SUBJECT: Approve four (4) Quit Claim Deeds for a previously vacated portion of Baltimore
Avenue, east of Huntington Street
Statement of Issue:
The City Council is asked to approve the release, through a quit claim deed, of its former interest in
a portion of Baltimore Avenue that was vacated in 1984 through Resolution 5352. The portion of
vacated Baltimore Avenue subject to this release is east of Huntington Street.
Financial Impact:
Not applicable.
Recommended Action:
A) Approve the release of any interest in a portion of vacated Baltimore Avenue; and,
B) Authorize the Mayor and City Clerk to execute the four quit claim deeds and any other related
documents.
Alternative Action(s):
Do not approve the release and direct staff as necessary.
Analysis:
On February 6, 1984, the City Council passed Resolution 5352 vacating a City street over the
portion of Baltimore Avenue east of Huntington Street (attached map). The property has remained
vacant since the City vacated the.street.
Over the years there have been various issues regarding who owns the property after the street
vacation. However, because the size and shape makes the property independently undevelopable
no one pursued ownership. More recently one of the adjoining owners wanted to add a portion of
the property to his existing lot. He requested that the City sell to him the portion of the vacated
street. However, since the City had vacated the street and technically does not own the parcel, the
City could not sell him the site.
The City obtained a Preliminary Title Report to verify ownership in the vacated area. The report
showed the vacated street is owned by the three adjoining property owners. However, to be sure
that the City retains no interest or obligations to these owners the City Attorney opined that the City
provide a quit claim deed to each adjoining owner to ensure the City has no rights, title or interest in
the land, nor obligations to the adjoining owners.

Therefore, three quickclaim deeds are needed for the adjoining owners. One for the apartment
complex to the south, Playa Mediterranean; one for the,single family residence to the west, 313
Baltimore; and one for the condominium association to the north, Las Brisas Community
Association, for the transfer of the parcel (5,622 square feet total) located east of the eastern
terminus of Baltimore Avenue (formerly a portion of Baltimore Avenue), vacated by resolution No.
5352.
A fourth quickclaim deed is needed for the single family residence at 313 Baltimore to transfer a
1.02 foot wide strip of land within APN 024-261-22 between parcels 2 and 3, that was not deeded at
the time the parcels were sold to the current owner by the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
.OF HUNTINGTON BEACH ORDERING THE VACATION OF
A PORTION OF BALTIMORE AVENUE, EAST OF
HUNTINGTON STREET
TWHEREASI, on January 3, 1984 the City Council of the City of
Huntington Beach duly adopted Resolution No. 5340 declaring
its intention to vacate a portion of Baltimore Avenue., east of
Huntington Street , and referring to maps or plans on file in the
office of the City Clerk for particulars as to the proposed va-
cation; and
Said resolution fixed the time and place of February 6 , 1984
at the hour of 7 : 30 P.m. , or as soon thereafter as the matter
could be heard, in the Council Chambers in the Civic Center, for
hearing allpersons interested in or objecting to the proposed
vacation., which time was not less than fifteen (15) days from
the passage of said resolution. Notices of the proposed vaca-
tion were posted conspicuously along that portion of Baltimore
Avenue proposed to ..be vacated, and such notices were posted not
more than three hundred ( 300) feet apart and at least three (3)
were posted,
On February 6 , 1984 at the hour of 7:30 p.m. , in the Council
Chambers in the Civic Center, the City Council of the City of
Huntington Beach did convene for the purpose of hearing all per-
sons interested in or objecting to the proposed vacation of
a portion of Baltimore. Avenue, east of Huntington Street , at which
time no objection was made to said vacation, and evidence was pre-
sented showing that such portion of Baltimore Avenue is not nec-
essary for present and prospective public street purposes and is
not suitable for use or development as bicycle paths or routes.

Streets and Highways Code, . commencing with Section 8320, does
resolve that the portion of Baltimore Avenue. proposed, for vacation
is not necessary for present or prospective public street pur-
poses, and is not suitable for use or development as bicycle
paths or routes, and it is hereby
ORDERED that a portion of Baltimore Avenue, east of Huntington
Street, be and the same is hereby vacated; and the portion of
Baltimore Avenue so vacated is more particularly described as
follows:
That portion of Baltimore Avenue, 36. 38 feet
wide,, bounded on the east by Lot 116 of Tract
No. 10248 , as shown on a map recorded in
Book 45.0, pages 14 to 17 inclusive,, of
Miscellaneous Maps, records of Orange County;
on the north by the easterly extension of the
southerly line of Lot 1, Block 203 of the Vista
del Mar Tract, as shown on a map recorded in
Book 4, page 5 of Miscellaneous Maps, records
of Orange County; on the west by the southerly
extension of the westerly line of said Lot 1,
Block 203; and on the south by the northerly
line and its westerly extension, of the land
described in a deed to Beloil Corporation,
Limited, recorded December 19, 1940 in Book 1069,
page 471, Official Records.
The city hereby reserves and excepts from the vacation a
permanent easement and right at any time

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH OF INTENTION TO VACATE A
PORTION OF BALTIMORE AVENUE, EAST OF HUNTINGTON
STREET
The City Council of the City 'of Huntington Beach does
hereby resolve as follows :
SECTION 1. A public meeting, was held before the Planning
Commission on August 16 , 1983 at which time it was determined,
pursuant to Government Code section 65402 , that the proposed va-
cation of Baltimore Avenue , east of Huntington Street, conformed
to the city' s general plan.
SECTION 2. Pursuant to Division 9 , Part 3, Chapter 2 of
the California Streets and Highways Code (sections 8320 et seq. ) ,
the City Council of the City of Huntington Beach hereby declares
its intention to vacate a portion of Baltimore Avenue , east of
Huntington Street more particularly described as follows :
All that certain land situated in the State of
California, County of Orange , City of Huntington
Beach, described as. follows :

SECTION 4. The City Council does hereby fix February 6,
1984 at the hour of 7. 30 p.m. , or as soon thereafter as the
matter may be heard in Council Chambers in the Civic Center,
as the time and place for hearing all persons interested in or
objecting to the proposed vacation, which time is not less than
fifteen (15) days from the passage of this resolution.
SECTION 5. The City Clerk is directed to cause a copy of
this resolution to be published in a weekly newspaper, published
and circulated in Huntington Beach for at least two successive
weeks prior to the time set herein for the public hearing.
SECTION 6. The Director of Public Works is directed to post ,
or cause to be posted , notices of vacation conspicuously along that
portion of Baltimore Avenue proposed to be vacated at least two
weeks before the date of the hearing. The notices shall be posted
not more than 300 feet apart , but at least three notices shall be
posted. The notices shall state the day`; hour, and place of
hearing and shall refer to the adoption of this resolution of in-
tention, and shall describe that portion of Baltimore Avenue
proposed to be vacated, or shall include a map or plan showing
the location of the proposed vacation.
