/Circulating Petition: Proponents may begin circulating the petition after publication of the title and
summary prepared by the city attorney (§ 9207) and must be file it within-180 days from the date of n
receipt of the title and summary from the Election Official.

Filing Petition: All sections of the petition must be filed at one time in the office of the Election Official i
during normal business hours as posted (§ 9208). The Election Official shall accept the petitions for a a
prima facie check to include a determination of the number of registered voters reported by the county
elections department to the Secretary of State effective on the publication date of the notice of intention, v
conduct a quick count of the signatures and a brief review to determine if any are not valid, e.g., address e
missing, someone other than voter added address, voter outside city, declaration of circulator missing, P
etc. If the prima facie check shows sufficient signatures, the petition shall be filed at that time. Petitions e
not accepted for filing shall be returned to the proponents (§ 9210). [An Initiative Petition Checklist can t

A copy of Section 84305 of the Government Code shall be provided by the Election Official to the o
proponents of a local initiative or referendum at the time of filing the petitions. (§ 16, EC) n

Withdrawal of local initiative or referendum measures shall be effective upon receipt by the appropriate
local elections official of a written notice of withdrawal signed by all proponents of the measure (§ 9604).
Checking Signatures: Once filed, the city clerk has 30 days, Saturdays, Sundays and holidays
excepted, in which to verify signatures on the petition by checking all signatures or by random sampling
pursuant to § 9114 & § 9115. Random sampling is a technical process that should not be attempted
without checking with your county election department. If the statistical sampling shows that the number
of valid signatures is within 95 to 110 percent of the number of signatures of qualified voters needed to
declare the petition sufficient, the elections official shall, within 60 days from the date of the filing of the
petition, excluding Saturdays, Sundays, and holidays, examine and verify each signature filed.
Notifying Proponents: The Election Official must notify the proponents as to the sufficiency or
insufficiency of the petitions and must cerVU

(§ 17200). Public access to the petition is restricted in accordance with § 6253.5, Government Code.
Proponents, of course, are allowed to review the petition if it did not qualify.
Notifying City Council:The Election Official must certify a sufficient petition to the city council at the next
regular meeting (§§ 9211, 9114). [A Certificate of Sufficiency / Insufficiency can be found in the
Forms section of the Election Handbook.] The legislative body may refer the proposed initiative
measure to any city agency or agencies for a report on its effect on municipal operations. The report shall
be presented to the legislative body within the time prescribed by the legislative body but no later than 30
days after the Election Official certifies to the legislative body the sufficiency of the petition (§ 9212)
Adopt or Call for Election: If the petition contains signatures representing 15% or more of the registered
voters of the city and contains a request that the ordinance be submitted immediately to a vote of the
people at a special election, the legislative body shall do one of the following:
(a) Adopt the ordinance, without alteration, at the regular meeting at which the certification of the
petition is presented, or within 10 days after it is presented.
(b) Immediately order a special election, to be held pursuant to subdivision (a) of Section 1405, at
which the ordinance, without alteration, shall be submitted to a vote of the voters of the city.
(c) Order a report pursuant to Section 9212 at the regular meeting at which the certification of the
petition is presented. When the report is presented to the legislative body, the legislative body
shall either adopt the ordinance within 10 days or order an election pursuant to subdivision (b).
Sections 1405, and 9214 requires the election to be held between 88 — 103 days from the date the
resolution ordering the election was adopted.

Petition for Submission to Voters of Proposed Amendment to the Charter of the City of Huntington Beach
The City Attorney has prepared the following title and summary of the chief purpose and points of the
proposed measure:
A proposed initiative measure which would amend the Charter of the City of Huntington Beach to change,
effective with the 2004 general municipal election, the total number of elected city councilmembers from
seven persons to five persons; to provide that the five councilmembers shall be elected by district rather than
at large; and to impose a two -term limit on elected councilmembers.
The proposed initiative measure would amend Sections 300 and 704 of, and add Sections 314, 315,
316, 317, 318 and 319 to, the Charter of the City of Huntington Beach. Under the current Charter, the
elective officers of the City, each with a four-year term, consist of a city council of seven members, a City
Clerk, a City Treasurer and a City Attorney. The proposed initiative measure, to be effective with the 2004
general municipal election: (1) would decrease the number of elected councilmembers from seven persons
to five persons; (2) would require that the five councilmembers be elected by district rather than at large; (3)
would divide the City into five separate, geographically described districts as nearly equal in population as
practicable; (4) would establish a district residence requirement for each elected councilmember; (5 would
provide for redistricting within six months following the completion of each federal decennial census; and
(6) would impose a two -term limit on each elected councilmember. The proposed initiative measure would
have no effect on the elective offices of City Clerk, City Treasurer or City Attorney.
