Statement of Issue:
A review of the city's comprehensive fee schedule has been conducted utilizing the services
of MGT of America, Inc., a consulting firm specializing in fee and cost allocation studies. In
order to reflect changes in costs to provide city services, it is requested that the
comprehensive fee schedule be updated by adopting the recommended fee amounts on the
attached fee schedules.
Funding Source:
No funding is required. Additional General Fund revenue for FY 2009/10 and beyond is
projected and discussed in the Analysis section below.
Recommended Action: Motion to:
1. Conduct a public hearing.
2. Adopt Resolution No. 2009 - 31 "A Resolution of the City Council of the City of
Huntington Beach establishing a citywide user fee schedule and repealing Resolution No.
2007-58 and all supplemental resolutions hereto."
3. Adopt Resolution No. 2009 - 32 "A Resolution of the City Council of the City of
Huntington Beach establishing a citywide development fee schedule and repealing
Resolution No. 2007-59 and all supplemental resolutions hereto."

Alternative Action(s):
1. Do not adopt updated fee schedule and leave fees at current levels.
2. Make changes to the recommended fee schedules and adopt as amended.
Analysis:
The City of Huntington Beach charges fees for providing various services and programs to
residents and visitors. These fees include providing cultural and recreational activities,
issuing building permits, activating residential water and sewer accounts, conducting
inspections of commercial buildings to ensure fire safety, and many other services. Charging
appropriate fees helps to offset the cost of providing these services. The revenue is
deposited into the General Fund.
Revenues received from user and development fees, recreational programs, facilities rentals,
and parking fees comprise approximately 12% of General Fund revenue (based on FY
2008/09 projections). At their current amounts, the various fees charged recover
approximately 68% of the citywide costs of service delivery.
In order to ensure appropriate fee amounts are being assessed, the city employs the
assistance of professional fee study consultants. Their recommendations are then used by
staff to review current fee levels, and where appropriate, adjust them to appropriate cost
recovery levels.
The last full cost recovery study was conducted in fiscal year 2004/05. Based on the results
of that study, City Council reviewed and approved adjustments to the comprehensive fee
schedule on November 21, 2005. On September 4, 2007, additional, minor updates to the
comprehensive fee study were made based on the change in the Consumer Price Index
(CPI). Since then, minor adjustments involving Planning (i.e., newsrack fee) and parking
fees (i.e., The Strand) have been made.
During FY 2008/09, the services of MGT of America, Inc. were utilized to conduct an updated
citywide cost recovery study. Regular review of the city's comprehensive fee schedule
utilizing the services of a professional cost recovery firm is a prudent practice to evaluate city
processes, determine the impact of improvements/efficiencies, and assure that the city is
charging the appropriate level of costs for providing various city services.
While the explanations below will show that some fees are recommended to be increased, it
should also be noted that other fees are being proposed to be reduced or kept at current
levels. Based on analysis by the consultants as well as staff recommendations,
approximately 47% of fees have recommended amounts equal to or less than what is
currently being charged.
In the aggregate, the city's General Fund, in FY 2009/10, could see revenue enhanced by
$500,000 to $1,000,000 should the recommended fees be adopted by City Council. This will
offset the increased cost to provide the services. The paragraphs to follow provide
additional, detailed analysis of the changes sought to each type of fee.

