Statement of Issue: Statement of Issue: The City has been acquiring right-of-way
along Yorktown Avenue between Delaware Street and Beach Boulevard in anticipation of
the subject project. The acquisition of a portion of the residential parcel between Beach
Blvd. and Florida Street, on the south side of Yorktown is necessary to improve the street
and pedestrian access and increase the likelihood of future grant funding for the project.
Funding Source: 94/95 Fiscal Year Community Development Block Grant Funds.
Recommended Action:
1. Authorize the Director of Real Estate Services to acquire for the City a portion of the
property at 704 Yorktown Avenue for an amount not to exceed $180,000,including
Relocation Benefits, and an amount not to exceed $15,000 to cover asbestos mitigation and
demolition, for a total of$195,000.
2. Authorize acceptance of said deed by the City Clerk on behalf of the City at such time
said deed is provided and approved by the City Administrator and the City Attorney.
Alternative Action(s): Forego this right-of-way acquisition.
Analysis: Design is complete for a project which is comprised of a series of spot widening
along Yorktown Avenue, between Delaware Street and Beach Boulevard. The Florida/Utica
Task Force has identified this as an important project. The project is necessary, primarily in
order to establish safe street right-of-way and sidewalk areas for pedestrians so they are not
forced to walk in the bicycle lane on the street pavement. This is the last parcel needing to
be acquired in the first phase of the project adjacent to the Florida intersection.

The City was unsuccessful in applying for outside funding for the project during the last
round of Measure M applications. Therefore, it is anticipated that this $2.4 million project
will be phased over several years. By completing the design and moving ahead with a first
phase of. right-of-way acquisition, future grant applications will stand a better chance of
success. There is $525,000 in 1994/95 Fiscal Year Gas Tax Budget and $250,000 in the
CDBG Budget for this phase of the project. These funds were intended as a possible match
for a grant.
Staff has negotiated an agreement for purchase and relocation benefits of this parcel
needed for right-of-way for $176,720 plus closing costs. Thie amount is equal to the
appraised value of the property $154,220 plus the cost of relocation benefits (mandated
costs ) $22,500. Asbestos mitigation and demolition costs should not exceed $15,500.

65, of Miscellaneous Maps, in the office of the County Recorder of said County described as
follows:
Commencing at the centerline intersection of Yorktown Avenue and Florida Street as
shown on a Parcel Map recorded in Book 73, Pages 7 and 8 of Parcel Maps in the office of
said County Recorder; thence North 890 19' 32" East 30.00 feet along the centerline off
said Yorktown Avenue; thence along a line parallel to the centerline of Florida Street,

Statement of Issue: The City has been acquiring right-of-way along Yorktown Avenue
between Delaware Street and Beach Boulevard in anticipation of the subject project. The
acquisition of the commercial parcel between Beach Blvd. and Florida Street, on the south
side of Yorktown is necessary to improve the street and pedestrian access and increase the
likelihood of future grant funding for the project.
Funding Source: 94/95 Fiscal Year Gas Tax Funds
Recommended Action:
1. Authorize the Director of Real Estate Services to acquire for the City the property at
712 Yorktown Avenue fora total-amount not to exceed $67,000; and
2. Authorize the City Clerk to accept the deed on behalf of the City.
Alternative Action(s): Forego this right-of-way acquisition.

The City has been acquiring right-of-way along Yorktown Avenue between Delaware Street and Beach
Boulevard in anticipation of the subject project. The acquisition of a portion of the parcel at the northeast
corner of Yorktown Avenue and Florida Street is necessary to improve pedestrian access and increase the
likelihood of future grant funding for the project.
RECOMMENDED ACTION:
1. Authorize the Director of Real Estate Services to acquire for the City a portion of the parcel at 705
Yorktown Avenue and relocate tenants for an amount not to exceed $127,000; and
2. Authorize the City Clerk to accept the easement deed on behalf of the City; and
3. Authorize the Director of Public Works to advertise the demolition of the residence and construction of
asphalt walk at 705 Yorktown Avenue and solicit bids for the work; in anticipation of the Yorktown
Street Widening Project, from Delaware Street to Beach Boulevard; CC-884.
ANALYSIS:
Design is nearing completion for the project which consists of a series of spot widenings along Yorktown
Avenue, between Delaware Street and Beach Boulevard. The Florida/Utica Task Force has identified this as
an extremely important project.

The City was unsuccessful in applying for outside funding for the project during the last round of Measure
"M" applications. Therefore, this $2 million project will be phased over several years. That, however, does
not preclude future Measure W' grants. If the City completes the design and moves ahead with a first phase
of right-of-way acquisition, future grant applications will stand a better chance of success.
Prior to the Yorktown widening project, the acquisition of right-of-way at 705 Yorktown is necessary to
establish a safe walkway so that pedestrians are not forced to walk in the bicycle lane on the street pavement.
Staff proposes to remove one of the three houses on the property which encroaches on the ultimate street
right-of-way; relocate the tenants to a"decent, safe and sanitary" residence; demolish the house after the
tenants have relocated; grade the site; and construct a temporary asphalt walk.
ENVIRONMENTAL STATUS:
The Zoning Administrator approved Negative Declaration 93-4. The negative declaration will go before City
Council for approval concurrent with the approval of the plans and specifications for the project.
FUNDING SOURCE:
$165,000 is set aside in Account no. E-SF-PC-890 for right-of-way acquisition, relocation, and building
demolition. It was originally intended as a local match for a grant.
Engineer's estimate:
$92,000 Right-of-way acquisition including closing costs
$35,060 Relocation of tenants
$30,000 Demolition of house
8,000 Grading of site and construction of asphalt walk
$165,000 Total
* Appraised value of the parcel is $90,060. Staff has negotiated with the owner to purchase the parcel at the
appraised value.
