RESOLUTION NO. 5784 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING DESTRUCTION OF CERTAIN CITY RECORDS WHEREAS, Government Code sections 34090 , 34090 .5 , 34090 .6 and 81009 provide, among other things, that certain public records may be destroyed with the consent of the City Attorney and concurrence of the City Council; and The City Clerk has caused to be reproduced on microfilm two copies of various public records, documents, instruments and papers, and requests permission to destroy such records; and The City Attorney of the City of Huntington Beach consents to the destruction of such records, NOW, THEREFORE, BE IT RESOLVED by the . City Council of the City of Huntington Beach that approval is hereby given for the destruction of: 1 . Wentworth, City Clerk( ------- Subject: Destruction of Records 1 _ — --------'-"-'-""- CITY C K' �eS• I�S 2�$ Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: Or STATEMENT OF ISSUE Under Section 34090.5 of the Government Code, records which have been microfilmed may be destroyed under certain conditions, and with the authorization of the City Attorney and Resolution of the City Council . Storage space in the Clerk's vault is of prime concern. RECOMMENDATION Adopt Resolution No. Sz S$ allowing the City Clerk to destroy certain microfilmed records and retain agreement records for a period prescribed by law. ANALYSIS Pursuant to S. 34090 and 34090.5 and the attached Resolution which has been prepared subsequent to these codes, allows for the destruction of all cash contracts upon which the notice of completion and final payment have been made. Inactive agreement files from A-Z have been microfilmed and will be destroyed 5 years from the date of this resolution. FUNDING SOURCE None required. ALTERNATIVE ACTION Do not destroy records and purchase additional storage files.
