Funding Source: Not Applicable. Recommended Action: Motions to: Redevelopment Agency (1) Approve and authorize the Chairman and the Agency Clerk to execute the "Easement Deed." City Council (1) Direct the City Clerk to affix the City's deed acceptance and record with the Orange County Recorder. Alternative Action(s): (1) Deny the recommended actions. Analysis: The Revelopment Agency of the City of Huntington Beach entered into a Disposition and Development Agreement (DDA) with Mayer Financial, LTD. (developer) for the parcel located at the intersection of Beach Blvd. and PCH (See Exhibit C of Attachment #1) on approximately September 14, 1998. In summary, Attachment #4, Section III of the DDA states that the Agency shall take all necessary steps and sign all necessary documents in REQUEST FOE..--;OUNCIL/REDEVELOPMEN'%_- _ ,GENCY ACTION MEETING DATE: May 15, 2000 DEPARTMENT ID NUMBER: AS 00-023 Analysis: cont'd recordable form to create, move, or abandon easements and rights of way as may be required by the City. Specifically, the Agency will provide easements to facilitate the construction of any pedestrian overpass contemplated by the approved Commerial Site Master Plan for the development of the Site. A pedestrian overpass has been approved as part of the Site Plan and the granting/approval of the overpass easement is the first step in a series of actions which will be required to secure all rights and permits necessary to construct the overpass. The City and Mayer Financial, LTD. are currently in negotiations to complete a Landscape License Agreement which will cover the responsibilities associated with the pedestrian overpass.
