FRANZ, Deputy City Administrator SUBJECT: POSSIBLE SURPLUSING AND SALE OF EXCESS CITY P OPERTY jFsta—temen—tof Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status Attachments) Statement of Issue: Staff was instructed to determine if any City owned real estate has no present or future anticipated use for the City. Five City owned parcels seem to fall into this category. Funding Source: None Recommended Action: Approve the initiation of the process of surplusing and sale of the 5 parcels described herein. Alternative Action(s): Do not authorize the process for surplusing and sale of the five properties at this time. Analysis: Prior to initiating the fairly lengthy process (9 to 12 months) required to sell City property (see attachment 1), City Council review of these five parcels is recommended. As indicated in the timetable and Procedural Checklist (attachment 2) the decision by the City Council to declare the properties surplus and solicit bids would be expected in February or March, 1997. Considerable staff time and some expenditures for appraisals and title reports is required for the interim steps prior to such City Council action. As indicated in the attachments, zone variances would be necessary on some of the parcels and General Plan conformance is required on all parcels prior to declaring them surplus. These steps would be completed prior to preparation of a City Council Resolution directing the disposition of 3). surplus real property as required by the City's Surplus Property regulations (attachment RCQUEST FOR COUNCIL ACTT MEETING DATE: September 23, 1996 DEPARTMENT ID NUMBER: AS 96-044 Following is a brief description of the five potential surplus properties: Parcel #1�. was previously declared surplus by the City in 1989 but could not be sold. It consists of a combination of two parcels totaling about 6.1 acres which were originally acquired from the developers of the adjacent residential tracts. The property has a peat soil condition that has inhibited development proposals. Parcel #2 consists of four lots left from the old City Yard on Alabama Street. Most of the old City Yard was developed as single family residences. Parcel #3, 4. & 5 are the incremental remainder parcels of lots left over from the City's Yorktown Street widening project. The remaining portions may possibly be considered as single family residential building sites with proper zone variances. Each of these three lots had single family residences as improvements which were removed for the street project. The remaining narrower parcels have value if they can be built on as single family residences or possibly attached to the contiguous parcels for building expansion. Upoh completion of the process described above, the City Council can evaluate the advisability of offering these parcels for sale. Factors to be considered at that time will be real estate market conditions, input from departments or other agencies on alternative potential uses, community input from adjacent property owners, estimated proceeds, and other factors that may be raised during the review process. (2 months) 7) Request for Council Action requesting approval of Resolution (HBMC 3.06.010(b) & (a) Property be declared surplus. (b) Specify procedures to be followed: - Sale or Exchange - All cash or terms - Sealed Bid or Public Auction - Deposit requirements - Method of determining minimum bids - Sale to adjacent owners - Use of private real estate agents/commission (c) Statement as to how the City acquired the property. 8.) Prepare surplus property information packets with maps. Set date to open bids or have public auction. 9.) Mail out packets to those local builders or local interested parties on mailing list, advertise as required in local newspaper and post properly. Use other advertising methods as desired. (6 weeks) 10.) Prepare Sales Agreement for execution when bids opened or auction completed. (2 months) 11.) Open sealed bids or receive oral bids as required by type of sales method. 12.) If property is sold, receive deposit and have buyer execute Sales Agreement. 13.) RCA to City Council for approval of final offer and authorize City Officials to execute Sales Agreement and other documents as necessary and open escrow if determined necessary. 14.) Follow up until Escrow closes (retain mineral rights). (3 months). (a) The City Administrator shall inform the Council when real property belonging to the city is surplus to the needs of the city and recommend to the Council that a resolution be adopted directing the disposition of such surplus real property. (b) Resolutions directing the disposition of surplus real property shall declare that the public interest and necessity require the disposition of surplus real property, and shall direct that the surplus real property be disposed of by sale or exchange and shall specify the procedures to be followed in each case. Sales may be made for all cash or on terms. The resolution shall provide that independent appraisals be obtained to establish fair market value of properties being disposed of except in circumstances where the value of the surplus real properties does not justify the expense of the appraisal. Fair market value is the amount that would in all probability have been arrived at between owner willing to sell and purchaser willing to buy. The fair market value appraisal shall have added to it all of city's costs of preparing land for sale including appraisal fees. The resolution shall contain a statement as to how and in what manner the city acquired the property. (c) Dispositions of surplus real properties shall be in accordance with the provisions of Articles 8 and 8.5 of Chapter 5 of Part 1 of Division 2 of Title 5 (commencing with section 54220) of the California Government Code when such statutes