contiguous property owner. The contiguous owner, Sharar, is willing to accept the liability for this remnant parcel. A negative finding of the Planning Commission has been rendered (copy attached) 2. When Parcel AP #178-222-14 (see plat map) was developed the street improvements were installed, however, an easement deed was not recorded by the developer. The proposed easement deed from E. C. Sharar to the City will correct this oversight. Funding Source: $100 Transfer Fee to be paid to the City. $7,000 estimated street improvement and cost from Account #E-SF-PW-895-6-32-00. Recommended Action: 1) Declare the parcel AP #178-222-13 surplus to the City of Huntington Beach. 2) Grant the parcel AP #178-222-13 to Sharar and request the Mayor and City Clerk to execute and record the document. 3.) Accept the conditions contained in the letter agreement (see attachment #1). 4) Accept the Easement Dr,'d AP #178-222- 14 from Sharar and ,hor i ze the City Clerk to record same with the Orange County Recorder . ktQUEST FOR COUNCIL ACTION MEETING DATE: November 18, 1996 DEPARTMENT ID NUMBER: AS 96-024 Alternative Action(s): 1) Do not accept easement deed. 2) Do not grant deed to contiguous owner, fence off area to prohibit dumping and maintain landscaping at City expense. Analysis: Residents in the neighborhood are complaining about the narrow strip of land, owned by the City that is often used as a dumping ground or parking for various vehicles, often with for-sale signs on them. It is the only parcel on the street without a sidewalk or landscaping. Public Works does not desire to fund for the maintenance cost or the liability for the remnant parcel. The adjacent property owner (Sharar) is willing to accept the City owned remnant under the conditions described in the attachments. Two prior owners of the Sharar property were unwilling to accept the City owned parcel. The recommendation would remedy any Public Works problems and place the property on the tax rolls. Attached to'this letter are the Findings and Conditions of Approval for this application. Please be advised that the Planning Commission reviews the conceptual plan as a basic request for entitlement of the use applied for in relation to the vicinity in which it is proposed. The conceptual plan should not be construed as a precise plan reflecting conformance to all Zoning and Subdivision Ordinance requirements. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing of your total application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning (pcc1054-21) • Commission is final unless an appeal is filed to the City Council by you or an interested party. Said appeal must be in writing and must set forth in detail the actions and grounds by and upon which the applicant or interested party deems himself aggrieved. The proposed vacation of 1,619.54 square feet of surplus land conforms with the following goals, objectives, and policies of the Land Use and Circulation Element of the General Plan: Land Use Element Policy 3.4.2.1 Develop and maintain high standards of visual beauty within all areas of the City. The proposed vacation of 1,619.54 square feet of surplus land will allow a consistent street scene to be developed on both the east and west sides of Bolsa Chica Street. A consistent street scene provides continuity and helps to create identity for the neighborhood. The landscaped area proposed will help to maintain a high standard of visual beauty on Bolsa Chica Street. The proposed vacation of land will prevent the illegal dumping and parking on this site, by allowing the adjacent owner to develop and utilize the area. Policy 3.4.2.7 - 1 Encourage the rational use of land and other natural resources. The proposed vacation of 1,619.54 square feet of City maintained surplus land allows the adjacent property owner to assume responsibility for maintenance of the property. This will allow the City to save maintenance costs and utilize landscape maintenance personnel in a more efficient manner. This will also eliminate a vacant property that is used for illegal parking and dumping. Circulation Element Policy 3.1.2.2 Develop a system of arterial streets and highways that ensures the safe and efficient movement of people and goods. The proposed vacation of 1,619.54 square feet of surplus land will maintain a safe and efficient movement of pedestrian and vehicular traffic by providing a eight foot sidewalk, with curb and gutter. This will allow pedestrians to walk safely on the sidewalk and not on the street. (pcc1054-23) RESOLUTION NO. 1514 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH FINDING THAT THE VACATION OF 1,619.54 SQUARE FEET OF PROPERTY ON THE NORTHWEST CORNER OF BOLSA CHICA STREET AND PEARCE AVENUE TO BE IN CONFORMANCE WITH THE GENERAL PLAN (GENERAL PLAN CONFORMANCE NO. 96-1) WHEREAS, the Government Code of the State of California, Section 65402, provides that a local agency shall not acquire real property, nor dispose of any real property, nor construct a public building or structure in any county or city until the location, purpose, and extent of such activity has been reported upon as to conformity with the adopted General Plan; and WHEREAS, staff has reviewed the description of the proposed vacation of the parcel, as depicted on Exhibit A(attached), and generally described as a 1,619.54 square foot portion of surplus land on the northwest corner of Bolsa Chica Street and Pearce Avenue. NOW, THEREFORE, BE IT RESOLVED, the Planning Commission of the City of Huntington Beach does hereby find and resolve as follows: SECTION 1: The proposed vacation of 1,619.54 square feet of surplus land conforms with the goals, objectives, and policies of the Land Use and Circulation Element of the General Plan.
