(Attachment No. 1) The revisions proposed will allow for greater flexibility in the financial participation of the Agency in the In-Lieu Parking Program. Funding Source: Not Applicable. Recommended Action: Motion to: 1. Adopt Resolution No. 376 , "A Resolution of the Redevelopment Agency of the City of Huntington Beach Repealing Resolution No. 268, Providing New Guidelines for Consideration of Financial Participation in the In-Lieu Parking Fee Program." Alternative Action(s): 1. Do not repeal Redevelopment Agency Resolution No. 268. 2. Direct staff accordingly. REQUEST FOR REDEVELOPMENT AGENCY ACTION MEETING DATE: 7/6/2009 DEPARTMENT ID NUMBER: ED 09-39 Analysis: On November 20, 1995, the Redevelopment Agency Board approved Resolution No. 268 which adopted guidelines concerning the financial participation of the Agency in the Downtown In-Lieu Parking Program. (Attachment No. 2) The Resolution indicated that the Agency shall consider its participation on a case by case basis. However, if the Agency decided to participate in a project which required in-lieu fee parking spaces, the Resolution required that the Agency pay one-half (1/2) of the in-lieu parking fee. The Resolution repealed all prior resolutions which conflicted with Resolution 268 upon its adoption. In repealing Resolution No. 268, the Redevelopment Agency will have greater flexibility in the amount of assistance it provides, should the Agency decide to participate in a project which requires in-lieu parking fees. The original intent of the Agency's participation in the Downtown In-Lieu Parking Program was to assist in stimulating economic growth in the Downtown through attraction of desired tenants. This goal has been met through the Agency's participation in the parking in-lieu program. However, the mandate that the Agency contribute one-half of a project's in-lieu parking fees limits the Agency's ability to assist multiple projects. Several tenants have sought the Agency's assistance. The assistance could be a yearly payment plan for the in-lieu fees, payment of a portion of the fees, or other actions intended to assist tenants and property owners in meeting in-lieu parking requirements. Repealing Resolution No. 268 would allow the Agency to tailor the amount of in-lieu parking fee assistance it provides based on the merits of individual projects without requiring financial participation. This will also allow the Agency to maximize the return of Agency assistance to the City through these tailored projects. Staff recommends the Agency repeal Resolution No. 268. The Agency now desires to amend the guidelines adopted in Resolution No. 268, NOW, THEREFORE, the Redevelopment Agency of the City of Huntington Beach does hereby resolve as follows: SECTION 1: That the Redevelopment Agency shall consider any participation in the In- Lieu Parking Fee Program on a case-by-case basis. SECTION 2: That Resolution No. 268 and all other resolutions in conflict herewith are hereby repealed.
