Flynn, CIVIC, City Clerk SUBJECT: Adopt Resolution No. 2011-50 appointing the City Clerk as Housing Authority Clerk Statement of Issue: On March 7 ,, 2011, the City Council adopted Resolution No. 2011-18 to establish a Housing Authority in accordance with the California Housing Authorities Law. It is necessary to appoint a Housing Authority Clerk. Financial Impact: Not applicable. Recommended Action: Motion to: Adopt Resolution No. 2011-50, "A Resolution of the City Council of the City of Huntington Beach to amend Resolution No. 2011-18 by appointing the City Clerk as Housing Authority Clerk." Alternative Action(s): None. Analysis: Resolution No. 2011-18 provided direction to "appoint the Mayor of the City of Huntington Beach as the chairperson of the Housing Authority until such time as a successor chairperson is appointed by the commissioners of the Housing Authority pursuant to Section 34277 of the Housing Authorities Law." However, it failed to appoint a Housing Authority Clerk. Therefore, it is now necessary to amend Resolution No. 2011-18 by adopting Resolution No. 2011-50 to appoint a Housing Authority Clerk. Appointing the City Clerk into this position is consistent with other City agencies the Mayor chairs such as the Redevelopment Agency, the Public Finance Authority, and the Civic Improvement Corporation. Environmental Status: The creation of a housing authority has no significant effect on the environment; therefore, the activity is not subject to CEQA. HB -475- Item 19. - 1 Item 19. - 2 HB -476- RESOLUTION NO. 2011-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING CITY COUNCIL RESOLUTION NO.2011-18 BY AMENDING SECTION 9 THEREOF TO APPOINT THE CITY CLERK AS HOUSING AUTHORITY CLERK WHEREAS, on March 7, 2011, pursuant to Section 34242 of the Housing Authorities Law, the Huntington Beach City Council adopted Resolution No. 2011-18 to establish the City of Huntington Beach Housing Authority (the "Housing Authority") and It is necessary to amend Resolution No. 2011-18 to appoint the Huntington Beach City Clerk as Clerk to the Housing Authority, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. Section 9 of Huntington Beach City Council Resolution No. 2011-18 is hereby amended to read as follows: 9. The Mayor of the City of Huntington Beach shall serve as the chairperson of the Housing Authority until such time as a successor chairperson is appointed by the commissioners of the Housing Authority pursuant to Section 34277 of the Housing Authorities Law. The City Clerk of the City of Huntington Beach shall serve as the Housing Authority Clerk, and the term of office and succession of the Housing Authority Clerk shall be concurrent with and identical to the term and succession of the City Clerk. 2. This resolution shall become effective immediately upon adoption.