are applicable and may be made for cash or upon such terms as the Council in its resolution shall direct: When the Council determines that disposition of surplus real property to the owner of the real property adjacent or contiguous to the surplus real property is in the public interest,then,the surplus real property sha11_first be offered to such property owner on such terms as the Council shall deem just. No surplus real property shall be disposed of in violation of any land use regulation of the city,and insofar as possible dispositions shall be made to implement and further such regulations. No surplus real property shall be transferred or sold which in itself, as a separate parcel, may not be developed in accordance with provisions of the state Map Act and the subdivision and other applicable ordinances of the city unless such surplus real property is transferred or offered for sale to an adjacent property owner. In the event more than one property owner, adjacent to said surplus real property, desires to acquire ownership of said surplus real property,then the city shall decide the manner in which to divide said surplus real property for transfer or sale to said adjacent property owners. (d) The City Council,by resolution, shall declare when it is in the best interest of the city to exchange city-owned surplus real property for other real property. (2262-3178,2380-7r19, 2500-8/81) (e) Sales, conveyances, and leases of real property to the Redevelopment Agency of the City of Huntingotn Beach for a redevelopment project shall be exempt from the provisions of this section. In all instances where the city disposes of surplus real property when the city owns the mineral rights,the instrument of conveyance shall contain the following reservation,retaining for the city such rights: "EXCEPTING therefrom all oil, gas and other hydrocarbon substances and minerals lying below a depth of 500 feet from the surface of said land,but without the right of surface entry at any time upon said land or within the top 500 feet thereof, for the purpose of exploiting, developing, producing,removing and marketing said substances." The City acquired the entire lot including the residence located on the property which is scheduled to be removed. Upon removal we will have a vacant lot 30' by 115' which might support a single family residence given a zoning variance. Given that variance the vacant lot might be worth $75,000. Unimproved 6.117±ac. located north of Marilyn Drive and east of Dale Vista Lane, adjacent to Irby Park. The City Council declared this property surplus (1989) Approximately 26 to 33 homes and park addition might be developed from this R1 property. Soils Reports indicate a serious peat bog problem underlying the surface - from 2' to 12' thick in areas. The original developers in this area, being aware of the condition, dedicated the land to the City. A builder might find it economical to remediate the soil condition and construct homes depending on the current real estate market conditions. There are several architectural drawings showing possible residential lot and street scenarios for the property Pricing this property for sale is difficult because of the unknown cost of remediating the soil. Preliminary estimate of sale today might range from$1,500,000 to $2,250,000. 2. 4 Vacant Lots - Remnant of Old City Yard at Alabama St/Nashville south of Adams This parcel of land consists of four (4) lots with the equivalent of RMH-A Zoning, might support 4 single family residents or if lot consolidation occurs, a seven unit apartment complex. Estimated current range of value for the parcel - $300,000 to $400,000. 3. 602 Yorktown The north 20' of this 60' wide lot plus a radius on England Street was needed for the Yorktown Street right-of-way project. The City was required to acquire the entire property including the residence, that was demolished, to allow the street r/w improvements to be installed. We now have a remainder lot approximately 40' x 125' which should support a single family residence with a zone variance. BEA H INTER-DEPARTMENT COMMUNICATION Le"NNAGEMENT HUNTINGTON BEACII - E To Florence Webb From Les Evans Acting Deputy Director, Planning City Engineer Subject Review'of Soils Investigation in the Date August 5, 1982 Irby Park Area �• Subsurface soil investigations for Preliminary Soils Reports were made for Tract 5557 and Tract 7498 which are adjacent to the subject site. The in- vestigations were made by two different firms approximately eight years apart. The boring logs for both subdivisions include subsurface data for the subject site. All ten borings for the undeveloped property show zones of peat and peaty clay between beds of very fine sandy silt and fine sand. In several places 'the peat layers are up to twelve feet thick. In the 1963 report (Tract 5557) , the soils engineer indicated that the south- east portion of the tract was unsuitable for building due to the presence of predominately organic soils. The 1971 report, however, remanded removal of the peat and peaty clay from the uppernnst zones (3 to 13 feet) and replacement with clean compacted ✓ fill. The lower zones of meat and peaty clay (10 to 19 feet below grade) were described as similar to the upper zones_, but able to perform satisfactorily under the anticipated surcharge conditions without excessive settlements. Attached are eopies,of the borings taken on the subject site. The worst areas of the subject site appear to be near test borings 6, 8, and 9. Excavation of up to twenty feet may be necessary in these areas. Through- out the remainder of the site, excavations and removals of the top eight to ten feet' of material should be adequate to insure buildable sites. Based on this information, the site appears to be suitable for development.
