BIGGS, Director of Economic Development a SUBJECT: Approve Community Development Block Grant (CDBG) — b Enhancement Areas Statement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: The U.S. Department of Housing and Urban Development has provided the City with areas eligible to be Enhancement Areas, based upon Census 2000. Staff has reviewed the data, as has the Citizens Participation Advisory Board (CPAB). City Council is asked to approve the Enhancement Areas as recommended. Funding Source: Not Applicable. Recommended Action: Motion to: 1. Approve eight Community Development Block Grant (CDBG) Enhancement Areas within the City of Huntington Beach. Alternative Action(s): Deny recommended action and approve only default 51% low- moderate income block groups as Enhancement Areas. Analysis: The U.S. Department of Housing and Urban Development (HUD) gives participating jurisdictions an annual allocation of Community Development Block Grant (CDBG) funds, which are for the purpose of improving the quality of life for low and moderate-income residents. Eligibility for Public Service activities, including health care, senior services, educational services, is determined on a case-by-case basis, dependent upon the individual's household income. However, eligibility for projects including Public Facilities and Improvements, Code Enforcement, Infrastructure Improvements is based in part upon the geographic location of a proposed project or activity. HUD's basic criteria to determine a low moderate-income area is based upon Census 2000 data and the percentage of residents within a Census Tract Block Group where 51% of the 7- 2 kE QUEST FOR COUNCIL ACT'wiil MEETING DATE: December 15, 2003 DEPARTMENT ID NUMBER: ED 03-34 residents have household incomes at the low or moderate rate, as determined by HUD. Huntington Beach is an exception jurisdiction where the percentage of individuals meeting the low and moderate income criteria may be less than 51% in order to identify a larger geographic area in which to be able to allocate CDBG funds. HUD has established the exception percentage for Huntington Beach at 40.3%. Staff has reviewed all potentially eligible block groups, and with the exception of those potentially eligible areas where the infrastructure is privately maintained, staff recommends inclusion of the potentially eligible areas as shown in Attachment 1. This decision would allow the greatest City flexibility in terms of funding projects and activities for the duration of the Census 2000 Enhancement Areas, which will most likely remain in effect until data from Census 2010 is available. The Citizen Participation Advisory Board (CPAB), the City Council-appointed board which makes recommendations to City Council on CDBG funding, has also reviewed and discussed the information on Enhancement Areas. CPAB concurs with staff on the inclusion of the eligible areas presented. As a result of their deliberations, CPAB has identified eight Enhancement Areas, with boundaries and identifiers as indicated within Attachment 1. If approved, the eight Enhancement Areas would be labeled: • Bolsa-Chica Heil • Goldenwest • Washington • Oak View • Newland • Garfield ■ Yorktown ■ Adams A decision to not adopt the exception areas, but rather to only identify the 51% low- moderate income geographic areas as Enhancement Areas, would substantially limit the City's flexibility to execute any public improvement projects or activities in future years. Upon approval of the recommended action or an alternate action, the approved Enhancement Areas will be immediately in effect, and CDBG applications for funding for the 2004/2005 program year will be available and distributed to interested agencies. Current California Redevelopment Law (California Health & Safety Code, Section 33333.6(e)(2)) provides for eliminating this time limit after January 1 , 2002. The Agency is currently in the process of re-issuing Agency debt that includes the financial analysis without this time limitation. If City Council approves an ordinance this change to the redevelopment plan will become effective. Funding Source: Not Applicable Recommended Action: Adopt City Ordinance approving the elimination of the time limits to incur indebtedness for the Huntington Beach Redevelopment Project. Alternative Action(s): Do not approve the Ordinance. Analysis: Approved in 2001 , the California Legislature enacted SB211 that became effective January 1 , 2002, ("SB211"). SB211 provided, among other things, that at anytime after its effective date, the limitation on incurring indebtedness contained in a redevelopment plan adopted prior to January 1 , 1994, might be deleted by ordinance of the legislative body (California Health & Safety Code, Section 33333.6(e)(2)). RcmUEST FOR COUNCIL ACTIor MEETING DATE: July 15, 2002 DEPARTMENT ID NUMBER: ED-02-20 The Huntington Beach Redevelopment Project, adopted by Ordinance 3343 on December 16, 1996, merged five project areas into one project with January 1, 2014 set as the time limit for the issuance of debt. Each original forty-year project life of the five sub-areas remains in effect, which range from 2022 to 2024. Functionally, the ability to incur debt or refinance will now become a factor of the remaining life of the redevelopment plan and the last date to collect tax increment rather than a specific date set in the Redevelopment Plan. In recent Official Statements for bond issuance and in the current refinancing of the Agency's debt, the financial analysis considers such deletion of the time limit. Now that January 1, 2002 has passed, it is an appropriate opportunity to amend the plan to eliminate this time limitation. This change will allow for more flexibility in financing or refinancing of existing debt. Approving the proposed Ordinance does not affect any other provision of the Plan including the limitations on the cumulative tax increment that can be received ($850 million) or on the time limitations on the collection of tax increment with respect to the constituent redevelopment projects (Main-Pier Original Area, Main-Pier Amendment Area, Oakview, Talbert-Beach, Yorktown-Lake, and Huntington Center). Additionally, this amendment is exempt from the requirements of the California Redevelopment Law (Section 33450), in general, meaning the public hearing and noticing requirements. As the Redevelopment Agency already has tax sharing agreements with the affecting taxing agencies, this change would not affect the existing statutory pass through payments.