User Fees (Attachment#1)
Historically, user fees are utilized to recover costs for services, which directly benefit the
individual or entity requesting the service. Any costs not recovered through user fees are
paid (supported) with proceeds of taxes (e.g., General Fund revenue). With the assistance
of MGT of America, Inc., staff has developed the recommendations for City Council reflected
in Attachment#1.
It should be noted that Huntington Beach strives for 100% cost recovery through user fees.
However, some proposed fees in Attachment #1 are being reduced so as not to be over the
100% cost recovery threshold. At the 100% cost recovery level, user fee activities recoup
the labor and overhead costs of providing the service while not requiring General Fund
support.
If approved by City Council, the user fees would become effective immediately on June 16,
2009.
Development Fees (Attachment#2)
Development fees represent charges to recover costs of city services pertaining to
development activity: plan reviews, conditional use permits, tract map reviews, grading and
landscape permits, etc. As with user fees, 100% cost recovery is the goal for some
development fees so that the General Fund does not support these services.
MGT of America, Inc., in consultation with city staff, have reviewed the costs involved in
providing the various development services related to Planning, Building and Safety, Public
Works, and Fire. As with user fees, the amount charged for development fees cannot
exceed the actual cost of providing the services.
In order to mitigate the impact of increasing certain development fees, it is proposed to have
a "phased" implementation of pre-entitlement (e.g., Planning) development fees. While the
goal is 100% cost recovery, the phased implementation would allow for that goal to be
reached over a three-year period.
That is, the phased approach would increase pre-entitlement development fees by
approximately 80% cost recovery amount in FY 2009/10, then approximately 90% in FY
2010/11, and 100% in FY 2011/12. In addition, some fees have been rounded down to the
nearest whole number for administrative purposes.
Using the Planning Department's Coastal Development Permit as an example, the 100%
cost recovery amount of$6,348 would not be implemented until FY 2011/12. In FY 2009/10,
the amount would increase $823, from the current amount of $4,255 to $5,078. In 2010/11,
the fee would increase to $5,713 and finally in 2011/12, the fee would achieve 100% cost
recovery at $6,348.

Finally, there are two changes to the Development Fees attachment from the materials
presented at the June 1, 2009 Study Session. First, several Building & Safety Department
Development Fees are charged based on the value of the building being constructed. Pages
8 through 12 of the Building & Safety Development fee packet are the valuation table that will
be used to calculate these fees. Second, the Planning Department Fees reflect the "phased"
implementation approach. We have presented the recommended fees effective in 2009
along with the ultimate fees to be charged in 2011.
If approved by City Council, these fees will become effective sixty days hence (August 16,
2009.)
Facility Rentals/Recreational Services Fees (Attachment#3)
Attachment #3 encompasses facility rentals and recreational/cultural program fees charged
by the Library Services and Community Services Departments.
Many of these programs have recommended fees that are below the 100% cost recovery
threshold. The practice of supporting certain social, cultural, and recreational programs
allows for the continued provision of affordable recreational and cultural services to the
residents of Huntington Beach. As an example, some youth recreational programs as well as
the Library's interlibrary loan program charge fees below the 100% cost recovery level.
However, in reviewing facility rental and parking fees, there is justification for not providing
such General Fund support. For example, the majority of proposed rental rates assessed by
the Library were increased by 10%. It has been over six years since those fees were last
adjusted. The recent rehabilitation of the Central Library has drastically improved the quality
of rental facilities. The increased maintenance costs associated with this upgrade can be
partially offset by the proposed rental rate increases.
Upon approval by City Council, these fees would become effective June 16, 2009.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING A CITYWIDE USER
FEE SCHEDULE AND REPEALING RESOLUTION NO. 2007-58
AND ALL SUPPLEMENTAL RESOLUTIONS THERETO
WHEREAS, on September 4, 2007, the City Council adopted Resolution No. 2007-58
establishing a City fee schedule for user fees charged to the public; and
The City Council desires to update existing fees charged to the public; and
The City Council has reviewed the comprehensive fee study prepared by MGT America
dated May 1, 2009 ("MGT report"). Pursuant to the MGT report and staff recommendation, the
fees do not exceed the reasonable cost of providing the service for which the fee is collected; and
The City Council desires to establish fees consistent with MGT's report and staff
recommendation, and finds that according to the MGT report and staff recommendation, the fees
hereinafter established do not exceed the estimated reasonable cost of providing the service for
which the fees are imposed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach that the fees set forth in Exhibit "A" and adopted by this Resolution shall become effective
immediately following the adoption of this Resolution, and continue thereafter.
BE IT FURTHER RESOLVED that Resolution No. 2007-58 and all supplemental
resolutions thereto are hereby repealed
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular
meeting thereof held on the 15th_day of June , 2009.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING A CITYWIDE DEVELOPMENT
FEE SCHEDULE AND REPEALING RESOLUTION NO. 2007-59 AND
ALL SUPPLEMENTAL RESOLUTIONS THERETO
WHEREAS, on September 4, 2007, the City Council adopted Resolution No. 2007-59
establishing a fee schedule for development fees; and
The City Council desire to update existing development fees charged to the public; and
The City Council has reviewed a comprehensive fee study prepared by MGT America dated
May 1, 2009 ("MGT report"). Pursuant to the MGT report and staff concurrence, the fees do not
exceed the reasonable cost of providing the service for which the fee is collected; and
The City Council desires to establish fees consistent with MGT's report and staff
recommendation, and finds that the fees hereinafter established do not exceed the estimated reasonable
cost of providing the service for which the fees are imposed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach
that the fees set forth in Exhibit "A" and adopted by this Resolution shall be effective sixty (60) days
following the adoption of this Resolution, and continue thereafter.
BE IT FURTHER RESOLVED that the City Council of the City of Huntington Beach has
determined that due to current economic conditions, implementation of certain Development fees as
specifically identified in the attached Exhibit A, will go into effect in three phases to reach 100% of the
City's cost recovery.
BE IT FURTHER RESOLVED that Resolution No. 2007-59 and all supplemental resolutions
are hereby repealed.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular

