[ ] Yes [ ] New Policy or Exception Statement of Issue, Recommendation, Analysis, Funding Source, Alternative.Actions, Attachments: i STATEMENT OF ISSUE: Staff is nearing completion of negotiations with Coultrup Development Company, et al for the development of a condominium project on Block 105 downtown. In order to complete property acquisition and proceed with the proposed project it will be necessary to acquire the property located at 504-506 Pacific Coast Highway. RECOMMENDED COUNCIL/AGENCY ACTION: Direct staff to initiate negotiations with the property owners for the acquisition of the subject property located at 504-506 Pacific Coast Highway (AP# 024-152-11 & 12), consistent with the property appraisal. ANALYSIS: The Redevelopment Agency entered into an Exclusive Negotiation Agreement (ENA) with Coultrup Development Company and the Main-Pier Phase II Property Owners' Association on July 15, 1991. Although that ENA has expired, the Agency has agreed to let staff continue to negotiate with the developer on the premise that good faith progress was being achieved. As it stands to date, the developer has turned in his submittal. for entitlements and is scheduled to go before the Planning Commission for consideration on August 4, 1992. Negotiations with the developer for the Disposition and Development Agreement are anticipated.to be completed by the end of August. In order to move forward with the proposed project it .is necessary to acquire 504-506 Pacific Coast Highway- in a timely fashion. Staff has had the subject parcel. appraised and.is ready to commence negotiations for acquisition. The property owners were given an opportunity to respond under a Request for Proposals for development of the two block area and declined to participate. P10/1/85 Further, should the proposed Coultrup project not go forward for whatever reason, staff would note that the acquisition of this property is, nonetheless, strategically very important in that without this parcel it is not economically feasible to develop the parcels the Agency already has acquired on Block 105. . FUNDING SOURCE: Budgeted Main-Pier Phase II Land Acquisition Account No. E-TM-ED-909-6-10-00. This parcel is critical to the project and requires public acquisition to complete a needed redevelopment project in the Main-Pier Redevelopment Project Areas, as amended. This parcel will result in the least private injury for reasons to be articulated at the public hearing. RECOMMENDATION: Conduct and conclude the noticed hearing and adopt the attached Resolution of Necessity (Agency Resolution No. AFY). Lots 4 & 5, Block 105 of the Huntington Beach Tract Assessor Parcel 024-152-10. ANALYSIS: The Agency has been attempting to purchase and consolidate parcels in the Main-Pier Redevelopment Project Area to accommodate a planned development project. After attempts to acquire this property acquisition, this key parcel now requires condemnation. The adoption of a Resolution of Necessity will authorize the acquisition of this parcel by eminent domain, which will allow the development to proceed as proposed in the Main-Pier Redevelopment Project Area. FUNDING SOURCE: Main-Pier Account No. E-TM-ED-810-6-01-00. ALTERNATIVE ACTION: Do not adopt the Resolution of Necessity and continue negotiations with property owners. This parcel is critical to the project and requires public acquisition to complete a needed redevelopment project in the Main-Pier Redevelopment Project Areas, as amended. This parcel will result in the least private injury for reasons to be articulated at the public hearing. RECOMMENDATION: Conduct and conclude the noticed hearing and adopt the attached Resolution of Necessity (Agency Resolution No. L±5J. Lot 17, Block 104 of the Huntington Beach Tract Assessor Parcel 024-153-07. ANALYSIS: The Agency has been attempting to purchase and consolidate parcels in the Main-Pier Redevelopment Project Area to accommodate a planned development project. After attempts to acquire this property acquisition, this key parcel now requires condemnation. The adoption of a Resolution of Necessity will authorize the acquisition of this parcel by eminent domain, which will allow the development to proceed as proposed in the Main-Pier Redevelopment Project Area. FUNDING SOURCE: Main-Pier Account No. E-TM-ED-810-6-01-00. ALTERNATIVE ACTION: Do not adopt the Resolution of Necessity and continue negotiations with property owners. This property is located within Phase II of the downtown Redevelopment Plan. My client is in receipt of the letter of October 26 , 1989 , from the office of the City Attorney, giving the notice as required by Section 1245. 230 of the California Code of Civil Procedure. Pursuant to such notice, my clients request to be heard at the public hearing set for November 20 , 1989, at 7 :00 P.M. My clients object to the City taking any action at this time leading to eminent domain proceedings with respect to their property. They have consistently represented, both in writing and in conferences with representatives of the Redevelopment Agency from time to time , that they wish to, intend to, and are well qualified to participate as an owner within the planned project, either through rehabilitation of their present structures or pursuant to construction of new buildings on the land owned by them, all pursuant to reasonable guidelines as required by the City or any other appropriate governmental agencies. This property was previously owned by Mr. J.P. Terry and C. Victor Terry, the grandfather and father of Victoria Lane, who with her husband are now the present owners of this property. Thus, this property has been in the Terry family for many, many years. Both J.P. Terry and C. Victor Terry were members of the City Council of Huntington Beach , and C. Victor Terry was the Mayor of this city from the period 1956 to 1958 . It is the earnest desire that this property continue to be kept in their family.
