A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH AUTHORIZING
DESTRUCTION OF CERTAIN CITY RECORDS
WHEREAS, Government Code sections 34090 , 34090 .5 , 34090 .6 and
81009 provide, among other things, that certain public records may
be destroyed with the consent of the City Attorney and concurrence
of the City Council; and
The City Clerk has caused to be reproduced on microfilm two
copies of various public records, documents, instruments and
papers, and requests permission to destroy such records; and
The City Attorney of the City of Huntington Beach consents to
the destruction of such records,
NOW, THEREFORE, BE IT RESOLVED by the . City Council of the
City of Huntington Beach that approval is hereby given for the
destruction of:
1 . Campaign statements of successful. candidates for
elective office and committees supporting such candidates or
committees supporting successful measures. . .
2 . Campaign statements of unsuccessful candidates for
elective office, their committees and committees supporting
unsuccessful. measures.
3 . Copies of Statements of Economic Interests of elected
officers and Economic Statements of City employees terminated
and/or over seven years old and nomination papers and statements
of qualifications of elected officers are also included .
4 . Conditional use permits, parcel maps, divisions of land,
tract files, Public Works contracts, consultant contracts and/or

Notwithstanding any of the foregoing, no record shall be
destroyed which is expressly required to be retained under

STATEMENT OF ISSUE
Under Section 34090.5 of the Government Code, records which have been microfilmed may
be destroyed under certain conditions, and with the authorization of the City Attorney
and Resolution of the City Council . Storage space in the Clerk's vault is of prime
concern.
RECOMMENDATION
Adopt Resolution No. Sz S$ allowing the City Clerk to destroy certain microfilmed records
and retain agreement records for a period prescribed by law.
ANALYSIS
Pursuant to S. 34090 and 34090.5 and the attached Resolution which has been prepared
subsequent to these codes, allows for the destruction of all cash contracts upon which
the notice of completion and final payment have been made. Inactive agreement files
from A-Z have been microfilmed and will be destroyed 5 years from the date of this
resolution.
FUNDING SOURCE
None required.
ALTERNATIVE ACTION
Do not destroy records and purchase additional storage files.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH AUTHORIZING DESTRUCTION OF
CERTAIN CITY RECORDS
WHEREAS, Government Code sections 34090, 34090. 5 and
34090. 6 provide, among other things , that certain public records
may be destroyed with the consent of the City Attorney and con-
currence of the City Council; and

3. Agreements , A through Z, over five years old.
Notwithstanding any of the foregoing, no record shall be
destroyed which is expressly required to be retained under
California Government Code section 34090.

RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH APPROVING THE DESTRUCTION
OF CERTAIN CITY RECORDS .
WHEREAS, Section 34090 of the California Government
Cod.e provides for the destruction of non-excepted. city records
not less than five years old, with the approval of the Council
and, with the consent of the City Attorney, by resolution; and.
The City Clerk has in his custody written reports of
damage to city property commencing with the year 1959 and. con-
tinuing through the year 1963, and he has requested. a resolu-
tion of d.estruction in connection with such records; and.
Such record.s d.o not fall within the excepted. categor-
ies under said. Section of the Government Cod.e; and
The City Attorney has given his written consent for
the destruction of such records;
NOW, THEREFORE, the City Council of the City of
Huntington Beach resolves as follows :
The City Council approves of the d.estruction of all
written reports of damage to city property commencing with the
year 1959 and. �continuing through the year 1963, now in the
custody of the City Clerk.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting held. on the 17th
day of February 1969.

City of Huntington Beach, California, at the request of the
City Clerk, hereby consents, subject to the approval of the
City Council by resolution, to the d.estruction of all written
reports of damage to city property commencing with the year
1959 and. continuing through the year 1963, now in the custody
of the City Clerk.