RESOLUTION NO. 2009-33
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING A CITYWIDE
SCHEDULE FOR CHARGES FOR FACILITY RENTALS AND
RECREATION SERVICES AND REPEALING RESOLUTION NO. 2007-60
AND ALL SUPPLEMENTAL RESOLUTIONS THERETO
WHEREAS, the City imposes a charge on public access and use of certain City property for
the purpose of raising revenue; and.
The City Council desires to state new charges and update the existing amounts currently
charged to the public for access and use of City property; and
The City Council has reviewed a comprehensive fee study prepared by MGT America dated
May 1, 2009 ("MGT report"). Pursuant to the MGT report and staff concurrence, the fees do not
exceed the reasonable cost of providing the service for which the fee is collected; and
The City Council desires to establish fees consistent with MGT's report and staff
recommendation, and finds that the fees hereinafter established do not exceed the estimated
reasonable cost of providing the service for which the fees are imposed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach that the fees set forth in Exhibit "A" and adopted by this Resolution shall be effective
immediately following the adoption of this Resolution, and continue thereafter_
BE IT FURTHER RESOLVED that Resolution No. 2007-60 and all supplemental
resolutions thereto are hereby repealed.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular
meeting thereof held on the 15th day of June , 2009.

Dear Mayor Bohr:
On behalf of our Board of Directors, I want to thank City Staff for meeting with us on
Wednesday,June 10 to review the proposed development fees which will be on the
Council agenda for consideration on Monday, June 15.
Our comments are:
1. If the proposed fees are the true cost,the do not have a problem with the increases.
However, as in the past, we once again ask that you consider whether the'process being
reviewed is necessary and is it being_performed at a higher, and possibly more costly and
time consuming level than is required.
2.We were advised by staff that the proposed.increases are not connected to the budget
deficit. If that is the case,why,would you further burden the business community with
increased cost in a poor economy?
We ask that you hold off on the approval of the proposed fee increases scheduled for
October 10,2011 until all possible avenues of cost reduction are analyzed. The
Chamber is willing to meet with staff and assist in this process.
We commend the staff for the positive changes that have been made to date and
encourage you to go another step beyond what has already been accomplished..

schedule to address parking issues at various
City owned downtown parking locations as set
forth in Exhibit "A" attached hereto and
incorporated herein by this reference,
NOW. THEREFORE BE IT RESOLVED by the
City Council of the City of Huntington Beach
that the fees set forth in Exhihit"A"and adopted
by this Resolution shall be effective immediately
following the adoption of this Resolution, and
continue thereafter.

other charges or fees set forth in Resolution
No.2009-33 shall remain in effect.
