[ ] yes [ ] New Policy or Exception CITY CO Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: 074-� STATEMENT OF ISSUE: Disclosure of property ownership by Deputy City Attorney Sarah Lazarus within the Talbert -Beach Redevelopment Project Area. RECOMMENDED ACTION No action need be taken; this is solely a disclosure requirement. ANALYSIS• Section 33130.5 of the California Health & Safety Code ("the Code") allows an employee of the Agency or City to acquire property within a redevelopment project area for personal residential use. Section 33130 of the -Code prohibits any officer, employee or agent from acquiring property not used as a personal residence within any redevelopment project area in the City and requires formal disclosure to both the Agency and City of any existing ownership interest which is not for residential purposes. Such disclosure must appear on the minutes of the hearing at which it was made. Deputy City Attorney Sarah Lazarus has owned property within the Talbert -Beach Redevelopment Project Area (Capewoods Condominium Project) for approximately four years and has used it for personal residential purposes. Ms. Lazarus declared a conflict of interest upon acquiring the property and therefore has never participated and will not participate in any work or decision -making on any matter which has concerned or will concern the Talbert -Beach Project Area. Ms. Lazarus recently purchased property in an area not covered by a redevelopment plan and is using that property for her personal residence. The Capewoods Condominium is being held by her as rental property. Pursuant to Code § 33130, this Request for Council/Redevelopment Agency Action shall constitute disclosure of Ms. Lazarus' .� interest in property within the Talbert -Beach Project Area.
